ORDINANCE NO. 12218
AN EMERGENCY ORDINANCE OF THE MIAMI CITY
COMMISSION APPROPRIATING AND ACCEPTING
DONATIONS TO THE DEPARTMENT OF PARKS AND
RECREATION PERSONS WITH DISABILITIES
FUNDRAISING SPECIAL PROJECT NO. 110032,
REVENUE ACCOUNT CODE NO. 110032.058010.4.349,
IN THE AMOUNT OF $4,000 FROM PHYSICIANS
HEALTHCARE PLANS, INC. TO CO-SPONSOR THE CITY
OF MIAMI MUSICAL SHOWCASE TO BE HELD ON MAY
10, 2002, AT THE MANUEL ARTIME THEATER, AND IN
THE AMOUNT OF $5,000 FROM NAPA AUTO PARTS FOR
THE PURPOSE OF PROVIDING FURNISHINGS AND
EQUIPMENT FOR THE SANDRA DELUCCA DEVELOPMENT
CENTER, FOR A TOTAL AMOUNT OF $9,000;
AUTHORIZING THE CITY MANAGER TO EXECUTE ALL
NECESSARY DOCUMENTS, IN A FORM ACCEPTABLE TO
THE CITY ATTORNEY, TO ACCEPT THE DONATIONS;
CONTAINING A REPEALER PROVISION AND A
SEVERABILITY CLAUSE.
BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI
FLORIDA:
Section 1. The donations in the amount of $4,000 from
Physicians Healthcare Plans, Inc. to co-sponsor the city of
Miami Musical Showcase to be held on May 10, 2002, at the Manuel
Artime Theater, and in the amount of $5,000 from NAPA Auto Parts
for the purpose of providing furnishings and equipment for the
Sandra DeLucca Development Center, for a total amount of $9,000,
are accepted.
Section 2. Said donations are appropriated to the
Department of Parks and Recreation Persons with Disabilities
Fundraising Special Project No. 110032, Revenue Account Code
No. 110032.058010.4.349.
Section 3. The City Manager is authorized" to execute
the necessary documents, in a form acceptable to the City
Attorney, for acceptance of the donations.
Section 4. All ordinances or parts of ordinances,
insofar as they are in conflict with provisions of this
Ordinance are repealed.
Section 5. If any section, part of section, paragraph,
clause, phrase or word of this Ordinance is declared invalid,
the remaining provision of this Ordinance shall not be affected.
Section 6. This Ordinance is declared to be an
emergency measure on the grounds of urgent public need for the
preservation of peace, health, safety, and property of the City
of Miami, and upon further grounds of the necessity to make the
required purchases of goods and supplies and to generally carry

on the functions and duties of municipal affairs.
Section 7. The requirements of reading this Ordinance
on two separate days are dispensed with by an affirmative vote
of not less than four-fifths of the members of the Commission.
Section 8. This Ordinance shall become effective
immediately upon adoption and signature of the Mayor.2/

zi This Ordinance shall become effective as specified herein unless vetoed
by the Mayor within ten days from the date it was passed and adopted.
If the Mayor vetoes this Ordinance, it shall become effective
immediately upon override of the veto by the City Commission or upon
the effective date stated herein, whichever is later.

ENCLOSURES:
It is respectfully recommended' that the City Commission
adopt the attached emergency ordinance accepting two (2)
donations. One in the amount of {$4,000 in cash is from
Physicians Healthcare Plans, Inc. to be used by the
Department of Parks and Recreation for the purpose of
covering the expenses for the Musical Showcase being held
by Programs for Persons with Disabilities Division on May
10, 2002 at the Manuel Artime Theater. The second donation
• is in the amount of $5,000 in cash from NAPA Auto Parts for
the acquisition of furnishings and equipment for the Sandra
DeLucca Developmental Center. In addition, the Ordinance
appropriates the donated funds in the Parks and Recreation
Persons with Disabilities Fund Raising Special Project No.
110032, Revenue Account Code No., 110032.0580104.349.

BACKGROUND:
The City of Miami Parks and Recreation Department, Programs
for Persons with Disabilities Division provides a highly
successful year round program for children and adults with
varying disabilities. The Division is housed at a fully
accessible new, approximate 5,270 square foot building
named the Sandra DeLucca Developmental Center at Kinloch
Park. Physician Healthcare Plans, Inc. is donating $4,000
to the division to be used for the Musical Showcase as
follows:

• To provide technical assistance and cover other
production costs.
• To enable participants with disabilities to socialize and
receive instruction in the arts and perform in front of a
live audience.
• To enable program participants to enhance there lives and
open doors to opportunities.
NAPA Auto Parts is donating $5,000 in cash to the Division
to be used as follows:

To acquire furnishings and equipment for the Center.
