AN EMERGENCY ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING ORDINANCE NO. 12128, AS AMENDED, THE ANNUAL APPROPRIATIONS ORDINANCE, TO INCREASE CERTAIN OPERATIONAL AND BUDGETARY APPROPRIATIONS FOR FISCAL YEAR ENDING SEPTEMBER 30, 2002, TO REFLECT CHANGES FOR THE ADDITION OF TWO FIRE -RESCUE UNITS; FURTHER APPROVING CHANGES TO THE TABLE OF ORGANIZATION ADOPTED SEPTEMBER 25, 2001 FOR FISCAL YEAR ENDING SEPTEMBER 30, 2002; AMENDING ORDINANCE NO. 12144, ADOPTED OCTOBER 25, 2001, TO REFLECT A REVISION IN THE FUNDING SOURCE RELATED TO THE FLAGLER FIRST CONDOMINIUM PROJECT; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE. WHEREAS, the City Commission adopted Ordinance No. 12128, as amended, the Annual Appropriation Ordinance, on September 25, 2001, establishing revenues and appropriations for the City of Miami, Florida, for Fiscal Year ending September 30, 2002; and WHEREAS, it is the desire of the City Commission to add two rescue units to the Fire -Rescue Department to improve emergency response time; and WHEREAS, it is necessary to hire twenty-six (26) additional uniformed personnel to operate the two rescue units; and WHEREAS, it is necessary to increase the budget for the Fire -Rescue Department in the amount of $900,000 to cover the expenses associated with 26 new positions and other operational costs related to the addition of the two rescue units; and WHEREAS, on October 25, 2001, the City Commission adopted Ordinance No. 12144 appropriating $900,000 of Strategic Initiative Reserve funds for the Flagler First Condominium Project; and WHEREAS, it is necessary to amend Ordinance No. 12144 by revising the funding source identified for the Flagler First Condominium Project from Strategic Initiative Reserve funds to Parking Surcharge revenue; and WHEREAS, the $900,000 of Strategic Initiative Reserve funds previously identified for the Flagler First Condominium Project will now be allocated to the Fire -Rescue Department to fund the deployment and operational costs of the two additional rescue units; and WHEREAS, it is necessary to increase appropriations in the `Charges for Services' revenue category to reflect the $900,000 of Parking Surcharge revenue identified for the Flagler First Condominium Project; and WHEREAS, the proposed revisions include a change in positions set forth in the Table of Organization to reflect an increase of twenty-six (26) permanent positions in the Fire - Rescue Department; Page 2 of 5 1218 NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are adopted by reference and incorporated as if fully set forth in this Section. Section 2. Ordinance No. 12128, as amended, adopted September 25, 2001, the Annual Appropriations Ordinance for Fiscal Year ending September 30, 2002, is further amended in the following particulars: 11 "Ordinance No. 12128 Section 1. The following appropriations are made for the municipal operations of the General Fund for Fiscal Year ending September 30, 2002: GENERAL FUND Appropriations Departments, Boards, and Offices: * * * * * Fire -Rescue 48,9S7�52- 49,857,952 TOTAL GENERAL FUND $329,792,0 $ 330,602,037 Section 2. The above appropriations for the General Fund are made based on the following sources of revenues for Fiscal Year ending September 30, 2002: 1� Words and/or figures stricken through shall be deleted. Ordinance No. 12144, adopted October 25, 2001, is amended to reflect a change in the funding source identified for the Flagler First Condominium Project from Strategic Initiative Reserve funds to Parking Surcharge Revenue. Section 4. The increase of twenty-six (26) positions in the General Fund for the Fire -Rescue Department, funded by Strategic Initiative Reserve funds, as set forth in the Table of Organization, is approved. Section 5. All ordinances or parts of ordinances, insofar as they are in conflict with provisions of this Ordinance are repealed. Section 6. If any section, part of section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provision of this Ordinance shall not be affected. Section 7. This Ordinance is declared to be an emergency measure on the grounds of urgent public need for the preservation of peace, health, safety, and property of the City of Miami, and upon further grounds of the necessity to make the required and necessary payments to its employees and officers, payment of its debts, necessary and required purchases of goods and supplies and Page 4 of 5 ?� Y }Y� to generally carry on the functions and duties of municipal affairs . Section 8. The requirements of reading this Ordinance on two separate days is dispensed with by an affirmative vote of not less than four-fifths of the members of the Commission. Section 9. If the Mayor vetoes this Ordinance, it shall become effective immediately upon override of the veto by the City Commission or upon the effective date stated herein, whichever is later. At the City of Miami Commission meeting held on January 10, 2002, the City Commission expressed its desire to fund two additional rescue units in the Fire -Rescue Department in order to improve emergency response times. The estimated cost of adding 26 uniformed personnel and other operating costs to deploy two additional rescue units in Fiscal 2002 amounts to $900,000. The funding for the deployment in Fiscal 2002 will be from the reallocation of Strategic Initiative funds previously appropriated for the Flagler First Condominium Project. The Flagler First Condominium Project will now be funded with an increase in the estimated revenues from parking surcharge in Fiscal 2002.
