ORDINANCE NO.
AN ORDINANCE OF THE MIAMI CITY COMMISSION,
WITH ATTACHMENT(S), AMENDING PAGE NO. 27 OF
THE ZONING ATLAS OF ORDINANCE NO. 11000, AS
AMENDED, THE ZONING ORDINANCE OF THE CITY OF
MIAMI, FLORIDA, ARTICLE 4, SECTION 401,
SCHEDULE OF DISTRICT REGULATIONS, BY CHANGING
THE ZONING CLASSIFICATION FROM C-2 LIBERAL
COMMERCIAL TO C-2 LIBERAL COMMERCIAL WITH AN
SD -19 OVERLAY (2.0 F.A.R.), FOR THE PROPERTY
LOCATED AT APPROXIMATELY 4101 NORTHWEST 11
STREET, 1135-1137 AND 1145-1147 NORTHWEST 41
AVENUE, MIAMI, FLORIDA, LEGALLY DESCRIBED IN
ATTACHED "EXHIBIT A;" CONTAINING A REPEALER
PROVISION, A SEVERABILITY CLAUSE; AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the Miami Zoning Board, at its meeting of
January 28, 2002, Item No. 5, following an advertised hearing,
adopted Resolution No. ZB 2002-0518, by a seven to zero (7 to 0)
vote, thus constituting a RECOMMENDATION OF APPROVAL for a change
of zoning classification, as hereinafter set forth; and
WHEREAS, the City Commission, after careful consideration of
this matter, deems it advisable and in the best interest of the
general welfare of the City of Miami and its inhabitants to grant
this change of zoning classification as hereinafter set forth;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:

Section 1. The Zoning Atlas of Ordinance No. 11000, as
amended, the Zoning Ordinance of the City of Miami, Florida,
Article 4, Section 401, Schedule of District Regulations, is
amended by changing the zoning classification from C-2 Liberal
Commercial to C-2 Liberal Commercial with an SD -19 Overlay
(2.0 F.A.R.), for the property located at approximately
4101 Northwest 11 Street, 1135-1137 and 1145-1147 Northwest
41 Avenue, Miami, Florida, as legally described in attached
"Exhibit A."
Section 2. It is found that this zoning classification
change:
(a) is in conformity with the adopted Miami Comprehensive
Neighborhood Plan;
(b) is not contrary to the established land use pattern;
(c) will not create an isolated district unrelated to
adjacent and nearby districts;
(d) is not out of scale with the needs of the neighborhood
or the City;
(e) will not materially alter the population density
pattern or increase or overtax the load on public
facilities such as schools, utilities, streets, etc.;
(f) is necessary due to changed or changing conditions;
(g) will not adversely influence living conditions in the
neighborhood;

(h) will not create or excessively increase traffic
congestion or otherwise affect public safety;
(i) will not create a drainage problem;
(j) will not seriously reduce light and air to adjacent
area;
(k) will not adversely affect property value in the
adjacent area;
(1) will not be a deterrent to the improvement or
development of adjacent property in accord with
existing regulations; and
(m) will not constitute a grant of special privilege to an
individual owner so as to compromise the protection of
the public welfare.
Section 3. Page No. 27 of the Zoning Atlas, made a part
of Ordinance No. 11000, as amended, the Zoning Ordinance of the
City of Miami, Florida, by reference and description in said
Ordinance, is amended to reflect the changes made necessary by
this Amendment.
Section 4. All ordinances or parts of ordinances insofar
as they are inconsistent or in conflict with the provisions of
this Ordinance are repealed.
Section 5. If any section, part of section, paragraph,
clause, phrase, or word of this Ordinance is declared invalid,
the remaining provisions of this Ordinance shall not be affected.

Section 6. This Ordinance shall become effective thirty
(30) days after final reading and adoption thereof. -!I

ANALYSIS FOR ZONING CHANGE
Approximately 4101 NW 11 Street, 1135=1137 and
1145-1147 NW 41 Avenue
CASE NO: 2001-0511
Pursuant to Article 4, Section 401 of Ordinance 11000, as amended, the Zoning
Ordinance of the City of Miami, Florida, the subject proposal has been reviewed for an
amendment to the Zoning Atlas as follows:
The request is to change the Zoning designation as follows:
A parcel along NW 11th Street, located approximately between 41St Avenue and 42°d
Avenue,,from C-2 "Liberal Commercial' to C-2 "Liberal Commercial' with an SD -
19 "Designated F.'A. -R. Overlay District" designating an F.A.R. of 2.0 (Complete_
legal description on file with the -Hearing Boards Office).
The following findings have been made:
• It is found that the SD -19 "Designated F.A.R. Overlay District" is a district that was
created as an instrument to modify (increase or decrease) the E.A.R. on specific
properties within the City.
• It is found that the effect of the SD -19 shall be to modify regulations within portions
of other zoning districts included within the SD boundaries to designate properties or
areas of the City with a specific floor area ratio (F.A.R.).
• It is found that the subject property has a C-2 zoning designation that allows for a
F.A.R. of 1.72 times the gross lot area. It is also found that due to the geographical
conditions of the subject property and the potential development allowed, the increase
of the F.A.R. could result in a massive over -development with all the subsequent
negative results.
• It is found that the additional F.A.R. requested is not necessary to accommodate
reasonable development. The requested additional F.A.R. could only serve to create a
massive amount of development on this site that is totally out of scale and character
..with the surrounding area.

It is found that if .an anticipated project requires additional F.A.R., a twenty (20)
percent F.A.R. increase could be obtained through the process of a Major Use Special
Permit (MUSP) for Planned Unit Development (PUD) in which case the Planning and
Zoning Department would be allowed to review the effects of the additional F.A.R.
on specific properties and areas.
• It is found that the requested zoning designation change is not inconsistent with the
underlying land use designation and therefore does not require an amendment to the
Future Land Use Map of the Comprehensive Plan.
Based on these findings, the Planning and Zoning Department is recommending
denial of the application as presented.
