ORDINANCE NO. 12183
AN ORDINANCE OF THE MIAMI CITY COMMISSION
AMENDING ORDINANCE 11000, AS AMENDED, THE
ZONING ORDINANCE OF THE CITY OF MIAMI, BY
AMENDING ARTICLE 9, SECTION 906, CONVENIENCE
ESTABLISHMENTS AS ACCESSORY TO RESIDENTIAL OR
OFFICE USES, AND ARTICLE 25, SECTION 2502, IN
ORDER TO INTRODUCE PROVISIONS AND A DEFINITION
FOR "BUSINESS CENTER" AS AN ACCESSORY USE,
SUBJECT TO A CLASS I SPECIAL PERMIT;
CONTAINING A REPEALER PROVISION AND
SEVERABILITY CLAUSE; AND PROVIDING FOR AN
EFFECTIVE DATE.
BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. Ordinance No. 11000, as amended, the Zoning
Ordinance of the City of Miami, Florida, is amended by amending
the text of said Ordinance as follows:l'
"ARTICLE 9. GENERAL AND SUPPLEMENTARY REGULATIONS

Sec.906.7. Convenience establishments as accessory to
residential or office uses.
906.7.3. Accessory convenience establishment; uses
permitted. The following convenience establishment uses
shall be permitted in connection with the principal uses
indicated. In the case of hotels, apartment hotels, and
residence hotels involving mixtures of uses, bars and
restaurants shall be permitted only if lodging units make up
eighty (80) percent or more of the required minimum points
(as computed at 906.7.1.1).

" Offices with 60,000 square feet or more of gross floor area required.
Article 25. Definitions.
Business Center. A grouping of office cubicles and/or
separate single room office spaces within a residential
complex for the purpose of conducting extended home
occupations within a residential complex of over 100 units;
said use shall be located on the lower, or public
(nonresidential) levels of such residential buildings and
shall be permissible pursuant to Sec. 906.7 with the
following additional requirements:
1. The total combined office space uses within such a
business center may not exceed 5% of the square
footage of the residential building in which the
business center is to be located.
2. The Class I Special Permit shall require notice to
any tenant or homeowner associations within the

building in which the business center is to be

centers shall be limited to those permissible
within home occupations as specified in Sec.
906.5.; such uses must also comply with the
limitations for employees.
4. Occupants of such office spaces within a business
center shall reside in the building in which the
business center is located.
Section 2. All ordinances or parts of ordinances insofar
as they are inconsistent or in conflict with the provisions of
this Ordinance are repealed.
Section 3. If any section, part of section, paragraph,
clause, phrase or word of this Ordinance is declared invalid, the
remaining provisions of this Ordinance shall not be affected.

Section 4. This Ordinance shall become effective thirty
(30) days after final reading and adoption thereof.z'

This Ordinance shall become effective as specified herein unless vetoed
by the Mayor within ten days from the date it was passed and adopted.
If the Mayor vetoes this Ordinance, it shall become effective
immediately upon override of the veto by the City Commission or upon the
effective date stated herein, whichever is later.

PETITION Consideration of amending Ordinance 11000, as
amended, the Zoning Ordinance of the City of Miami,
Florida, by amending Article 9, section 906 in order to
allow business centers as accessory uses, and by
amending Article 25, Section 2502 in order to provide a
new definition for "Business Center".

RECOMMENDATION Approval.
BACKGROUND AND
ANALYSIS The proposed text amendment is in order to add a
definition and regulations for a new use entitled "Business
Center". This new use is being proposed in recognition of
advancing technology and the need for individuals in
residential- projects with over 100 units to be able to work
out of their homes and/or buildings, versus commuting to
on offsite office location. It is a new form of "home
occupations" that will allow for onsite office rooms within
such residential projects with an underlying zoning
classification of R-3 or R4. The Planning and Zoning
Department is recommending approval based on findings
that this type of use will cut down on commuting for
individuals in need of small office cubicle space within
their own residential building to be able to have home
occupations.
