Before we begin this system, the City will have a 96 -gallon con- tainer (cart -on -wheels) delivered to your home for you to use to dispose of your residential garbage and trash. You will no longer be able to use personal cans. Bags should be placed into the con- tainer. These cans will hold as much as three standard garbage s and are on wheels for easy movement. You are to use it for bage, trash and yard waste, as long as the container is able to close. Your service collection days will not change. We will still collect garbage twice a week, just as we do now. In addition, we will still pick up large bulky waste items and large tree cuttings according to the schedule we currently use, until this is implemented city- wide, at which time we will reassess the bulky waste collection schedule. Reports from other communities indicate that residents like the idea of using these containers because they are on wheels, have an attached lid, and improve the appearance of the neighborhood by reducing litter associated with bag or can breakage. A detailed information sheet will be attached to the container when it is delivered to you. Please take the time to read it before placing it at curbside for collection. Our aim is to provide you with better service and a cleaner community. If you have any questions about the service or need assistance with using or plac- ing your cart out, please let us know. Your typical household garbage and trash, including yard trim- mings such as grass and leaves, may be placed in the container, as long as the lid can close. Automated Collection is a totally new system of residential garbage and trash collection that requires a special vehicle and container. The City of Miami currently provides manual garbage collection. Each home will be given a special container on wheels which the resident will roll to the curbside on collection day. The truck is equipped with a lifting mechanism that reaches out to the container, lifts and empties the contents and returns the cart to its original position. The driver never leaves the truck cab, but controls the entire loading operation from the driver's seat. The entire process takes approximately 50 seconds. After collection, the resident is responsi- ble for rolling the container to its storage place. Que es el Servicio Automatizado? Pinkney 305-635-5130 The Ninth Annual Commemorative Service and Procession sponsored by the African American Committee of Dade Heritage Trust will take place on Sunday, April 28, 2002, beginning at 2:30 P. M. Special tribute will be paid to Mr. M. T. Mitchell, Mr. Artry Willis, incorporators of the City of Miami, and Mr. George E. Kelly, a musician with the Ink Spots. All pioneers buried in the City Cemetery will be honored. Admission is free and refreshments will be served. The public is invited to participate in the procession from Historic St. Agnes Episcopal Church, 1750 N. W. Sr' Avenue to the City Cemetery, 1800 N. E. 2nd Avenue where the Service will take place. The Progressive Cornet Band, Mr. Thomas Cash, director, will lead the procession. Additional music will be fiunished by the Arcola Lakes Singing Angels, Dr. Richard Strachan, director, and Ms. Travalya Wallace, soloist, Northwestern Senior High School. Winners of the Essay Contest, "Why I Am Proud of My Heritage," will be announced. Mr. M. T. Mitchell's name is listed on the Miami City Charter as a Colored incorporator of the City of Miami. A headstone will be unveiled and dedicated in his honor during the Ninth Annual Commemorative Service in memory of his contributions to Miami. The Miami City Directory, of 1904 lists him as a General Merchandiser whose business was located at 100 Avenue G., now known as Second Avenue. Later he became Miami's first African American Undertaker and Embalmer at 114 Avenue G. He bought fifty (50) lots in the City Cemetery from the City of Miami in order to have a place to bury black people. The February 28, 1913 Miami Metropolis lists his death in the obituary column. It stated that he was a well and favorably known colored citizen of Miami who died suddenly at his home. The Miami City Cemetery Burials 1896-1990 states that he was sixty-five at his death. His wife, Ella Mitchell, who was a milliner and dress- maker, sold hats and dresses to Burdines. She did not want to continue the business and sold it to Dr. Kelsy L. Pharr, and Edward Carter, according to her granddaughter, 84 year old Sara Scott Martin Stewart who now lives in Jacksonville, Florida. Mrs. Monica Hanna 90, said that caskets were carried in a glass hearse and driven by two horses during those days in Miami with a marching band as a part of the funeral procession. No one knew Artry Willis' original name, according to his great —grandson, Dwight Jackson, of Richardson Mortuary. Willis is an incorporator of the City of Miami. He was a slave who was brought to Little Rock, Arkansas and worked on a plantation clearing land. He was physically challenged and threatened by a grand wizard of the Ku klux Klan who slapped him. In turn he shot and killed the klansman. He escaped Arkansas through the Underground Railroad, and migrated to Miami to make a new start in life. He changed his name to Artry Willis. and started his own logging firm, supplying logs for Henry Flagler. These logs were used to create rails for the railroad and