HomeMy WebLinkAboutO-12248• l J-02-566 6/26/02 ORDINANCE NO. 12248 AN EMERGENCY ORDINANCE OF THE MIAMI CITY COMMISSION CREATING A NEW SPECIAL REVENUE FUND ENTITLED: "PROGRAMS FOR THE DEVELOPMENTALLY DISABLED, - 2002-2003; APPROPRIATING FUNDS FOR ITS OPERATION IN THE ESTIMATED TOTAL AMOUNT OF $338,729; AUTHORIZING THE CITY MANAGER TO ACCEPT THE FOLLOWING TWO GRANTS TO FUND PROGRAMS DURING THE PERIOD OF JULY 1, 2002 THROUGH JUNE 30, 2003, FOR THE DEVELOPMENTALLY DISABLED, ADMINISTERED BY THE DEPARTMENT OF PARKS AND RECREATION THROUGH ITS PROGRAMS FOR PERSONS WITH DISABILITIES FROM: (1) THE STATE OF FLORIDA DEPARTMENT OF CHILDREN AND FAMILIES, IN AN ESTIMATED AMOUNT OF $9,370, AND (2) THE STATE OF FLORIDA AGENCY FOR HEALTH CARE ADMINISTRATION, MEDICAID PROGRAM DEVELOPMENT, IN AN ESTIMATED AMOUNT OF $329,359; FURTHER AUTHORIZING THE CITY MANAGER TO EXECUTE THE NECESSARY DOCUMENTS(S), IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, FOR ACCEPTANCE OF SAID GRANTS. WHEREAS, for the past twenty-four (24) years, the Department of Parks and Recreation Department, through its Programs for Persons with Disabilities, has applied to and received grant awards from the State of Florida Departments of Children and Families ("DCF") and the Agency for Healthcare Administration, to support its programs; and 12248 WHEREAS, the DCF is expected to award the City a grant for its Program in the estimated amount of $9,370 for the period of July 1, 2002 through June 30, 2003; and WHEREAS, the Agency for Healthcare Administration is awarding a grant in the amount of $329,359; and WHEREAS, the aggregate of these funds, in the total estimated amount of $338,729, will allow the Department of Parks and Recreation programs to continue through June 30, 2003; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The following Special Revenue Fund is established as described herein: FUND TITLE: PROGRAMS FOR THE DEVELOPMENTALLY DISABLED 2002-2003 RESOURCES: UNITED STATES DEPARTMENT OF HEALTH AND HUMAN SERVICES GRANT THROUGH THE FLORIDA DEPARTMENT OF CHILDREN AND FAMILIES. $ 9,370 STATE OF FLORIDA AGENCY FOR HEALTHCARE ADMINISTRATION, MEDICAID PROGRAM DEVELOPMENT $329,359 APPROPRIATION: PROGRAMS FOR THE DEVELOPMENTALLY DISABLED, 2002-2003 $338,729 Page 2 of 4 12248 • r Section 3. The City Manager is authorized" to accept the following two grants to fund programs for the developmentally disabled administered by the Parks and Recreation Department through its Programs for Persons with Disabilities during the period of July 1, 2002 through June 30, 2003 from: (1) the State of Florida Department of Children and Families, in an estimated amount of $9,370, and (2) the State of Florida Agency for Healthcare Administration, Medicaid Program Development, in the estimated amount of $329,359, and to execute the necessary document(s), in a form acceptable to the City Attorney, for acceptance of said Grants. Section 4. All Ordinances or parts of Ordinance insofar as they are inconsistent or in conflict with the provision of this Ordinance are repealed. Section 5. If any section, part of section, paragraph, clause, phrase, or word of this Ordinance is declared invalid, the remaining provision of this Ordinance shall not be affected. Section 6. This Ordinance is declared to be an emergency measure on the grounds of urgent public need for the preservation of peace, health, safety, and property of the City of Miami and upon the further grounds of the necessity to make the required 1� The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. Page 3 of 4 12248 and necessary purchases and payments, and to generally carry out the functions and duties of municipal affairs. Section 7. The requirement of reading this Ordinance on two separate days is dispensed with by a vote of not less than four-fifths of the members of the Commission. Section 8. REFERENCES: Developmentally ,Disabled 2002-2003 ENCLOSURES: It is respectfully recommended that the ,City Commission adopt the attached Emergency Ordinance accepting two grants as described herein and creating a, new special revenue fund entitled "Programs for the Developmentally Disabled - 2002- 2003 and appropriating funds for the program's.operation in an estimated amount of $338,729.; consisting of a $9,370 grant from the Florida Department of Children and Families (DCF) and a $329,359 grant from the. State of ,Florida Agency for Healthcare Administration, Medicaid .Program Development (AHCA); authorizing the City Manager to accept the grants from DCF and AHCA agencies and to execute the necessary document (s) . t . BACKGROUND: For the.past twenty-four (24) years, the Department of Parks and -Recreation - Programs for Persons with Disabilities has received funds from. the. State of Florida Department of Children and Families. Since .1993, the State of Florida Agency for Healthcare Administration Medicaid Program Development has provided grant funds for this Program. These grants are used .to provide programs and transportation services to. more than ninety-four (94) developmentally disabled adults on a weekly basis. Due to the high quality of service provided by the City of Miami, the State of Florida has again awarded grant funds. The contract period for the grants will run from July 1, 2002 through June 30, 2003. 12248 Honorable Mayor and Members of the City Commission Page 2 of 2 To serve as many as ninety-four . (94) clients, funds from both State funding sources are combined to cover two (2) interrelated programs offered by, the Parks. Department's Program for Persons with Disabilities. The Adult Day Training, program provides for thirty (30) clients, thirty (.3 0) hours' per week,, a non -.work oriented program, giving instruction in such skills as telling time, .transacting money, and learning independent living skills. The second program provides for non-residential support services to a minimum of sixty four (64) clients, on the average of eight (8) hours per month. Specific activities in this program include dances, bowling, movies and special events. Additionally, clients are educated on socialization skills, interpersonal relationships, and peer interaction. The Programs for Persons with - Disabilities Division also provides the, clients with transportation to the various programs and activity sites. The establishment of a special revenue fund is required in order to appropriate these funds. for the operation of the Parks Department's Programs for Persons with Disabilities. There is always a timing issue between the time that we are notified of the award of the grant and the contract period that is covers. Therefore, in order to be as close as possible to the grant's starting date of. July 1,. 2002, we have prepared..this emergency ordinance. It is therefore recommended that the City Commission adopt the attached emergency Ordinance creating a special revenue fund and appropriating funds for said purpose.
