HomeMy WebLinkAboutO-12254J-02-586 7/2/02 ORDINANCE NO. 12254 AN EMERGENCY ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING ORDINANCE NO. 12128, AS AMENDED, THE ANNUAL APPROPRIATIONS ORDINANCE FOR FISCAL YEAR ENDING SEPTEMBER 30, 2002, TO REPROGRAM APPROPRIATIONS IN THE AMOUNT OF $100,000 FROM EXISTING CAPITAL IMPROVEMENT PROJECT NO. 326013, ENTITLED "DINNER KEY MARINA DINGHY DOCK REPLACEMENT," TO NEW CAPITAL IMPROVEMENT PROJECT NO. 326011, ENTITLED "DINNER KEY MARINA RENOVATIONS", FOR PIER IMPROVEMENTS AND OTHER FACILITY UPGRADES REQUIRED AT DINNER KEY MARINA; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE. WHEREAS, the City Commission adopted Ordinance No. 12128, as amended, the Annual Appropriations Ordinance, on September 25, 2001, establishing revenues and appropriations for the City of Miami, Florida, for Fiscal_Year ending September 30, 2002; and WHEREAS, the pilings at Dinner Key Marina are deteriorating and require immediate remediation; and WHEREAS, it is necessary to reprogram $100,000 of assessment lien revenue previously appropriated in Capital Improvement Project No. 326013, entitled "Dinner Key Marina Dinghy Dock Replacement", to a new Capital Improvement Project No. 326011, entitled "Dinner Key Marina Renovations", to replace these pilings; 12254 NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are adopted by reference and incorporated as if fully set forth in this Section. Section 2. Ordinance No. 12128, as amended, adopted September 25, 2001, the Annual Appropriations. Ordinance for Fiscal Year ending September 30, 2002, is further amended in the following particulars; l/ "Ordinance No. 12128 Section 7. Section 6 of Ordinance No. 11705, as amended, adopted September 28, 1998, Section 5 of Ordinance No. 11839, as amended, adopted September 28, 1999, and Section 7 of Ordinance No. 11970, as amended, adopted September 28, 2000, are further amended in the following particulars to revise previously approved Projects and establish new Projects to be initiated during Fiscal Year 2001-2002: The following appropriations in all Capital Improvement Projects are in the thousands of dollars. The FY 2002 Budget Allocation represents funding available from June 29, 2001 - Sept. 30, 2002. Total FY12002 Project Budget Appropriation Allocation V. All ordinances or parts of ordinances, insofar as they are in conflict with provisions of this Ordinance are repealed. Section 4. If any section, part of section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provision of this Ordinance shall not be affected. Section 5. This Ordinance is. declared to be an emergency measure on the grounds of urgent public need for the preservation of peace, health, safety, and property of the City of Miami, and upon further grounds of the necessity to make the required and necessary payments to its employees and officers, payment of its debts, necessary and required purchases of goods and supplies and to generally carry on the functions and duties of municipal affairs. Section 6. The requirements of reading this Ordinance on two separate days is dispensed with by an affirmative vote of not less than four-fifths of the members of the Commission. Gimenez City Manager DATE: FILE: SUBJECT: Emergency Ordinance Amending Previously Approved CIP Project at Dinner Key Marina to Facilitate REFERENCES Replacement of Pilings ENCLOSURES: RECOMMENDATION It is respectfully recommended that the City Commission adopt the attached Emergency Ordinance reprogramming $100,000 of assessment lien revenue previously appropriated in Capital Improvement Project No. 326013, Dinner Key Dinghy Dock Replacement, to a new Capital Improvement Project No. 326011, Dinner Key Marina Renovations. BACKGROUND Dinner Key Marina currently has 582 slips distributed over nine concrete piers, seven of which extend out into the basin, and two which run along the shoreline. Wooden finger piers, consisting of six pretreated piles, which are held in place by wooden, side, cross and header beams, serve the marina slips. All slips have three green heart piles, one in front of the finger pier and the other two out and by the sides, common to the next finger pier: The life expectancy for green heart piles is 15 to 20 years. Some of these piles date from 1986, and replacement of the piles should have begun some time ago. Attached are photos depicting the deterioration of the current piles. The replacement of these piles is necessary to ensure the safe operation of the Dinner Key Marina. The Department of Conferences, Conventions and Public Facilities recommends the reprogramming of the CIP Project to expedite the necessary replacement of these piles.