lumber for building. He was successful in his business. He would leave his house everyday, located on 3rd Avenue and 14d' Street and ride his bicycle to his F f business, located D CUSSED IS U , y� between Perrine and Goulds, Florida and return every evening. He was well liked by both blacks and whites, and considered to be the second wealthiest African American in Dade County, next to Mr. D. A. Dorsey. His wealth was also accumulated through purchasing many parcels of land from Miami to Homestead. He married Sophie Stokes, and to this union one daughter was born, Artie Willis Richardson, founder of Richardson Mortuary. Flowers will be laid at his grave during the service '1 George Edwin Kelly was born July 31, 1915 in Miarni, Florida. He died May 31, 1998. He graduated from Booker T. Washington High School in 1935, where he formed his first band, "Little George Kelly and the Cavaliers." This band played between Miami and Fort Lauderdale. Many of his friends, Ivan "Loco" Rolle, Panama Francis, Noel Cruz, William Curry, Grachan Moncur, and Theodore Hepburn were a few of the members of his first band. He was a veteran of World War II, Air Force Band. He married Ida Simmons. From this union two daughters were born, Ida Kelly McKay, and Dorothy Kelly Wooten. The Comprehensive Employment Strategy Agreement Between Miami Dade County and The City of Miami, approved through the adoption of Resolution No. 00-704 by the City Commission July 27, 2000, states that the County's Construction Manager must meet the objectives of the County's Job Clearinghouse and the City's First Source Hiring Provisions to employ unemployed or under- employed individuals who reside locally. The Department of Community Development, Office of Workforce Development has been working closely with the Performing Arts Center Builders (hereafter referred to as the Master Contractor) in an effort to facilitate compliance with the standards set forth by the Comprehensive Employment Strategy Agreement (hereafter referred to as the Employment Agreement) (See Attachment A), by serving as a screening and referral source for employees on the Project. Section 1.1 of the Comprehensive Employment Strategy Agreement states, "First priority is being provided to those residents within the County's Empowerment Zones (CBD and Seaport Neighborhood, and the Overtown Neighborhood). To the extent that the available employment opportunities cannot be met by the above outlined first priority residents, 2"d priority for every employment generated by the project shall be given equally to residents of QNIP Zone I of Miami Dade County and within the City to those residents of the Community Development Block Grant (CDBG) Community Revitalization Districts (Overtown and Wynwood) in which the Project is located -The 3'd priority for every employment opportunity generated by the project shall be given to qualified unemployed, under -employed and Section 3 residents of the City of Miami, and thereafter to qualified unemployed, under -employed and Section 3 residents of unincorporated Miami Dade County and the incorporated municipalities in Miami Dade County. To the extent that the available employment opportunities cannot be met within the above outlined ls; 2"d and 3'd priority residents, 4m priority for every employment opportunity generated by the Project shall be given to qualified workers outside of the above-described areas': The Office of Workforce Development serves as a primary referral source of qualified candidates to the Project. It has the capacity to attract and screen job candidates, track job orders and manage candidate referrals to help facilitate the process, in support of the good faith efforts of Project contractors, in providing employment opportunities for area r-esidents within the four priority areas outlined in the Comprehensive Employment Strategy Agreement. As stipulated in the Agreement, the first opportunity to apply for employment opportunities generated by the Project will be determined by the priority status of the applicant. The Master Contractor agreed to route all job orders for new hires for the Project through the City of Miami. To date, the Office of Workforce Development has processed a total of 331 applications for employment. From this total, 188 (57%) applications were submitted by City of Miami residents and the balance by residents of Miami -Dade County. A list of all applicants, including a breakdown by trade, qualifications, and Commission District, is attached (See Attachment B). Also enclosed is the Master Contractor's Overall Workforce Plan that lists the 42 contractors approved to work on the Project, including an overview of the anticipated number of new hires created by the Project and the projected job start date for each subcontractor (See Attachment Q. Based on the information provided in the Master Contractor's Overall Workforce Plan, it is estimated that 400 new hires will be created for the Project during the construction phase from January 2002 through September 2003. Under the timelines established in to the projected schedule, it was anticipated that 49 new hires should have been placed on the Project at this time. However, to date, the Office of Workforce Development has received work orders from only one (1) subcontractor, Complete Dewatering Pumps and Wells Inc., requesting