AN EMERGENCY ORDINANCE OF THE. MIAMI CITY
COMMISSION ESTABLISHING SIX SPECIAL REVENUE
FUNDS ENTITLED: (1) COMMUNITY DEVELOPMENT
BLOCK GRANT (28TH YEAR); (2) HOME INVESTMENT
PARTNERSHIP PROGRAM; (3) HOUSING
OPPORTUNITIES FOR PERSONS WITH AIDS; (4)
EMERGENCY SHELTER GRANT PROGRAM; (5) SHIP
HOUSING PROGRAM; AND (6) SECTION 8 HOUSING
PROGRAM AND APPROPRIATING FUNDS AS MORE
SPECIFICALLY SET FORTH BELOW, CONSISTING OF
GRANTS FROM U.S. DEPARTMENT OF HOUSING AND
URBAN DEVELOPMENT IN THE AMOUNT OF
$33,909,442 AND FLORIDA HOUSING FINANCE
CORPORATION IN THE AMOUNT OF $2,326,054 AND
COMMUNITY DEVELOPMENT PROGRAM INCOME IN THE
AMOUNT OF $2,260,000; AUTHORIZING THE CITY
MANAGER TO ACCEPT SAID GRANTS AND TO EXECUTE
ALL NECESSARY DOCUMENTS, IN A FORM ACCEPTABLE
TO THE CITY ATTORNEY FOR ACCEPTANCE OF THE
GRANTS; AND AUTHORIZING THE EXPENDITURES OF
THE FUNDS FOR THE OPERATION OF THE PROGRAMS;
CONTAINING A REPEALER PROVISION AND A
SEVERABILITY CLAUSE.
WHEREAS, it is projected that the City of Miami will receive
entitlement grant awards from the Department of Housing and Urban
Development and the Florida Housing Finance Corporation for the
period commencing October 1, 2002, and ending September 30, 2003,
for the following programs and in the projected specified
amounts:

(1) Twenty-eighth Year Community Development Block Grant
(CDBG) Program for the provision of community
development activities - $12,856,000;
(2) HOME Investment Partnership (HOME) Program to provide
affordable housing activities for low and moderate
income persons - $5,409,000;
(3) Emergency Shelter Grant (ESG) Program to provide
activities for homeless persons - $447,000;
(4) Housing Opportunities for Person With AIDS (HOPWA)
Program to provide housing services to eligible HOPWA
clients - $12,482,000;
(5) SHIP Housing Program funds to provide housing
assistance to income -eligible persons - $2,326,054;
(6) Section 8 Program funds to provide housing assistance
to income -eligible persons - $2,715,442; and
WHEREAS, the Department of Community Development has
identified $2,715,442 of program income;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Ordinance are adopted by reference and
incorporated as if fully set forth in the Section.
Section 2. The following Special Revenue Funds are
established and resources are appropriated as described herein:

and the Florida Housing Corporation and the City Manager's
acceptance thereof.
Section 4. The City Manager is authorized'''/ to accept
the aforementioned grants and to execute the necessary documents,
in a form acceptable to the City Attorney, to accept the grants.
The herein authorization is further subject to compliance with all
requirements that may be imposed by the City Attorney, including but not
limited to those prescribed by applicable City Charter and Code
provisions.

Section 5. The City Manager is authorized to expend
monies from these funds for the operation of said Programs.
Section 6. All ordinances or parts of ordinances insofar
as they are inconsistent or in conflict with the provisions of
the Ordinances, are hereby repealed.
Section 7. If any section, part of section, paragraph,
clause, phrase or word of.this Ordinance is declared invalid, the
remaining provisions of this Ordinance shall not be affected.
Section 8. This Ordinance is declared to be an emergency
measure on the grounds of urgent public need for the preservation
of peace, health, safety, and property of the City of Miami, and
upon the further grounds of the necessity to make the required
and necessary payments of its debts purchases of goods and
supplies and to generally carry on the functions and duties of
municipal affairs.
Section 9. The requirement of reading this Ordinance on
two separate days is dispensed with by an affirmative vote of not
less than four-fifths of the members of the Commission.
Section 10. This Ordinance shall become effective
immediately upon its adoption and signature of the Mayor.2/
zi If the Mayor does not sign this Ordinance, it shall become effective at
the end of ten calendar days from the date it was passed and adopted.
If the Mayor vetoes this Ordinance, it shall become effective
immediately upon override of the veto by the City Commission.

