SLUM AND BLIGHT CONDITIONS
PROPOSED EXPANSION AREA
This report is presented for the consideration of the City of Miami
Commission, during its deliberations on the potential expansion to the
boundaries of the existing redevelopment district.
BACKGROUND
In 1969, the Board of County Commissioners approved by Resolution
1117-69 the Central Miami Renewal Plan. This plan included the area south of
NW Twentieth Street; west of the FEC Railroad, with an extension to N.E.
Second Avenue; east of I-95; and north of the Miami River. It was amended on
January 20, 1981, to include the areas bounded on the west and south by the
FEC tracks; on the east by Biscayne Boulevard; and on the north by I-395. In
addition, the area bounded on the south by I-395; on the east by Biscayne
Boulevard; on the north by NW Seventeen. Street in part, and the City of
Miami Cemetery in part; and on the west by the FEC tracks.
At those public hearings, evidence was presented to find this area meeting
the definition of "slum and blight".

The importance of that decision is that the proposed expansion area located
north of I-395 and fronting on NW Third Street, extending north to NW
Twentieth Street was declared through resolution of the County Commission
as "slum and blight". (Area B1). Additionally, Areas B and C of the proposed
expansion, were part of the Central Miami Urban Renewal Area graphic
provided for illustration purposes at the hearing of January 20, 1981, when the
expansion was approved.
PROPOSED AREA A. These properties are located within the rights of
way of I-395 and I-95. They were not included in the description of either of
the existing redevelopment districts. These properties are presently in a state of
disrepair, and to leave them out of the districts simply creates a ribbon of
neglected properties separating the redevelopment districts. These properties
meet the criteria of "slum and blight".
PROPOSED AREA A-1. The general boundaries of this area are: on the
south and west, the I-395 Right of Way; on the north NW l x. Street from I-
395 to North Miami Avenue, and NW 15`h; and on the east North West Miami
Avenue.
This area is in state of disrepair, and it contains a number of vacancies that
present serious limitations for redevelopment. It is important to consider this
area in connection with the SEOPW Redevelopment District because of its
visual relationship to both districts, and its continuity under the expressway.
PROPOSED AREA A-2. This area is bounded generally on the north and
east by the I-95 Right of Way; on the west by NW Fifth Avenue; and on the
south by NW Tenth Street
Two of the three properties are owned by the City, and the other one is a
decrepit structure, which needs major work or demolition.
The percentage of vacant land and dilapidated structures qualifies the area
as "slum and blight".
PROPOSED AREA A-3. Bicentennial park is presently vacant. There is
no permanent use established. The only meaningful structure is the seawall and
it is damaged to a great degree.

It is important to consider this area as expansion to the Redevelopment
District because its planned use will serve as a support activity to the residential
development that will emerge in the immediate neighborhoods.
PROPOSED AREA A4. Watson Island has some uses projected, but
presently its major portion is vacant.
Again, the percentage of existing vacant land qualifies this area as "slum and
blight".
PROPOSED AREA B. This area is defined on the north by NW Tenth
Street; on the east by I-95; on the south by NW Fifth Street; and on the west by
NW Fifth Avenue.
It is evident that the identity of the existing SOTPW area is changing, from
a primarily residential neighborhood to a more dynamic mixed-use district,
defined by attractions and recreational activities. As these uses take up some of
the properties that were originally considered for residential purposes, Area B
emerges as a natural expansion to the west. There is a neighborhood
infrastructure, which maintains a very close visual relationship and great
connectivity through the street network that crosses under the expressway.
The building code requires a 40/50 year certification for structures built
before 1960. Eighty percent of the properties were built before 1960.
Approximately fifty percent of the properties are vacant.
The number of vacancies, lack of maintenance and updating qualify this
area as "slum and blight" under the criteria of "deterioration of site and other
improvements"; "diversity of ownership which prevents the free alienability of
land within the deteriorated area"; and "inadequate and outdated building
density patterns".
AREA B-1. This corridor runs along NW Third Avenue, from I-395 to
NW Twenty Second Street. It includes all properties fronting on the east side
of the right of way. On the west side, it includes a number of properties owned
by public agencies, which have contributed to the character of the strip. It is
important to expand the District to include this corridor so that the tax
increment may be used to improve a significant number of historically
significant structures in disrepair. The majority of structures were built before
1950.

Number of vacancies and the age of the buildings meet the criteria of
"slum and blight".
PROPOSED AREA C. This area is defined by NW Eleven Street on the
north; on the east by NW Fifth Avenue; On the south by NW Seventh Street;
and on the west by NW Seventh Avenue.
Almost sixty percent of the property in this area is vacant, and the
remainder contains a mix of industrial, commercial and residential uses.
Diversity of ownership and vacancy rates qualifies this area as "slum and
blight".
Attached please find a list of properties according to the proposed area,
including vacancies and condition of the existing structures. This will assist the
Board during its consideration for expansion.