nine (9) laborer positions. The Office of Workforce Development referred ten (10) candidates to these job openings, which includes two (2) replacement referrals, and all ten (10) applicants were subsequently employed by Complete Dewatering Pumps and -Wells, Inc. For your information, these candidates were referred from a database maintained by the Office of Workforce Development for Performing Arts Project applicants. Applicants were referred to the subcontractor based on -conformance with the laborer qualifications required of the position in accordance with the priority criteria defined in the Employment Agreement. Based on these criteria, six (6) candidates qualified in the aid priority, which includes unemployed or underemployed City of Miami residents. It should be noted that five (5) of the ten (10) individuals selected for employment were union members, three (3) from Laborers Union #278 and two (2) members of the Ironworkers Union. The Office of Workforce Development also provided a Community Small Business Enterprise and Employment Compliance Seminar February 21, 2002 for prime subcontractors of the Master Contractor to the Project. This seminar included an in depth presentation on the First Source Hiring Agreement, stressed the importance of compliance with the Comprehensive Employment Strategy Agreement for the Project and provided a comprehensive overview outlining the benefits of partnering with the Office of Workforce Development. It is also important to point out that staff held several meetings with representatives from the Local Union 278, Laborers Union February 28, 2002 to discuss the potential economic impact of the Project, specifically as it related to the creation of new jobs for unemployed and underemployed residents of the City. This discussion included a proposed amendment to the existing Comprehensive Employment Agreement to ensure that language be included in the CESA requiring all subcontractors on the Project to enter into an agreement with the Union to allow members to receive benefits. It was agreed that union members would be referred to the Project through the Office of Workforce Development to streamline referrals *and monitoring of all new hires to the Project. Representatives from the Laborers Union 278 were advised that the issue of benefits was one which would have to be worked out with each subcontractor, or would require revision of the entire agreement. To date, there have been no additional job orders received by the Office of Workforce Development despite direct requests made to the individual contractors that have started work on the Project. According to Alicia Anderson, Department of Business Development Compliance Officer, a draft of the Comprehensive Strategy Agreement Monthly Report which reports cumulative hires through February 2002 reflected a total of nine workers on the project to date. Although the report has not been finalized at this time, if the initial number of hires reflected in the draft report is accurate, all new workers hired were referred through the Office of Workforce Development. This agreement, with the amended priorities outlined herein, will help to ensure that the Construction Manager and the Subcontractors participating in the construction of the PAC utilize a comprehensive strategy to meet the objectives of the County's Job Clearinghouse, the County's Quality Neighborhoods Initiative Bond Program (QNIBP) — Utilization of Area Residents by Contractors, and the City of Miami's First Source Hiring Ordinance to employ unemployed or under -employed individuals who reside locally and individuals who are transitioning from welfare benefits to self -sufficiency - BACKGROUND On January 25, 2000, the Board approved Resolution R-78-00 authorizing the County to enter into a Comprehensive Employment Strategy Agreement with the City of Miami. The intent of this Agreement is to meet the objectives of the County's and the City's employment recruitment goals by establishing a comprehensive agreement to delineate the strategy. The City of Miami has required, as a condition for the issuance of the PAC's Major Use Special Permit (NIUSP), that the County execute a "First Source Hiring Agreement" with the City. The approved Comprehensive Employment Strategy Agreement incorporates the City's NfUSP requirement and centralizes the County's Job Clearinghouse, QNIBP and Empowerment Zone recruitment objectives. �aST �ED Honorable Chairperson and Members Board of County Commissioners Page 2 On July 27, 2000, the City of Miami Board approved Resolution No. 00-704, which modified the Comprehensive Employment Strategy Agreement approved by the Miami - Dade Board of County Commissioners on January 25, 2000. The following are the modified priorities for the hiring goals contained in the attached Agreement. These are followed by a summary of the differences between the recommended Agreement and the previously approved Agreement. Amended Comprehensive Employment Strategy Agreement Priorities 1. Provide first priority to those residents within the County's Empowerment Zones (Central Business District & Seaport Neighborhood and Overtown Neighborhood as identified in Exhibit 1). 