ORDINANCE NO.
AN EMERGENCY ORDINANCE OF THE MIAMI CITY
COMMISSION AMENDING ORDINANCE NO. 12128, AS
AMENDED, THE ANNUAL APPROPRIATIONS AND
CAPITAL IMPROVEMENTS ORDINANCE FOR FISCAL
YEAR ENDING SEPTEMBER 30, 2002, ACCEPTING
AND APPROPRIATING A DONATION IN THE AMOUNT
OF $36,500 FROM SHAKE -A -LEG MIAMI AND
REVISING CAPITAL IMPROVEMENT PROJECT
NO. 333124, VIRRICK COMMUNITY WATER SPORTS
CENTER; AUTHORIZING THE CITY MANAGER TO
EXECUTE THE NECESSARY DOCUMENTS, IN A FORM
ACCEPTABLE TO THE CITY ATTORNEY, FOR
ACCEPTANCE OF THE DONATION; CONTAINING A
REPEALER PROVISION AND A SEVERABILITY
CLAUSE.
WHEREAS, the City of Miami Parks and Recreation Department
has received $36,500 from Shake -A -Leg Miami to cover
additional architectural services necessary to implement
upgrades and revisions to the proposed Shake -A -Leg building
that is part of the International Water Sports Center Project;
and
WHEREAS, it is necessary to revise Capital Improvement
Project No. 333124, Virrick Community Water Sports Center to
accept and appropriate the donation;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Ordinance are adopted by reference and included
as if fully set forth in this Section.
Section 2. The donation from Shake -A -Leg Miami in the
amount of $36,500 for additional architectural fees related to
the International Water Sports Center Project is accepted.
Section 3. Ordinance No. 12128, as amended, adopted
September 25, 2001, the Annual Appropriations and Capital
Improvements Ordinance for Fiscal Year ending September 30,
2002, is further amended to appropriate said donation in the
following particulars:l/

Section 7. Section 6 of Ordinance No. 11705, as amended,
adopted September 28, 1998, and Section 5 of Ordinance No. 11839,
as amended, adopted September 28, 1999, and Section 7 of
Ordinance No. 11970, as amended, adopted September 28, 2000, are
further amended in the following particulars to revise previously
approved Projects and establish new Projects to be initiated
during Fiscal Year 2000-2001:

Section 4. The City Manager is authorized�/ to execute
the necessary documents, in a form acceptable to the City
Attorney, for acceptance of the donation.
Section 5. All ordinances or parts of ordinances,
insofar as they are in conflict with provisions of this
Ordinance are repealed.
Section 6. If any section, part of section, paragraph,
clause, phrase or word of this Ordinance is declared invalid,
the remaining provision of this Ordinance shall not be affected.
Section 7. This Ordinance is declared to be an
emergency measure on the grounds of urgent public need for the
preservation of peace, health, safety, and property of the City
of Miami, and upon further grounds of the necessity to make the

required and necessary payments to its employees and officers,
payment of its debts, necessary and required purchases of goods
and supplies and to generally carry on the functions and duties
of municipal affairs.
Section 8. The requirements of reading this Ordinance
on two separate days are dispensed with by an affirmative vote
of not less than four-fifths of the members of the Commission.
Section 9. This Ordinance shall become effective
immediately upon adoption and signature of the Mayor.31

3/ This Ordinance shall become effective as specified herein unless vetoed by the
Mayor within ten days from the date it was passed and adopted. If the Mayor
vetoes this Ordinance, it shall become effective immediately upon override of
the veto by the City Commission or upon the effective date stated herein,
whichever is later.

RECOMMENDATION:
It is respectfully recommended that the City Commission adopt
the attached emergency ordinance amending FY 2001 Annual
Appropriation Ordinance No. 11970, as amended, to accept and
appropriate a donation in the amount of $36,500 from Shake -A -Leg
Miami for additional architectural services related to its
proposed building at the International Water Sports Center
Project.
BACKGROUND:
The Shake -A -Leg Miami organization has previously donated
$40,095 to the City of Miami for the payment of architectural
and engineering fees associated with upgrades and revisions to
the scope of the International Water Sports Center. These funds
have been accepted by Resolution No. 01-753 and appropriated by
Ordinance No. 12083.
Once again, Shake -A -Leg has requested additional changes to the
scope of the project, thereby necessitating additional
architectural services to implement said changes to this end,
they have contributed to the City an additional $36,500 to fully
pay for the increased architectural fees.
The proposed legislation is a companion item to another item
scheduled for the January 10, 2002 Commission Meeting increasing
the contract with the architect of the International Water
Sports Center Project, R.J. Heisenbottle, P.A.