The john S. and James L. hnight Foundation has funded and formed a partnership between
B.A.M.E. Development Corporation, the Black Archives History and Research Foundation,
the Local Initiatives Support Corporation (LISC), St. John Community Development
Corporation, The Trust for Public Land (TPL), and the Collins Center for Public Policy to
help catalyze the revitalization of Overtown. %X'e are diligently working to recreate
Overtown with the following goals:
a. To plan, create and sustain a healthy mixed -income, multi-ethnic communis,
and a mixed-use neighborhood with adequate public spaces and parklands;
b. To use private, public, and community, capital to build housing and physical
development, create jobs and economic development, and contribute to the
social and human development of area residents;
c. To affirm and build upon the historic and cultural heritage of Overtown;
d. To assure the maximum possible benefits to the existing residents and businesses
from a revitalized Overtown; and
e. To undertake this neighborhood transformation effort with the significant
collaboration and participation of Overtown stacehu-iders and through a broad
program of community participation, community- organizing, and community -
building.
With regard to the proposed expansion of the CR -1 target area, we request that the CR -1
address the following question: Why is the CRA proposing the expansion and in ghat
manner will it benefit the community?
The Partnership is concerned that an expansion in the target area will siphon both energy
and funds from existing CRA areas. As there are many proposed miffed -use, mixed income
projects in Southeast Overto-,,m/ Park %Vest, it would be counterproductive to take away any
energy or resources from these initiatives.

The community needs the CRA to help expedite the development process for projects
already proposed. Below are specific actions needed from the CRA.
• P.A.M.E. Development Corporation requires the CRA's help in securing permits for
New Hope Overtown, 4U -units of muted -income single-family detached homes.
• In order to facilitate the expansion of the Lyric Theater, the Black Archives is
requesting that the CRA implement the following: sign the application necessary to
close the alley behind the theater, execute the lease agreement for the south side, and
allow the Black Archives to acquire property on the east side needed for the
economic viability of the theater.
• St. John Community Development Corporation has assembled 14 scattered sites in
the Overtown area and is in the process of constructing new for -sale and rental units
and needs the CRFs support on these and other developments.
• TPL needs help in implementing its Overtown Greenprint. The Greenprint will
transform the landscape of the communin through an interconnected system of
open spaces including parks, gardens, plazas, and pedestrian corridors.
• LISC and the Collins Center are assisting with these projects and more.
l:ommissioner Teele, there are mane existing projects that need the CR -i's support and
immediate attention.
Our success in the revitalizauon of Overtow-n depends on the CRFs support of these
community -driven projects and efforts. We ask that the (:R_\ commit itself to the support
and encouragement of these initiatives.

Southeast Overtown/Park West Redevelopment Plan Amendment and
Modification
Dear Mayor Diaz, Commissioners, and City and CRA Staff:
I am in receipt of the Miami City Commission's proposed ordinance amending and
modifying the Southeast Overtown/Park West Community Redevelopment Plan to
extend the boundaries. The proposed ordinance was adopted on first reading at the
June 13, 2002 City Commission meeting and is scheduled for public hearing on June
24, 2002. Please enter this letter into the record for this agenda item at the public
hearing.
Per Florida Statutes Chapter 163, Part III and our interlocal agreement, it is clear that
the Board of County Commissioners (the "Board") of Miami -Dade County, a home rule
charter county, must approve any Plan amendment and modification for it to be
effective. We would expect clear communication from the City on any intention it has to
amend this Plan. It is particularly important, in my judgment, that the City and County
confer prior to an item's advancement when it relates to common issues such as
blighted conditions and how we jointly may agree to spend our limited ad valorem tax
dollars. We recently were surprised when we became aware of your intentions only
through a public advertisement in the Miami Herald wherein readers were informed that
the City was to consider and take action on the subject ordinance at its June 24, 2002

meeting. We were not provided advance communication on this subject. We were,
subsequently, disappointed that the City took up this proposed ordinance for first
reading on June 13. 2002 as a "pocket' item late at night (as the last item) without it
being on the City Commission Agenda and without proper notice to taxing jurisdictions
(Miami -Dade County) per Florida Statutes Chapter 163, Part Ill. We have reviewed the
subject statutes, including recent amendments, and conclude that Board approval is
needed.
Specifically, our interlocal agreement on Southeast Overtown/Park West clearly
indicates that only specific powers have been delegated by the Board; the power to
amend and modify the Plan has not been delegated. We look forward to discussing
these matters with City staff; however, at this time, we see no legal basis whatsoever for
unilateral City action. Further, I am informing you that we expect the City to bring this
Plan amendment and modification, if adopted by the City, to the Board for
consideration. Unless approved by the Board, the County will not consider any change
in boundaries to be in effect. Also, you should be aware that based on the information
provided by the City to date, I do not support the proposed boundary change and would
not recommend such change to the Board.
I am especially concerned that in the proposed ordinance the City Commission is solely
referenced as the governing body of the Miami Community Redevelopment Agency
(CRA) and there is no reference to the Board in this governing/approval process. Also, I
understand from County Office of Management and Budget staff member Thomas
Marko, present at the subject June 13, 2002, meeting that immediately following the
meeting he spoke with Commissioner Art Teele, City Manager Carlos Gimenez and City
Attorney Alex Vilarello wherein the Commissioner indicated the City has a "window of
opportunity" until July 1, 2002, to expand the Plan's boundaries without Board approval.
As Tom indicated then, we do not concur that the City can act unilaterally on this very
important matter within any "window of opportunity".
Regarding Southeast Overtown/Park West, but on a different subject, we recently
received CRA documentation indicating the CRA intends to use CRA funds for
relocation expenses outside of the Southeast Overtown/Park West boundaries. I
understand that the CRA intends to use funds for relocation expenses and that CRA
staff has a private attorney's legal advice that CRA funds may be used for such
purposes. However, it is also my understanding that this use would require County
Commission approval. Without further information and discussion between City, CRA
and County staff, my recommendation would be that the Board not amend the Plan for
this purpose at this time.