2_ Provide second priority to residents equally of QNMP Zone 1 of Miami -Dade County (Exhibit 2) and within the City of Miami to residents of CDBG Revitalization Districts (Overtown and Wynwood) (Exhibit 3) 3. Third priority for every employment opportunity generated by the Project shall be given to qualified unemployed, under -employed and Section 3 residents of the City of Miami, and thereafter to qualified unemployed, under -employed and Section 3 residents of un -incorporated Miami -Dade County and the incorporated municipalities in Miami -Dade County. 4. Fourth priority for every employment opportunity generated by the Project shall be given to qualified workers outside of the above-described areas. Summary of Differences The previously approved Agreement contained three hiring priorities, the first of which combined Priorities I and 2 above. The former Priority 2 has become the new Priority 3 and now includes Section 3 residents of the City of Miami. Also the old Priority 3 included "qualified unemployed, under -employed and Section 3 residents of Broward, Monroe, and Palm Beach Counties"_ This priority is now covered under Priority 4, above. The goal is to employ unemployed and under -employed residents in these regions who meet job -specific qualifications. The County and the Construction Manager will mutually develop specific hiring goals, specifically taking into consideration the priorities outlined above. The Performing Arts Center Management Office will have a full-time CSBE Specialist, recruited through the Department of Business Development, to ensure adherence to these requirements. To the extent that the Construction Manager has not met these goals, the Construction Manager shall be penalized pursuant to the CSBE Provisions in Miami -Dade County Ordinance 9-52 and Administrative Order 3-22, as amended. wED v _= ATTACHMENT A PERFORMING ARTS CENTER OF GREATER MIAMI COMPREHENSIVE EMPLOYMENT STRATEGY AGREEMENT THIS AGREEMENT is made this day of , 2001, by and between the City of Miami, a municipal corporation of the State of Florida (the "City") and Miami -Dade County (the "County"), a political subdivision of the State of Florida. The Work may constitute the whole or a part of the Project. o) The terms "Workforce Plan" means a plan delineating the administrative and construction trade personnel that will work on the Project. The plan shall be organized by trade and indicate: the positions that are already filled and the positions that will require recruitment;_the anticipated date that the hiring process will be initiated; the deadline for referrals; the anticipated position commencement date; and the duration of the position. 3 2. 1. Construction 1.1 The City acknowledges that Miami -Dade County intends to solicit proposals from Construction Managers, with a general contractor's license, for the construction of the Project. Miami -Dade County agrees to the greatest extent possible, to cause the Construction Manager, and each of the contractors and subcontractors, retained by the Construction Manager, to first give every employment opportunity generated by the Project to qualified unemployed, under -employed, Section 3 and other residents of the City of Miami and Miami -Dade County, including, but not limited to those who are participants in the County's training, employment, Clearinghouse and QNIBP programs and the City's training and employment programs (where certificates of competency are required, the training program must be a State certified apprentice program in accordance with Section 2-11.16 of the Code of Miami -Dade County — Responsible Wages), by providing first priority to those residents within the County's Empowerment Zones (CBD & Seaport Neighborhood and Overtown Neighborhood as identified in Exhibit 1). To the extent that the - available employment opportunities can not be met by the above outlined first priority residents, 2"d priority for every employment opportunity generated by the project shall be given equally to residents of QNIBP Zone 1 of Miami -Dade County (as identified in Exhibit 2) and within the City to those residents of the Community Development Block Grant (CDBG) Community Revitalization Districts (Overtown and Wynwood as # identified in Exhibit 3) in which the Project is located. To the extent that the available employment opportunities can not be met by the above outlined 2nd priority residents, 3`d priority for every employment opportunity generated by the Project shall be given to qualified unemployed, under- employed and Section 3 residents of the City of Miami, and thereafter to qualified unemployed, under -employed and Section 3 residents of un- incorporated Miami -Dade County and the incorporated municipalities in Miami -Dade County. To the extent that the available employment opportunities can not be met within the above outlined 151, 2nd, and 3`d priority residents, 4 I priority for every employment opportunity generated by the Project shall be given to qualified workers outside of the above- described areas. Miami -Dade County's obligation shall include, without limitation, requiring the Contractor and its Subcontractors to do following: A.