ORDINANCE NO.
AN ORDINANCE OF THE MIAMI CITY COMMISSION
AMENDING CHAPTER 2/ARTICLE XI OF THE CODE OF
THE CITY OF MIAMI, FLORIDA, AS AMENDED,
ENTITLED "ADMINISTRATION/COUNCILS, COMMITTEES,
COMMISSIONS, TO FORMALLY ESTABLISH THE CITY OF
MIAMI SISTER CITIES PROGRAM AND ESTABLISH THE
SISTER CITIES COORDINATING COUNCIL (COUNCIL)
AND PROVIDE FOR THE "SUNSET" OF SAID COUNCIL;
TO SET FORTH SAID. COUNCIL'S PURPOSE, POWERS,
AND DUTIES; TO PROVIDE FOR MEMBERSHIP,
QUALIFICATIONS, TERMS OF OFFICE, VACANCIES,
OFFICERS, PARLIAMENTARY PROCEDURES AND RULES OF
PROCEDURE, MEETINGS, QUORUM, VOTING, ATTENDANCE
REQUIREMENTS, ASSIGNMENT OF STAFF, COUNSEL,
NOTICES AND FILING OF RECORDS AND ANNUAL
REPORTS; MORE PARTICULARLY BY ADDING NEW
DIVISION 16, CONSISTING OF SECTIONS 2-1215
THROUGH 2-1222, AND AMENDING SECTION 2-892 OF
SAID CODE; CONTAINING A REPEALER PROVISION AND
A SEVERABILITY CLAUSE.
WHEREAS, The City of Miami has participated in the
International and United States Sister Cities Programs through
its own Sister Cities Program; and
WHEREAS, Miami has established sister city• relationships
with more thanthirtycities since 1971; and
WHEREAS, Miami wishes to establish a structure and advisory
body for the administration of a Sister Cities Program;

NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to
this
Ordinance are
adopted by reference and
incorporated
as if
fully set forth in
this Section.
Section 2. Chapter 2/Article XI/Section 2-892, entitled
"ADMINISTRATION/COUNCILS, COMMITTEES, COMMISSIONS/"Sunset" review
of Councils.," is amended in the following particulars: J/
"Chapter 2
ADMINISTRATION
ARTICLE XI. COUNCILS, COMMITTEES, COMMISSIONS
DIVISION 1. GENERALLY
Sec. 2-892. "Sunset" review of Boards.
Commencing with the year 1995, each City Council
shall be reviewed in the following manner:
(4) The following Councils shall initially be reviewed
in the following years and shall be reviewed every
four years thereafter:

Section 3. Chapter 2/Article XI, entitled
"ADMINISTRATION/ COUNCILS, COMMITTEES, COMMISSIONS, is amended by
adding new Division 16, consisting of Sections 2-1210 through
2-1216, to.the Code of the City of Miami, Florida, as amended, in
the following particulars:/
"Chapter 2
ADMINISTRATION
ARTICLE XI. COUNCILS, COMMITTEES, COMMISSIONS
DIVISION 16. SISTER CITES COORDINATING COUNCIL
Sec. 2-1215. Established; sunset date.
(a) A limited. agency and instrumentality of the
City of Miami to be known as the "Sister Cites
Coordinating Council" is hereby established which shall
hereinafter be referred to as the "Council".
(b) Sunset date. This Council shall sunset on
December 31, 2011.
Sec. 2-1216 Continuation of the City of Miami Sister
Cities Program.
The City of Miami recognizes its ongoing
participation in the International and United States

Sister Cities Programs and seeks to continue the Cit
of Miami Sister Cities Program through the Council.
Sec. 2-1217. Purpose, powers and duties.
The purpose, powers and duties of the Council are:
(1) to serve in an advisory capacity for the City of
Miami Sister Cities Program to plan, implement, and oversee
the city's international, professional, technical,
educational and cultural exchanges, promotion and policies
to create and stimulate friendlv and meaningful
relationships.
(2) to form a committee for each sister city that will
have a President with significant cultural and business ties
to the sister city, said President to be appointed by the
Council;
(a) The sister cities committee president shall
recruit members from the community at large with
membership criteria emphasizing significant
cultural and business ties to the sister city
countries having a sister city relationships with
the City of Miami.
b) Local Consul General of the country -of the
individual sister cities will be afforded the
opportunity to appoint an individual to the sister
cities committee; thereby, assigning an ex officio
member from the consul general's staff to be a
liaison between the consulate and the committee.
(3) to maintain an affiliation policy and direction of
sister city committees established for each sister city of
the City of Miami.
(4) to actively solicit contributions and financial
support from private business interests and any other
governmental authorities to the degree necessary to achieve
its purpose.
Sec. 2-1218. Membership; qualifications; terms of
office; vacancies; officers;
parliamentary procedures and rules of
procedure; meetings;_ quorum; voting;
attendance requirements.