Thank you, in advance, for taking my concerns into account at your June 24 public
hearing. I firmly believe it is in our mutual best interest to work together and
communicate fully on redevelopment plan modifications and improvements for the
Southeast Overtown/Park West area, or any other redevelopment districts or areas of
mutual concern. County staff will be in attendance at Monday's meeting.

threaten the homes of so many
people, experts said. As of
Wednesday, 38 families had
been displaced at Woodhill
Apartments, a collection of 21
neatly kept two-story buildings
on well-groomed, oak -shaded
slopes. About 100 people, many
assisted by the Red Cross, were
being housed temporarily in
other apartments, or with
friends or in motels.
"Chances are it is probably
not quite over yet," cautioned
Shiou-San Kuo, professor of
engineering and director of the
Sinkhole Institute at the Uni-
versity of Central Florida. "You
have to wait a few days to see if
it will grow bigger."
That was bad news for
Rebecca Frias and others who
scampered to safety Tuesday
night when the sinkhole
appeared. Frias awakened to a
hasty evacuation order. She
peeled open the drapes and
looked down in horror.
"Everything was just drop-
ping," said Frias, 18, a worker at
OfficeMax. A bench, a gazebo
and trees were disappearing
into the hole, neighbors said.
BIGGER AND BIGGER'
"The hole was getting bigger
and bigger," Frias said. "I was
really, really scared." She
grabbed her 11 -month-old
daughter, Lisely, fetched her
aging grandmother and blind
cousin and led them to the
safety of the parking lot.
There, as fire trucks, ambu-
lance, police and county build-
ing officials rushed in, they
joined other worried people
like Merliana Williams, 25,
whose daughter had been play-
ing near a gazebo moments
before it started moving toward
the ever-growing pit. Williams'
fiance had just brought the
child back to the apartment.
"By the grace of God, she was
saved," Williams said during a
pause in trips between car and
apartments.
As Williams spoke, streams
of neighbors moved in and out
of apartments, salvaging every-
thing they could. Although ten-
ants were not allowed to sleep
in their apartments, officials
declared the buildings safe
enough to let people retrieve
their furniture and other
belongings.
On a window nearby, build-
ing officials have pasted a large
"CONDEMNED" sign. No one
knew when families would be
allowed to move back in.
As a withering sun beat
down on them, people stuffed
their furniture and other
belongings into anything with
wheels as the daylong evacua-
tion continued into nightfall.
The volunteer spirit was alive
and well as men moved from
orae apartment to the next,
helping neighbors hoist the
heaviest furniture.
SECOND IN A WEEK
The Woodhill sinkhole is the
second one in Central Florida
i L the past week. Another one
flit Interstate 4 last week, clos-
ing one lane for several days.
Sinkholes happen when sed-
iment resting on Florida's lime-
stone bedrock collapses into
cavities left behind by water.
Droughts or heavy rain create
instability and can trigger a
sudden collapse.
"It has taken nature hun-
dreds of millions of years to
create the cavities that are now
collapsing," said Anthony Ran-
dazzo, a geology professor at
the University of Florida. "This
is a long geological process."
Although most of the state's
recent sinkhole activity has
been in the Hillsborough,
Pinellas, Pasco and Hernando
Counties area, some of the most
severe have been in the
Orlando area. Florida has thou-
sands of sinkholes, . but not
since a 250 -foot -wide giant
appeared in 1981 in Winter Park
Lias there been one this big.

Notice is hereby given that a public hearing will be held at 5:30 p.m. on June 24, 2002, in the City Commission Chambers of City Hall, 3500 Pan American Drive, Miami, Florida, for the purpose of receiving
public comment on a proposed ordinance amending and modifying The Southeast Overtown/Park West Community Redevelopment Plan by extending the boundaries of the Southeast Overtown/Park West

Beginning near the southeast corner of Lummus Park; at the southwest comer of the intersection of NW 2nd Street and NW 3rd Court; continue north to the north side of NW 5th Street; then west along the