-. Utilize the assistance of the Miami -Dade County and City of Miami's Office of Workforce Development (OWD) as the screening and referral sources for employment for the Project. After the construction contract is awarded and prior to submission of the first application for -payment, the Contractor shall be required to inform the County and OWD of its overall Workforce Plan by trade and the number of positions which may be filled through the County and OWD. The Contractor will furnish a job schedule which reflects the anticipated Workforce plan by trade. The Contractor will advise the County and OWD of the minimum qualifications required for each position identified to the Contractor by each _ 5 Subcontractor. The Contractor will update and submit the Workforce Plan ' with each monthly payment request; B. n the event that the County or the City of Miami residents that were referred by the County or OWD pursuant to this Agreement are to be replaced, for any reason, during the course of the Project, Miami -Dade County will require the Contractor to immediately contact the County and OWD for assistance in identifying the replacements that are required. The County and OWD shall make their referrals to the Contractor within three (3) business days; and C_ 1 Miami -Dade County will require the Contractor to advertise, as needed, in local minority media, the Miami -Dade County community television channel (Channel 34), and the City of Miami community television channel (NET 9), seeking to attract unemployed, under- employed and Section 3 residents of Miami -Dade County (both incorporated and un -incorporated) and the City of Miami to seek employment at the Project. \21 2 r In the event that the County and OWD are unable to identify qualified persons to fill all the positions identified by the Contractor with the respective time frames provided for in Section B. above, any unfilled positions my be filled by any qualified Miami -Dade County resident and subsequently to any Broward, Monroe and Palm Beach County residents and thereafter to any qualified .person irrespective of their residence. 1.3 The City acknowledges that all employees of the Project will tip• 2 f= be required not only to have the required employment skills but also to comply with the requirements of the Project insurance policy, including, without limitation, requirements for a drug free workplace. In addition, the County and the City acknowledge that various employment opportunities will require union membership. OWD shall assist the Project in upgrading the skill level of the City of Miami residents by making its employment and training programs available to qualified individuals within parameters of its contract and program guidelines. 1.5 To the extent that the procedures set forth in this Section are In conflict with the procedures implemented by the Contractor in order to comply with the Contract Documents and applicable federal, state and local laws, the Contractor may substitute such other procedures, as may be approved by the County and the City in writing, in order to accomplish the purpose and intent of this Agreement. Monitoring 2.1 County shall maintain staff for the purpose of Monitoring compliance with the Agreement. Assigned individuals will be on the site daily to review the Contractor's progress relating to meeting its construction hiring objectives. The County shall maintain, and make readily available to the City, all records pertaining to employment by the Contractor and Subcontractors on the Project. 1a 7 3. Contact Enforcement 3.1 In conjunction with the requirements outlined in ' Section 01027 of the Project Manual entitled, "Applications for Payment,” Miami -Dade County will require the Contractor to submit monthly report itemizing, by trade, all New Hires performing work on the Project (including, but not limited to the trade, the time period the work was performed and the permanent residence) and identifying which New Hires were recruited from the County and OWD. Miami -Dade County may withhold payment if these reports are not submitted or if the contents of the submitted report reflect a consistent lack of compliance with the hiring goals, which will be mutually developed by the County and the Contractor, specifically taking into consideration the priorities outlined in the provisions of Section 1.1 of this Agreement. 4. Governing Law This agreement shall be governed by the laws of the State of Florida. 5. Conflicts of Interest; County and City Representative is Not Individually Liable No member, official, representative, or employee of - fhe County or the City, or the City Manager shall have any personal interest, direct or indirect, in any Work or service to be provided pursuant to this Agreement, nor shall any such member, official, representative or employee participate in any decision relating to this Agreement which affects his or her personal interests or the interests of any corporation, partnership or association in which he or she is directly or indirectly, interested. No member, official, representative or employee of the County or the City, or the City Manager shall be personally liable to the City or Miami -Dade County or any successor in interest in the event of any default or breach by the County, the City, or the City Manager or for any amount which may become due to the City or Miami -Dade County or its successors or on any obligation under the terms of this Agreement. 6. Notice. Entire Agreement. This agreement and its attachments constitute the sole and only agreement of the parties hereto and correctly sets forth the rights, duties and obligations of each to the other as of its date.
