ORDINANCE NO.
AN ORDINANCE AMENDING PAGE NO. 35 OF THE
ZONING ATLAS OF THE CITY OF MIAMI, FLORIDA,
BY CHANGING THE ZONING CLASSIFICATION FROM
"R-3 MULTIFAMILY MEDIUM DENSITY RESIDENTIAL"
TO "R-3 MULTIFAMILY MEDIUM DENSITY
RESIDENTIAL WITH AN SD -19 DESIGNATED F.A.R.
OVERLAY DISTRICT WITH AN F.A.R. OF 1.0", FOR
THE PROPERTIES LOCATED AT APPROXIMATELY 1245-
1271 NORTHWEST 2nd STREET, 1227, 1231, 1232,
1244, 1251, 1252, 1257, 1258, 1267, 1268 AND
1276 NORTHWEST 3rd STREET, 1228, 1229, 1230,
1234, 1235, 1259, 1260, 1267, 1268 AND 1269
NORTHWEST 4th STREET, 1228, 1229, 1236, 1244,
1245, 1252, 1253, 1268 AND 1269 NORTHWEST 5th

CONTAINING A REPEALER PROVISION AND A
SEVERABILITY CLAUSE; AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, the Planning Advisory Board, at its meeting of
February 20, 2002, Item No. 4, following an advertised hearing,
adopted Resolution No. PAB-16-02, by a seven to zero (7-0) vote,
RECOMMENDING APPROVAL of a change of zoning designation, as
hereinafter set forth; and
WHEREAS, the City Commission, after careful consideration of
this matter, deems it advisable and in the best interest of the

general welfare of the City of Miami and its inhabitants to grant
this change of zoning classification as hereinafter set forth;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The Zoning Atlas of Ordinance No. 11000, as
amended, the Zoning Ordinance of the City of Miami, Florida,
Page 35, Article 4, Section 401, Schedule of District
Regulations, is amended by changing the zoning classification
from 11R-3 Multifamily Medium Density Residential" to "R-3
Multifamily Medium Density Residential with an SD -19 designated
F.A.R. Overlay District with an F.A.R. of 1.01', for the
properties located at approximately 1245-1271 Northwest 2nd
Street, 1227, 1231, 1232, 1244, 1251, 1252, 1257, 1258, 1267,
1268 and 1276 Northwest 3rd Street, 1228, 1229, 1230, 1234, 1235,
1259, 1260, 1267, 1268 and 1269 Northwest 4th STREET, 1228, 1229,
1236, 1244, 1245, 1252, 1253, 1268 and 1269 Northwest 5th Street,
1228, 1236, 1246, 1254, 1258 and 1274 Northwest 6th Street, 420
Northwest 12th Avenue, and 219, 227, 303, 321, 327, 335, 421,
429, 443, 519 and 527 Northwest 13th Avenue, Miami, Florida, more
particularly described on "Exhibit A", attached hereto.
It is found that the proposed change is consistent with the
intent of the area and will not impose an adverse impact on the
adjacent community.
It is also found that the change:

(a) Is in conformity with the adopted Miami Comprehensive
Neighborhood Plan;
(b) Is not contrary to the established land use pattern;
(c) Will not create an isolated district unrelated to
adjacent and nearby districts;
(d) ' Will not materially alter the population density
pattern or increase or overtax the load on public
facilities such as the said school;
(e) Is necessary due to the inconsistency with the current
zoning and the actual use of the properties;
Section 3. Page No. 35 of the Zoning Atlas, made a part
of Ordinance No. 11000, as amended, the Zoning Ordinance of the
City of Miami, Florida, by reference and description in said
Ordinance, is amended to reflect the changes made necessary by
this Amendment.
Section 4. All ordinances or parts of ordinances insofar
as they are inconsistent or in conflict with the provisions of
this Ordinance are repealed.
Section 5. If any section, part of section, paragraph,
clause, phrase, or word of this Ordinance is declared invalid,
the remaining provisions of this Ordinance shall not be affected.
Section 6. This Ordinance shall become effective (31)
days after final reading and adoption thereof pursuant to Section
163.3187 (3) (c) , Fla. Stat. (2001) .

Consideration of amending Ordinance 11000, as amended, the Zoning
Ordinance of the. City of Miami by amending the Zoning Atlas by changing the

1276 NW 3rd Street, 1228, 1229, 1230, 1234, 1235, 1259, 1260, 1267, 1268 and
1269 NW 4" Street, 1228, 1229, 1236, 1244, 1245, 1252, 1253, 1268 and 1269
NW 5th Street, 1228, 1236, 1246, 1254, 1258 and 1274 NW _6th Street, 420 NW
12th Avenue, and 219, 227, 303, 321, 327, 335, 421, 429, 443, 519 and 527 NW
13th Avenue from "R-3" Multi -Family Medium Density Residential, to "R-3" Multi -
Family Medium Density Residential with an "SD -19" Designated FAR Overlay of
1.00.
The proposed Ordinance is in order to achieve a slight increase in FAR for
certain R-3 properties located in sucha manner that the increase will allow for
larger unit types (2 and 3 bedroom units) in order to attract urban infill housing
types that attract families into the city. This amendment does not change the
amount of units allowed per acre, but rather allows for larger units.
This amendment is the result a study conducted of the R-3 neighborhood just
east of the Orange Bowl, and the specific needs int hat area for urban infill
housing. Please see attached study.
The Planning and Zoning Department is recommending approval of the
proposed amendment finding that the slight increase in FAR will not have a
detrimental effect on this neighborhood and that the result will allow for larger
unit types to be developed in this area to meet the needs of a growing
neighborhood.

Existing Conditions
Location: The study area is located in the historic Little Havana neighborhood, in a
residentially zoned area between NW 12th and 13th Avenue from 2nd and 6t' Streets. It
is located to the NW of the Latin Quarter District and in close proximity to the Civic
Center and Downtown Miami, which are major employment centers.
Land Use and Zoning: Little Havana is one of the most densely populated areas in the
City of Miami. Medium density multi -family residential development occupies the
greatest percentage of the land fallowed by single-family residential development. The
area is located to the west of a commercial district located along NW 12th Avenue. There
is a high rise housing construction underway to the south of the study area. The study
area is zoned R-3 which allows for up to sixty five (65) units per net acre
Housing: There is a variety of housing within the study area in'terms of architectural
style, size and age of construction. There are.many older apartment buildings built prior
to 1950 that have architectural significance, but some of them have being modified. Some
of these older structure do not provide adequate off- street parking which creates a
parking shortage. Also there are many single family bungalows, some of them built using
Coral rock details that contribute to provide housing variety to the neighborhood. The
size of the residential units in many of the existing apartments are small which encourage
a transient population. .
Little Havana has a housing shortage and the vacancy rate is one of the lowest in the City
of Miami. Also there is a need to provide better housing quality for the neighborhood,
which includes the provision of larger residential units within multi -family development.
SD 1 zoning in the Latin Quarter to the south of the study area has higher FAR which
allows for mixed residential commercial development and larger residential
developments. There are some vacant lots in the study area that provide an opportunity
for the expansion of the housing stock. If the FAR is increased within the study area,
larger residential units will be able to be developed.
