OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, ENTITLED "BUILDINGS/IN GENERAL", WHICH SETS FEES FOR BUILDING, PLUMBING, ELECTRICAL, MECHANICAL, INCLUDING BOILER AND ELEVATOR INSPECTION, PERMIT AND CERTIFICATE FEES, TO MODIFY THE FEES AND PROVIDE EXEMPTIONS; MORE PARTICULARLY BY AMENDING SECTION 10-4(b) OF THE CODE; CONTAINING A REPEALER PROVISION AND SEVERABILITY CLAUSE, AND PROVIDING FOR AN EFFECTIVE DATE. BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Chapter 10, Article I, of the Code of the City of Miami, Florida, as amended, entitled "Buildings/In General", is further amended in the following particulars: 1/ "Chapter 10 ARTICLE I. IN GENERAL Sec. 10-4. Building permit fee schedule. (a) Fee for work without permit. When work 'is commenced prior to obtaining a required permit, a fee 1� Words and/or figures stricken through shall be deleted. Underscored words and/or figures shall be added. The payment of such fees shall not relieve any person, firm or corporation from fully complying with all of the requirements of all applicable regulations and codes, nor shall it relieve them from being subject to any of the penalties therein. The fee requirement shall be applicable to all divisions of the building and tee department. (b) General fees; Minimum fee. (1) Solid waste surcharge. a. Building permits. Permits for a building whose estimated construction cost is under $1,000,000: Two percent of the cost of construction with a minimum of $50.00 and a maximum of $5,000. Permits for a building whose estimated construction cost is equal to or over $1,000,000: Two percent of the cost of construction with a minimum of $50.00 and a maximum of $10,000. Page 2 of 5 12237 b. Master Electrical, Mechanical, and Plumbing permits. Residential: $0.20 per $100.00 of the cost of construction on all master electrical, mechanical and plumbing permits with a minimum fee of $25.00 and a maximum fee of $500.00. Commercial: $0.20 per $100.00 of the cost of construction on all master electrical, mechanical and plumbing permits with a minimum of $50.00 and a maximum fee of $2,500.00. C. Exemptions: The following permits are exempt: sign, landscape, elevator, revisions, residential painting permits, aftd subsidiary permits (i.e., permits issued under the master permit plan number), building roofing, awning, door, window, shed, floor covering and driveway. Affordable housing shall be exempt providing that proper certification from the director of the community development department is presented at the time plans are reviewed. (6) Certificate of occupancy and certificate of use. d. Bonds may be required for unfinished work on temporary certificates of occupancy. (7) Minimum permit fee required. The minimum permit fee shall be $60.00. Provided, however, awning and shed permits shall be exempt from the minimum permit fee and shall also be exempt from payment of any public works, zoning and fire review fees set forth in this code. This exemption is intended to supersede any sections to the contrary in this rnrao Page 3 of 5 29, a� g� (h) Mechanical permit fees. (12) Mechanical and Elevator invoices. b. Whenever any owner or user of an elevator/boiler, escalator or any other lifting apparatus subject to this section fails to pay for any mechanical and/or elevator invoice, there will be a delinquent fee in addition to the fees charged: Over 60 days past due. $30.00 Over 90 days past due. $50.00 * * * * *„ Section 2. All Ordinances or parts of Ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are repealed. Section 3. If any section, part of section, paragraph, clause, phrase, or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 4. This Ordinance shall become effective thirty (30) days after final reading and adoption thereof.�' 2/ This Ordinance shall become effective as specified herein unless vetoed by the Mayor within ten days from the date it was passed and adopted. If the Mayor vetoes this Ordinance, it shall become effective immediately upon override of the veto by the City Commission or upon the effective date stated herein, whichever is later. DIAZ, MAYO Loop CORRECTNESS Page 5 of 5 00S?P� SECOND READING 16 ORDINANCE TO: The Honorable Mayor and Members of the City Commission FROM imene2 City Manager 12 DATE : APA 2 9 LJJL FILE SUBJECT: Proposed Ordinance Amending Section 10 of the Code of the City of Miami REFERENCES: ENCLOSURES RECOMMENDATION It is respectfully recommended that the City Commission adopt the attached Ordinance amending Section 10 of the Code of the City of Miami, as amended, modifying the assessment of the Solid Waste Surcharge and eliminating the, minimum fee requirements from awning and shed permits. BACKGROUND The adoption of the attached ordinance is required in order for the City of Miami to assess the Solid Waste Surcharge in a more equitable manner. In April 1998, a Construction Debris Removal Fee was implemented.. The fee is necessary to remove the enormous amount of illegally dumped debris from back alleys and rights of ways. The name was changed to Solid Waste Surcharge and modifications made in October 1998. The Solid Waste Surcharge has been charged on all building, electrical, plumbing, mechanical and demolition permits. Commercial building permits have been -based upon a 2% projected cost of the project for which the building permit is being applied, with a minimum fee of $50 and a maximum fee of $2,500/$3,500. Residential building permits are also based on a 2% cost of construction, with a minimum of $25 and a maximum fee of $500. The fee is assessed for electrical, plumbing and mechanical permits at the rate of $0.20 per $100 of the cost of construction with a minimum fee of $50 and a maximum fee of $500 for commercial permits and a minimum of $25 and a maximum fee The fee, as presently charged, is extremely high for the residents/ homeowners. The following is an example: Existing Fee Proposed Fee Type of Permit - Building (Residential) Building (Residential) Regular Permit Fees - $1,563.15 $1,563.15 Debris Removal Fee - 500.00 80.00 Total Permit Cost - $2,063.15 $1,643.15 12237 Page 2 A more equitable way to charge this fee will be to reduce the assessment to al residential building permits from 2% of the cost of construction to $0.20 per $100 o construction. In addition, the following residential and commercial permits will b( exempted: Awnings, sheds, doors, windows, roofs, shutters, floor coverings storefronts and driveways. The minimumpermit fee will also be eliminated fron awning and shed permits. Awning and shed; permits will be exempt from the reviev fees assessed by Public Works, Fire and Zoning. In order to continue to meet our budgetary requirements for Solid Waste Surcharge the maximum fee for all commercial building permits will increase fron. $2,500/$3,500 to $5,000 for all fees with an estimated cost of construction under $1,000,000; those with estimated cost of construction totaling over $1,000,000 will pay a maximum of $10,000. The City of Miami is not the only municipality charging such a fee. The City of Miami Beach also hass-a similar fee.
