RE: "Redistricting"; P osed presentation for City Commission Meeting of
December 12, 20 ; Outside Legal Counsel Miguel De Grandy's discussion
and request for policy direction related to implementation of 2000 Census
mandated City Commission districts reapportionment
As you are aware, the City Commission utilized, inter alfa, 1990 Census data when the
current single -member Commission district boundaries were first established in 1997. Those
boundaries have remained unchanged, but as a result of data now available from the 2000
Census, the City is in the process of reapportioning, as necessary, the City Commission's
districts.
That process, which the City Commission initiated, is ongoing and has manifested itself in
several ways: (1) City Commission adopted Resolution 02-670, on June 13, 2002, establishing
the City of Miami Commission District Boundary Committee; and (2) the City Commission, via
Motion 02-612, on the same date, directed creation of a redistricting plan and allocated funds for
the engagement of consultants and outside legal counsel. As a consequence of said Motion,
Miguel A. De Grandy, Esquire, was retained.
Mr. De Grandy has requested that the matter of City Commission district reapportionment
be placed, as a discussion item, on the City Commission's December 12th Agenda, and sets forth,
in his memorandum to me of November 27, 2002 (a copy of which is attached hereto), the
proposed issues for discussion and feedback during his requested one hour presentation and
discussion. Succinctly, his planned presentation is as follows: (1) legal issues related to
redistricting, and demographic issues raised by 2000 Census; (2) request for Commission policy
direction regarding related future public hearings; (3) request for Commission direction on the
preparation of new district boundary maps; and, (4) request for a "time -line" for completing the
redistricting process.

As we discussed a: our recent meeting in your office, I am requesting that the Ciry of Miami
Reapportionment be put on the December 12i° Agenda.
I would request that I have approximately one hour before the Commission. A portion of that time
will be used to give a presentation concerning the legal issues to be considered in a redistricting the
City using the dat« from the 2000 Census. The presentation will also highlight the demographic
changes the City faces and the challenges that they pose.
After the presentation, I would ask the Commission to give policy direction concerning whether it
desires public hearings set around the City in order to give members of the public the opportunity
to express their concerns about the new configuration of the districts. Public hearings are not
required under the law and their use is certainly within the discretion of the Commission. However,
our experience with the reapportionment of the Congressional delegation and the Legislature
showed that the public offered insights on issues such as communities of interest and
neighborhoods that should be kept united as boundaries are redrawn.
Once the direction concerning the public hearings is given, the legal team will work with staff to set
the hearings. Every effort will be made to have Spanish and Creole translators available and set the
hearings in venue`: that are accessible to persons with disabilities.
I am also going to ask that the Commissioners give direction on the types of factors that the legal
team and the experts should consider in drafting proposed maps. The types of factors include, for
instance, followin; natural and man-made boundaries and respecting communities of interest
Other factors will be discussed as part of the legal presentation.
Finally, the Commission will be asked to give direction on the time line to be followed in
completing the redistricting process. Qualifying for the 2003 election is in September. The
process should be concluded well before that, in order to give the courts time to consider a legal
challenge, should one arise. Exactly when is a policy decision for the Commission.
