AN EMERGENCY ORDINANCE OF THE MIAMI CITY
COMMISSION, WITH ATTACHMENT(S), AMENDING
ORDINANCE NO. 12128, AS AMENDED, BY REVISING
PREVIOUSLY APPROVED CAPITAL IMPROVEMENT
PROJECTS AND APPROPRIATING AND ACCEPTING
FUNDS IN THE AMOUNT OF $1,500,000, CONSISTING
OF A GRANT FROM THE FLORIDA DEPARTMENT OF
TRANSPORTATION; AUTHORIZING THE CITY MANAGER
TO EXECUTE ALL NECESSARY DOCUMENTS, IN A FORM
ACCEPTABLE TO THE CITY ATTORNEY, TO ACCEPT
THE GRANT; CONTAINING A REPEALER PROVISION
AND A SEVERABILITY CLAUSE, AND PROVIDING FOR
AN EFFECTIVE DATE.
WHEREAS, the City Commission adopted Ordinance No. 12128, as
amended, the Annual Appropriation Ordinance, on September 25,
2001, establishing revenues and appropriations for the City of
Miami, Florida, for Fiscal Year ending September 30, 2002; and
WHEREAS, it is necessary to revise certain ongoing capital
improvement projects to reprogram funds and appropriate new grant
funding; and
WHEREAS, the Orange Bowl Stadium is in need of emergency
construction work and engineering services in an amount not to
exceed $2,000,000; and

WHEREAS, Strategic Investment funds previously appropriated
in CIP No. 341184, Business District Street Improvements, will be
reprogrammed for the Orange Bowl Project, CIP No. 324002; and
WHEREAS, proceeds obtained upon the issuance of the Homeland
Defense/Neighborhood Improvement Bonds will be used to replace
the Strategic Investment funds that were redirected for the
Orange Bowl emergency work and the Strategic Investment funds
will be returned to CIP No. 341184, Business District Street
Improvements; and
WHEREAS, the Florida Department of Transportation has
approved an increase of $1,500,000 to the Joint Participation
Agreement with the City of Miami dated January 12, 1999 for the
Watson Island Aviation & Visitors Center; and
WHEREAS, it is necessary to accept and appropriate these
additional grant funds in the capital project for the Watson
Island Aviation & Visitors Center, CIP No. 344101;
NOW,.THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Ordinance are adopted by reference and
incorporated as if fully set forth in this Section.
Section 2. Ordinance No. 12128, as amended, adopted
September 25, 2001, the Annual Appropriations Ordinance for

Fiscal Year ending September 30, 2002, is further amended in the
following particulars:'/

Section 7. Section 6 of Ordinance No. 11705, as amended,
adopted September 28, 1998, Section 5 of Ordinance No. 11839, as
amended, adopted September 28, 1999, and Section 7 of Ordinance
No. 11970, as amended, adopted September 28, 2000, are further
amended in the following particulars to revise previously approved
Projects and establish new Projects to be initiated during Fiscal
Year 2001-2002:
The following appropriations in all Capital Improvement Projects are in the thousands of dollars.

Section 3. The City Manager is authorized,
to accept
the aforementioned grant and to execute all necessary
documents,
in a form acceptable to the City Attorney, to accept the
grant.
Section 4. The herein authorization shall remain valid
and outstanding even if the anticipated grant award is
reduced or
increased.
zi The herein authorization is further subject to compliance with all
requirements that may be imposed by the City Attorney, including but not
limited to those prescribed by applicable City Charter and Code
provisions.

Section 5. All ordinances or parts of ordinances,
insofar as they are in conflict with provisions of this Ordinance
are repealed.
Section 6.
If
any section, part
of section, paragraph,
clause, phrase or
word
of this Ordinance
is declared invalid, the
remaining provision of this Ordinance shall not be affected.
Section 7. This Ordinance is declared to be an emergency
measure on the grounds of urgent public need for the preservation
of peace, health, safety, and property of the City of Miami, and
upon further grounds of the necessity to make the required and
necessary payments to its employees and officers, payment of its
debts, necessary and required purchases of goods and supplies and
to generally carry on the functions and duties of municipal
affairs.
Section 8. The requirement of reading this Ordinance on
two separate days is dispensed with by an affirmative vote of not
less than four-fifths of the members of the Commission.
Section 9. This Ordinance shall become effective
immediately upon adoption and signature of the Mayor. 3/
3i This Ordinance shall become effective as specified herein unless vetoed by the
Mayor within ten days from the date it was passed and adopted. If the Mayor
vetoes this Ordinance, it shall become effective immediately upon override of
the veto by the City Commission or upon the effective date stated herein,
whichever is later.

It is respectfully requested that amendments to the FY2002 Annual Appropriations .
Ordinance No. 12128, as amended, be approved, thereby revising certain ongoing capital
improvement projects to reprogram funds and appropriate new grant funding
The proposed revisions include reprogramming $2,000,000 of Strategic Investment funds
previously appropriated in CIP No. 341184 for Business District Street Improvements, to CIP
No. 324002 for emergency construction work and engineering services required at the
Orange Bowl Stadium.
Proceeds obtained upon the issuance of the Homeland Defense/Neighborhood Improvement
Bonds will be allocated for the Orange Bowl work, thus releasing the Strategic Investment
funds to be returned to CIP No. 341184, Business District Street Improvements.
Also included in this Ordinance is the acceptance and .appropriation of an additional
$1,500,000 from the Florida Department of Transportation for the Watson Island Aviation &
Visitors Center, CIP No. 344101.