(a) Membership. The Council shall consist of
six voting members who shall serve without
compensation, but shall be reimbursed for necessary
expenses incurred in official duties, as may be
determined and approved by the City Manager, and shall
be composed as follows:
(1) One (1) member, appointed by the Mayor who
shall be the Chairperson; and
(2) One (1) City Commissioner, appointed by the
City Commission;
(3) Four (4) members appointed by the City
Commission, with each City Commissioner
nominating one (1) individual, except for the
City Commissioner appointed to the Council by
the City Commission as required in
subparagraph (2) herein; and
(b) Qualifications. The provisions set forth in
Section 2-884 shall apply to the members of the

(c) Terms of office. The terms of office of
the members of the Council shall be for one year, or
until the Mayor or the appointing. Commissioner leaves
office, whichever occurs first. All members shall
continue to serve until their successors have been
appointed and qualified. The provisions of
Section 2-885(b) shall not apply to the members of the
Council, as it relates to the number of years a member
may serve on the Council.
(d) Vacancies. If a vacancy occurs on the
Council, such vacancy shall be filled as applicable by
either the Mayor or by the Commissioner who appointed
the member whose position has become vacant. Such
appointment shall be effective for the remainder of the
unexpired term or until the Mayor or the appointing
Commissioner leaves office.
(e) Officers. The Mayor shall designate the
Chairperson of the Council. The Council shall select
and designate from its members a Vice -chairperson,
Secretary, and such other officers as may be deemed
necessary, who shall serve at the pleasure of the
Council. No Chairperson shall serve more than two

years in office. The vice -chairperson shall serve as
Chairperson in the absence of the Chairperson.
(f) Parliamentary authority and rules of
procedure. The parliamentary authority of the
Council shall be Robert's Rules of Order (Current
Edition), unless the Council adopts its own order of
business and rules of procedure governing its meetings,
and actions on matters within its jurisdiction, not
inconsistent with the provisions set forth herein,
which rules of procedure shall be filed with the City
Clerk. Copies of minutes of all Council meetings shall
be furnished to the Mayor, Commissioners and the City
Manager.
(g) Meetings; quorum; and voting. All meetings
of the Council shall be open to the public. The
provisions set forth in Section 2-887 of this Article
shall apply to all members of the Council as they
relate to quorum and voting.
(h) Attendance requirements. The provisions set
forth in Section 2-886 of this Article shall apply to
all members of the Council.
Sec. 2-1219. Assignment of staff.
(a) It shall be the duty of the City Clerk to
provide the services of an individual to keep minutes
of meetings, maintain committee correspondence, post
meeting notices, file reports and perform all other
necessary support functions.
(b) The Executive Director of the Sister Cities
Program shall act as the liaison for all activities of
the Council. It shall be the duty of the City Manager
to assign individuals as may be necessary to assist the
Council with ongoing and pending projects and to
provide administrative support.
Sec. 2-1220. Counsel.
The City Attorney's Office shall provide legal
assistance to the Council but shall not be required to
attend meetings of the Council or committees.
Sec. 2-1221. Notices and filing of records.

The provisions set forth in Section 2-888 shall
apply to the Council. Notice of meetings shall be
posted by the City Clerk at City Hall and other
appropriate locations after being apprised by the
Council of an upcoming meeting(s).. Advertised public
notice of meetings are not required. It shall be the
duty of the City Clerk to comply with applicable laws
related to filing of records and Section 2-889.
Sec. 2-1222. Annual Report.
The provisions set forth in Section 2-890 of this
Article shall apply related to the submittal of annual
reports.
Section 4. All ordinances or parts of ordinances or
resolutions insofar as they are inconsistent or in conflict with
the provisions of this Ordinance are repealed.
Section 5. If any section, part of section, paragraph,
clause, phrase or word of this Ordinance is declared invalid, the
remaining provisions of this Ordinance shall not be affected.
Section 6. This Ordinance shall become effective thirty
(30) days after final reading and adoption thereof.31

3/ This Ordinance shall become effective as specified herein unless
vetoed by the Mayor within ten days from the date it was passed
and adopted. If the Mayor vetoes this Ordinance, it shall become
effective immediately upon override of the veto ,by the City
Commission or upon the effective date stated herein, whichever is
later.

when presented back to the City Commission for second reading.
