HomeMy WebLinkAboutO-12207J-02-207 4/11/02 ORDINANCE NO. �y AN ORDINANCE OF THE 'MIAMI CITY COMMISSION AMENDING THE MIAMI CITY CODE, AS AMENDED, BY AMENDING CHAPTER 10, SECTION 10-22 TO MODIFY DEFINITIONS TO RENAME THE "OMNI AREA MEDIA DISTRICT" TO "FIRE STATION NO. 2 MOTION PICTURE AND MEDIA DISTRICT", IN RECOGNITION OF THE HISTORIC FIRE STATION NO. 2 WHICH IS LOCATED WITHIN THE DISTRICT; CONTAINING A REPEALER PROVISIONS, A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Commission, on April 26, 2001, adopted Ordinance No. 12052 which designated the area generally bounded by Northeast 15th Street on the north, the FEC right-of-way on the west, I-395 on the south, and Northeast 1St Avenue on the east as the "Omni Area Media District" as it related to exceptions from Section 10-22 of the City Code, more particularly, exceptions to the appearance code for purposes of media related photography and motion pictures; and WHEREAS, the historically designated Fire Station No. 2 is located within said "Omni Area Media District"; and 12207 WHEREAS, the City Commission finds that the district should be renamed in recognition of the historic "Fire Station No. 2"; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Chapter 10 of the Code of the City of Miami, Florida, as amended, entitled "Buildings," is amended in the following particulars:l/ Chapter 10 Buildings Article II. Exterior Fagade Code Sec. 10-22. Definitions. For the purposes of this chapter, the following terms, phrases, words and their derivations shall have the meaning given in this section, unless the context clearly indicates that another meaning is intended. when not inconsistent with the context, words used in the present tense include the future, words in the plural number include the singular number, and words in a singular number include the plural number. The word "shall" is always mandatory and not merely directory. Event shall, for the purpose of this chapter, mean any media related occurrence such as photo shoot, movie shoot, video shoot or other similar happening. 1� Words and/or figures stricken through shall be deleted. Underscored words and/or figures shall be added. The remaining provisions are now in effect and remain unchanged. Asterisks indicate omitted and unchanged material. Page 2 of 4 12207 Media district shall be defined as an area within the city which is designated as being of aesthetic value for the media/entertainment industry. Nonresidential/commercial property means any business or establishment of any nature or kind whatsoever other than a residential unit as defined in the zoning ordinance. Gmni az ea media Fire Station No.2 Motion Picture and Media district shall mean and is designated as that area bounded by Northeast 15th Street on.the north, the FEC right-of-way on the west, I-395 on the south, and Northeast 1st Avenue on the east. Residential property shall include any and all property of a residential use or nature as defined in the zoning ordinance. Section 3. All ordinances or parts of ordinances that are inconsistent or in conflict with the provisions of this Ordinance are repealed. Section 4. If any section, part of section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 5. This Ordinance shall become effective thirty (30) days after final reading and adoption thereof .21 PASSED ON FIRST READING BY TITLE ONLY this 7th day of March , 2002. This Ordinance shall become effective as specified herein unless vetoed by the Mayor within ten days from the date it was passed and adopted. If the Mayor vetoes this Ordinance, it shall become effective immediately upon override of the veto by the City Commission or upon the effective date stated herein, whichever is later. BACKGROUND AND ANALYSIS The requested amendment is for the purpose of renaming the "Omni Area Media District" as it relates to exceptions from Sec. 10-22 of the City Code, more particularly, exceptions to said the appearance code for purposes of media related photography and motion pictures, into the new ."Fire Station No. 2 Motion Picture District." In recognition of the historic Fire Station being located within the area. The area is generally bounded by Northeast 15"' Street on the north, the FEC right-of-way on the west, 1-395 on the south, and Northeast 1"t Avenue on the east.
