AN ORDINANCE OF THE MIAMI CITY COMMISSION
AMENDING ORDINANCE NO. 11000, AS AMENDED, THE
ZONING ORDINANCE OF THE CITY OF MIAMI-, BY
AMENDING ARTICLE 4, SECTION 401, SCHEDULE OF
DISTRICT REGULATIONS, TO MODIFY THE (C-1)
"RESTRICTED COMMERCIAL" ZONING CLASSIFICATION
TO INCLUDE FIRE STATIONS AS CONDITIONAL
PRINCIPAL USES, SUBJECT TO SPECIAL EXCEPTION
PERMIT, WITH CITY COMMISSION APPROVAL;
CONTAINING A REPEALER PROVISION AND
SEVERABILITY CLAUSE; AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, the Miami Planning Advisory Board, at its meeting
of April 24, 2002, Item No. 8, following an advertised hearing,
adopted Resolution No. PAD 29-02 by a vote of six to zero (6-0),
RECOMMENDING APPROVAL of amending Zoning Ordinance No. 11000 as
hereinafter set forth; and
WHEREAS, the City Commission after careful consideration of
this matter deems it advisable and in the best interest of the
general welfare of the City of Miami and its inhabitants to amend
Ordinance No. 11000 as hereinafter set forth;

NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to
this
Ordinance are
adopted by reference and
incorporated
as if
fully set forth in
this Section..
Section 2. Ordinance No. 11000, as amended, the Zoning
Ordinance of the City of Miami, Florida, is amended by amending
the text of said Ordinance as follows: 1/

ARTICLE 4. ZONING DISTRICTS
Sec.401. Schedule of District Regulations.
C-1 Restricted Commercial
Conditional Principal Uses:
Same as for 0 district and in addition:
29. Processing, packaging, handling, distribution and
wholesale and retail sales of seafood by Class II
Special Permit only and only when such uses are
conducted from properties which immediately abut
the Miami River. The Class II Special Permit
shall ensure compliance with the general and

special considerations outlined in section
604.3.2.
30. Sales of fresh flowers from mobile vending carts
placed in open space areas by Class II Special
Permit and subject to compliance with Coconut
Grove Right -of -Way Vending Cart Guides and
Standards.
31. Fire stations, subject to Special Exception with
City Commission approval, with additional
consideration given to adequate buffering when
such uses are located adjacent to residential
areas.
Section 3. All ordinances or parts of ordinances insofar
as they are inconsistent or in conflict with the provisions .of
this Ordinance are repealed.
Section 4. If any section, part of section, paragraph,
clause, phrase or word of this Ordinance is declared invalid, the
remaining provisions of this Ordinance shall not be affected.
Section 5. This Ordinance shall become effective thirty
(30) days after final reading and adoption thereof.2/
z/ This Ordinance shall become effective as specified herein unless vetoed
by the Mayor within ten days from the date it was passed and adopted.
If the Mayor vetoes this Ordinance, it shall become effective
immediately upon override of the veto by the City Commission or upon the
effective date stated herein, whichever is later.

PETITION Consideration of amending Ordinance 11000, as
amended, the Zoning Ordinance of the City of Miami,
by amending Article 4, Section 401, Schedule of
District Regulations, to modify the (C-1) "Restricted
Commercial' zoning classification to include fire
stations as conditional principal uses, subject to
Special Exception permit, with City Commission
approval.
PLANNING
RECOMMENDATION Approval.
BACKGROUND AND
ANALYSIS The proposed amendment is for the purpose of
including fire stations in the C-1 Restricted
Commercial zoning classification as a conditional
principal use, subject to Special Exception Permit with
City Commission approval. C-1 Restricted
Commercial zoning districts are generally located
along major arterial roadways adjacent to residential
areas. As a zoning classification, they are intended to
serve such residential areas. Fire stations are
intended to house such emergency vehicles and staff
so as to conveniently protect life and property. The
Planning and Zoning Department finds that residential
areas can benefit from having a certain number of fire
stations within close proximity so as to have
emergency assistance located within convenient
access. The required Special Exception permit (with
City Commission approval) is for the purpose of
ensuring that appropriate buffers are provided when
implementing such facilities.
PLANNING ADVISORY BOARD Recommended approval to VOTE: 6-0
City Commission.
