CITY COMMISSION OF MIAMI, FLORIDA
On the 5th day of September 2002, the City Commission of Miami, Florida, met at the Miami
Sports & Exhibition Authority, 701 Arena Boulevard, Miami, Florida, in special session.
The meeting was called to order at 5:16 p.m. by Chairman Tomas Regalado, with the
following members of the Commission found to be present:
Commissioner Angel Gonzalez (District 1)
Vice Chairman Johnny L. Winton (District 2)
Commissioner Joe Sanchez (District 3)
Chairman Tomas Regalado ( District 4)
ABSENT:
Commissioner Arthur E. Teele, Jr. (District 5)
ALSO PRESENT:
Alejandro Vilarello, City Attorney
Maria Chiaro, Assistant City Attorney
Julie O. Bru, Assistant City Attorney
Joseph Serota, Esquire, Weiss Serota & Helfman
Priscilla A. Thompson, City Clerk

1. ATTORNEY-CLIENT SESSION TO DISCUSS PENDING LITIGATION IN THE CASES
OF PATRICIA ROBBINS VERSUS THE CITY OF MIAMI, AND PATRICK MCGRATH
AND MIAMI-DADE COUNTY VERSUS THE CITY OF MIAMI.
Chairman Regalado: This is a special City Commission meeting. It's been noticed to be held in
the Executive Office of Miami Sports and Exhibition Authority, MSEA, and the purpose is to
discuss of several cases. A meeting was requested by and the City Attorney, so he'll brief the
members of the Commission on the issues that will be discussed.
Alejandro Vilarello (City Attorney): OK, we'll now be going into attorney-client session, which
is closed to the public for discussion of two particular cases. If the Commission wishes to go
ahead and proceed to the VIP (Very Important People) room, I'll go ahead and make the
announcement into the record. Pursuant to the -- pursuant to Florida Statute 286.1011(8)
[2002], the person chairing the Commission has announced that immediately after convening the
public meeting, there will be the commencement of the attorney-client session, closed to the
public, for purposes of discussing pending litigation: The McGrath, et al. vs. City of Miami and
Miami Dade County, et al. vs. City of Miami parking surcharge case, and Patricia Robbins, as
the personal representative of the estate of Otis James Robbins vs. the City of Miami. The
closed door session will begin at approximately 5:15 p.m.; both sessions will be attended by
members of the City Commission, Tomas Regalado, Angel Gonzalez, Joe Sanchez, Arthur
Teele, Jr., and Johnny Winton; the City Manager, Carlos Gimenez; the City Attorney, Alejandro
Vilarello, and Assistant City Attorney Maria Chiaro, and the session related to -- and Joe Serota,
on behalf of the City. The session related to the parking surcharge cases will be attended
additionally by -- I'm sorry, counsel -- counsel for the City, Joe Serota, from the law firm of
Weiss Serota & Helfman. The session related to the Robbins case will attended -- will be
attended additionally by Assistant City Attorney Julie Bru. A certified court reporter will be
present to ensure that the sessions are fully transcribed and the transcripts will be made public
upon the conclusion of the above cited ongoing litigations. At the conclusion of the attorney-
client sessions, the regular Commission meeting will be reopened and the person chairing the
City Commission meeting will announce the termination of the attorney-client session.
Thereupon, the City Commission recessed at 5:16 p.m. to convene the attorney-client
session.
Thereupon, the City Commission reconvened its special meeting at 6:25 p.m. in open
session.
Mr. Vilarello: (INAUDIBLE) adjourned (UNINTELLIGIBLE) executive sessions, and now
we're back in the public meeting. Mr. Chairman.
Chairman Regalado: Yes, public meeting --
Vice Chairman Winton: Move to adjourn.
Chairman Regalado: Yes, we have a motion to adjourn.

Chairman Regalado: Second by Commissioner Gonzalez. All in favor, say "aye."

The following motion was introduced by Vice Chairman Winton, who moved its adoption:

A MOTION TO ADJOURN TODAY'S SPECIAL COMMISSION MEETING.
Upon being seconded by Commissioner Gonzalez, the motion was passed and adopted by the
following vote:
AYES: Chairman Tomas Regalado
Vice Chairman Johnny L. Winton
Commissioner Angel Gonzalez
NAYS: None.
ABSENT: Commissioner Joe Sanchez
Commissioner Arthur E. Teele, Jr.
Chairman Regalado: Good night, good night.
Vice Chairman Winton: Thank you, thank you. Bye-bye.
