HomeMy WebLinkAboutO-12216J-02-155 02/20/02 ORDINANCE NO. 12216 AN ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING ORDINANCE NO. 11000, AS AMENDED, THE ZONING ORDINANCE OF THE CITY OF MIAMI, BY AMENDING ARTICLE 9, SECTION 918. OFFSITE PARKING TO MODIFY PROVISIONS RELATED TO OFFSITE PARKING REGULATIONS; CONTAINING A REPEALER PROVISION AND SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Ordinance No. 11000, as amended, the Zoning Ordinance of the City of Miami, Florida, is amended by amending the text of said Ordinance as follows:'' 1. "ARTICLE 9. General and supplementary regulations Sec. 918. Offsite parking. It is the general intent of these regulations that required offstreet parking be provided on the same lot with the principal use or structure it serves, except as otherwise specifically 1% words and/or figures stricken through shall be deleted. Unless otherwise specifically provided in special districts, offsite parking shall be permitted by Special Exception and up to twenty-five (25) percent of the required number of spaces and as authorized by the provisions of this section in districts more or equally permissive as where the principal use to be served is located, or as otherwise specifically permitted under the terms of this zoning ordinance, and in any event only where there are practical difficulties or unnecessary hardships involved in providing required parking on the site. In the event that such offsite parking is provided within a parkinq facility that is either owned, or otherwise controlled by a governmental agency, one hundred percent (100%) of the required parkinq may be located offsite pursuant to a Class II Special Permit only for adaptive re -uses of existing structures with insufficient parkinq, including additions to such structures; the purpose of the Class II shall be to ensure that compliance with the distance limitations (as specified below) are adhered to, and that all necessary leases with the participating governmental agency are in place. 918.1. Maximum distance limitations. Unless otherwise specifically provided in special districts, the maximum distance from a principal entrance of any parking facility permitted to provide required or excess offsite parking to the principal entrance of the use served shall not exceed six Page 2 of 4 hundred (600) feet, with distance measured by normal pedestrian routes; such offsite parking may be used as follows: (a) Self --service parking for visitors, clients, or customers of the principal use. (b) Self-service parking for officers, or employees of the principal use, reserved for and used only by such officers or employees. (c) Facilities approved for and maintained with attendant parking only. Section 2. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are repealed. Section 3. If any section, part of section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 4. This Ordinance shall become effective thirty (30) days after final reading and adoption thereof.21 21 This Ordinance shall become effective as specified herein unless vetoed by the Mayor within ten days from the date it was passed and adopted. if the Mayor vetoes this Ordinance, it shall become effective immediately upon override of the veto by the City Commission or upon the effective date stated.herein, whichever is later. APPLICATION NUMBER 02-004 Item #5 CITY OF MIAMI • PLANNING AND ZONING DEPARTMENT 444 SW 2ND AVENUE, 3RD FLOOR • MIAMI, FLORIDA, 33130 PHONE (305) 416-1400 Date: 3/13/2002 age 1 12216 ANALYSIS FOR AMENDMENT TO ARTICLE 9, Sec. 918 Offsite Parking OF THE ZONING ORDINANCE APPLICATION: No. 2002-004 The proposed amendment to the Zoning Ordinance is being requested in order to modify the regulations to the Offsite parking regulations in order to allow 100% of required parking to be offsite if the parking facility being utilized is owned or under control by a governmental agency and only for adaptive reuses for structures and uses with insufficient parking including additions to such structures. The amendment further requires that a distance limitation of 600 feet (which is what is currently in place for other offsite parking arrangements) be adhered to. These offsite parking arrangement will only be approved pursuant to a Class 11 Special Permit; the purpose of the Class II shall be to ensure that compliance with the distance limitations are adhered to, and that all necessary leases with the participating governmental agency are in place.
