Application No. 99-14. DISCUSSION The proposal has been reviewed for a change to the Future Land Use Map of the Miami Comprehensive Neighborhood Plan 1989-2000 from "Duplex Residential" to "Restricted Commercial". The subject property consists of a 0.84 acre parcel: Lots 27, 28, 29, 30 and 31 in Block 3 MIAMI SUBURBAN ACRES AMENDED SUBDIVISION (4 _ 73). Miami Comprehensive Neighborhood Plan (MCNP) Land Use Policy 1.6.1., established future land use categories according to the Future Land Use Plan Map and -the "Interpretation of the Future Land Use Plan Map". The subject property is currently designated "Duplex Residential"; and the same designation east, west and south; to the north, the area is designated "Restricted Commercial". The Duplex Residential land use category allows residential structure of up to two dwelling units each to a maximum density of 18 dwelling units per acre, subject to the detailed provisions of the applicable land development regulations and the maintenance of required levels of service. Other permissible land uses include community-based residential facilities (14 clients or less, not including drug, alcohol or correctional rehabilitation facilities); places of worship, child care centers and adult day care centers and primary and secondary schools are also permissible in suitable locations within this land use designation. The Restricted Commercial category accommodates commercial activities that generally serve the daily retailing and service needs of the public, typically requiring easy access by personal auto and often located along arterial or collector roadways. Residential uses equivalent to High Density Multifamily Residential, up to 150 dwelling units per acre, including hotels, are also permissible within this land use category. Commercial uses include general retailing, personal and professional services; real estate; banking and other financial services; restaurants; saloons and cafes; general entertainment facilities and private clubs and recreation facilities whose scale and land use impacts are similar in nature to those uses described above. Other permissible land uses include motels and hotels; community based residential facilities; offices; major sports and exhibition or entertainment facilities; places of worship and primary and secondary schools. Mixed - uses containing commercial, office and/or residential are also permissible within this land use designation. a4 ^ 02-247.1 The Planning and Zoning Department is recommending DENIAL of the application as presented based on the following findings: + It is found that the subject properties are under the saine ownership as the lots immediately adjacent to the north, facing Coral Way, designated Restricted Commercial. • It is found that there are several cases in that area of SW 22nd Terrace between SW 27h Avenue and SW 37" Avenue where the boundary line dividing the Restricted Commercial and the Duplex Residential has been changed due to approved land use change petitions. • It is found that this petition as presented, commercial traffic on 22°d Terrace is an intrusion into the residential neighborhood. • It is found that the requested change to "Restricted Commercial" will potentially have a massing effect that will be incompatible with the duplex residential scale of the neighborhood. • It is found tfiat a change such as the one proposed is in conflict with MCNP Land Use Policy 1.1.3. which requires that all areas of the City be protected from encroachment of incompatible land uses. + It is found that the requested change is also in conflict with MCNP Housing Policies 1.1.5. and 1.2.7. which require the City to preserve and enhance the general appearance and character of the City's neighborhood. These findings support the position that the existing land use pattern in this neighborhood should not be changed. It also should be stated, that whereas MCNP Land Use Policy 1.1.1. requires development or redevelopment, that results in an increase in density or intensity of land use, to be contingent upon availability of public facilities and services that meet or exceed the minimum LOS standards adopted in the Capital Improvement Element (CIE) (CIE Policy 1.2.3.). It is found that the attached Concurrency Management Analysis pertaining to concurrency demonstrates that no levels of service would be reduced below minimum levels. 2 02-24'7.1 NOTES 1. Potable water and wastewater transmission capacities are in accordance with Metro -Dade County stated capacities and are assumed correct. Service connections to water and sewer mains are assumed to be of adequate size: if not, new connections are to be Installed at owner's expense. Recreation/Open Space acreage requirements are assumed with proposed change made. When the area of Coral Way was developed, parking requirements were not in effect to serve mostly the commercial development within the corridor, as such the lots facing Coral Way were not very deep since they did not need to accommodate parking. As the current zoning and development requirements at the City changed, the existing lots facing Coral Way do not have the sufficient depth to accommodate today's parking requirements. The current R-2 zoning of the lots facing 22' Terrace that are connected to properties in Coral Way does not allow for surface parking or parking structures to support the redevelopment of the properties facing Coral Way at today's standards. 11. A more liberal district that allows flexibility in accommodating this redevelopment would be desirable and more efficient for the lots adjacent to Coral Way on the north side of SW 22n° Terrace. This would give the Coral Way properties sufficient depth to accommodate the redevelopment of the commercial properties using today's requirements for parking. Further the properties adjacent to the commercial properties and facing 22" d Terrace have lost their residential characteristics. There is a redevelopment trend within the Coral Way Corridor mostly for infill development of commercial and mid rise residential uses.
