AN EMERGENCY ORDINANCE OF THE MIAMI CITY
COMMISSION ESTABLISHING A NEW SPECIAL REVENUE
FUND ENTITLED "SUMMER FOOD SERVICE PROGRAM
FOR CHILDREN 2002" AND APPROPRIATING FUNDS
FOR THE OPERATION OF THE PROGRAM IN THE
ESTIMATED AMOUNT OF $534,457, CONSISTING OF A
GRANT FROM THE UNITED STATES DEPARTMENT OF
AGRICULTURE, THROUGH THE FLORIDA DEPARTMENT
OF EDUCATION; AUTHORIZING THE CITY MANAGER TO
ACCEPT THE GRANT AWARD FROM THE UNITED STATES
DEPARTMENT OF AGRICULTURE AND TO EXECUTE THE
NECESSARY DOCUMENT(S), IN A FORM ACCEPTABLE
TO THE CITY ATTORNEY; CONTAINING A REPEALER
PROVISION AND A SEVERABILITY CLAUSE.
WHEREAS, the Department of Parks and Recreation sponsors a
Summer Food Service Program for children which provides
nutritional meals in conjunction with its comprehensive
recreational program; and
WHEREAS, the Florida Department of Education, Food and
Nutrition Management Division, with funding from the U.S.
Department of Agriculture ("USDA") grants funds in the estimated
amount of $534,457 to conduct a summer food service program from
June 17, 2002 through August 23, 2002, for children up to age 18;
and
WHEREAS, the grant in the estimated amount of $534,457 is_
based on year 2001 figures and reimbursement rates of $2.30 for
operational and actual lunch cost, $.52 for operational and
actual supplement costs and $.05 for administrative costs of the
program; and
WHEREAS, an estimated 173,800 lunches and 171,600
supplements will be served during the project period commencing
June 17, 2002 and ending August 23, 2002; and
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Ordinance are adopted by reference and included
as is fully set forth in this Section.
Section 2. The following Special Revenue Fund is
established and resources are appropriated as described herein:

Appropriations: $534,457
Section 3. _This appropriation is contingent upon
approval by the Florida Department of Education of the City's
application for the grant and the City Manager's acceptance.

Section 4. The City Manager is authorizedl� to accept
the grant from the USDA, through the Florida Department of
Education, and to execute all necessary documents(s), in a form
acceptable to the City Attorney.
Section S. The herein authorization shall remain valid
and outstanding even if the anticipated grant award is reduced or
increased.
Section 6. All Ordinances or parts of Ordinance insofar
as they are inconsistent or in conflict with the provisions of
this Ordinance are repealed.
Section 7. If any section, part of section, paragraph,
clause, phrase, or word of this Ordinance is declared invalid,
the remaining provisions of this Ordinance shall not be affected.
Section 8. This Ordinance is declared to be an emergency
measure on the grounds of urgent public need for the preservation
of peace, health, safety, and property of the City of Miami, and
upon further grounds of the necessity to make necessary payments
of its debts, necessary and required purchases of goods and
supplies, and to generally carry on the functions and duties of
municipal affairs.
Section 9. The requirements of reading this Ordinance on
two separate days is dispensed with by an affirmative vote of not
less that four-fifths of the members of the Commission.
ii The herein authorization is further subject to compliance with all
requirements that may be imposed by the City Attorney, including but not
limited to those prescribed by applicable City Charter and Code
provisions.

Section 10. This Ordinance shall become effective
immediately upon its adoption and signature of the Mayor./

If the Mayor does not sign this Ordinance, it shall become effective at
the end of ten calendar days from the date it was passed and adopted.
If the Mayor vetoes this Ordinance, it shall become effective
immediately upon override of the veto by the City Commission.

amending Chapters 18, 38, 54, 55 and 62 of the Code of the City of Miami, Florida, as
amended, to require notice and public hearing prior to City he

particularly by amending Sections 18-176, 38-18, 54-136, 54-137, 55-8 and 62-128.
BACKGROUND:
The City Commission passed a Motion to amend City Code Sections to require notice
and public hearing prior to City Commission consideration of any matters relating to plat
approvals, street closures, and actions involving publicly owned lands to ensure that the
public receives advance notice before .the aforesaid matters are considered by the
Commission.

It is -respectfully recommended that the City Commission
.adopt the attached emergency ordinance -to create a new
.Special _.Revenue Fund and to appropriate grant funds. in the
'estimated amount of $534,457, to be received :from the United
States Department of..Agriculture (USDA) to conduct a summer
food service program for youth aged 18 and under from June
17,.2002 through August 23, 2002.1
BACKGROUND:
Each year since 1968, the Department of Parks and Recreation
has sponsored a. Summer Food Service .Program for children.`
Under this program, the City provides nutritional meals in
conjunction with its comprehensive recreational program
featuring arts and. crafts, sporting activities, field trips
and special events. This -year, we plan to serve up to 3,950
lunches and 3,900 snacks per day using no less than twenty-
eight (28) sites throughout the City.'
Based on 2001 program totals, we estimate that 173,800
lunches and 171,600 snacks will be served during the
upcoming summer program. These figures average out to 3,950
lunches .and 3,900 snacks..each dayfor the 45 day program.
Funding is provided to the City from a USDA grant through
Florida's Department of -Education (DOE):" This year's grant
is estimated -at $534,457 based on last year's meals. figures
and reimbursement rates of $2..30 for lunch and $.53 for
afternoon supplements (snacks), as well as appropriate
administrative expenses.. -This rate will provide sufficient
funds to cover the meal' cost and to hire the necessary
temporary, part-time recreation aides to - operate the
program., . The final grant award amount will be made
available by Florida's Department of Education in April
2002. This grant does not require matching funds.

This .Ordinance is being ..presented as an emergency item'
because the department was just recently informed of -the-
availability of grant funds; the need to meet the State of
_Florida established time constraints, deadlines for:contrac.t
execution, and to ensure that funds are in place prior to
the start of the Summer Program.on June 23, 2002.
This 'item. is companion to a .resolution, which -would
authorize the purchase of food through the inclusion -,of the
City's program requirements in the Miami -Dade County
.competitive bid package that allows vendors -to 'o ' ffer Summer
lunches and supplements at a rate lower. than .tha.which the -
City of Miami could obtain under a separate bid.