It is respectfully recommended that the City Commission adopt the attached Emergency
Ordinance establishing six (6) Special Revenue Funds to appropriate grant funds from the U.S.
Department of Housing and Urban Development (HUD) to implement the Community
Development Block Grant (CDBG) Program - $12,856,000 CDBG funds and $2,260,000 of
program income; the HOME Investment Partnerships (HOME) Program - $5,409,000; the
Housing Opportunities for Persons With AIDS (HOPWA) Program - $12,482,000; the
Emergency Shelter Grant (ESG) Program $447,000; SHIP Housing Program. - $2,326,054; and
the Section 8 Program - $2,715,442.
BACKGROUND:
The U.S. Department of Housing and Urban Development (HUD) has advised the City of Miami
that it is projected to receive the following entitlement grants for the 2002 — 2003 Fiscal Year:
■ Community Development Block Grant (CDBG) $12,856,000 .
■ Emergency Shelter Grant (ESG) 447,000 .
■ Housing Opportunities for Persons with AIDS (HOPWA) 12,482,000
■ HOME Investment Partnerships (HOME) 5,409,000
Total Grant Funds $31,194,000
In addition to the grant funds received through the entitlement formula process, the proposed
Special Revenue Fund entitled Community Development Grant Fund Program includes
$2,260,000 of program income. The proposed legislation also includes two (2) Special Revenue
Funds entitled Section 8 Housing Program, in which the City will receive $2,715,442 from HUD
to implement its Section 8 Housing Program, and SHIP Housing Program, in which the City will
receive $2,326,054 from Florida Housing Finance Corporation to implement its SHIP Housing
Program. The Department of Community Development has prepared the attached emergency
ordinance to establish six (6) Special Revenue Funds to appropriate the HUD grant awards
identified above.

Funds appropriated through the proposed ordinance are grant related and will not have a
budgetary impact on the General Fund.
This ordinance is provided on an emergency basis to execute the appropriate documents to ensure
that the grant supported human service, housing and economic development activities continue
without interruption.
It is recommended that the City Commission adopted the proposed emergency ordinance to "
establish the six (6) Special Revenue Funds relating to the City's HUD grant programs.

ACTION PLAN FOR THE USE OF HUD
GRANT FUNDS BY THE CITY OF MIAMI
Funding recommendations for the City of Miami Community Development Block Grant (CDBG), Housing
Opportunities for Persons With AIDS (HOPWA), HOME and the Emergency Shelter Grant (ESG)
Programs will be considered and approved. '
Pursuant to the Department of Housing and Urban Development 24 CFR Part 91, et al, it is required that
the City of Miami submit its Annual 2002-03 Action Plan to the U.S. Department of Housing and Urban
Development (HUD).
The City of Miami has completed a series of Public Hearings in each City Commission District to solicit
community input and participation in the development of the proposed Annual Action Plan. The final
Public Hearing to discuss and approve funding recommendations for FY'2002-2003 activities for the
aforementioned HUD grant programs and other Community Development issues will be held:

10. Discussion and proposed resolution authorizing the City Manager to submit the proposed Fiscal
Year 2002-2003 Annual Action Plan to the U.S. Department of Housing and Urban Development

(HUD) for the use of funds received by the City to implement the Community Development Block
Grant (CDBG) Program, Housing Opportunities for Persons With AIDS (HOPWA) Program,
HOME Investment Partnership Program (HOME) and the Emergency Shelter Grant (ESG)
Program; and further authorizing the City Manager to execute individual grant agreements with
the U.S. Department of Housing and Urban Development, in a form acceptable to the City
Attorney.
11. Discussion and proposed resolution allocating $425,000 of Housing Opportunities for Persons
With AIDS (HOPWA) Program funds to purchase the property located at 7104, 7126, 7160 NW
14 Place, also known as the Sugar Hill Project, from the Economic Opportunity Family Health
Center, Inc.; to establish a transitional housing facility for the impacted population.
12. Discussion and proposed resolution rolling over $56,421 of 26th Year Emergency Shelter Grant
(ESG) funds previously approved for the City of Miami Homeless Program to Fiscal Year 2001-
2002.
13. Discussion and proposed resolution increasing the existing allocation to Spanish American Basic
Education Rehabilitation, Inc. (SABER) by $228,410 and Douglas Gardens Community Mental
Health Center of Miami Beach by $304,000 to provide long term housing assistance previously
provided by the Miami -Dade Housing Agency and further allocating an additional $50,000 of
HOPWA funds to Sharpton, Brunson and Company to conduct a financial and performance audit
to closeout Miami Dade County Housing Agency and Miami — Dade Office of Community
Services HOPWA contracts.
Interested individuals are encouraged to attend the above Public Hearing. The Hearing site is accessible to
the handicapped.
Following the Public Hearing, the public review and comment period will run from July 9, 2002 through
August 10, 2002. The City of Miami invites all interested parties to communicate their comments
regarding the proposed Action Plan in writing to:
