Dear Rita:
Confirming our telephone conversation yesterday, attached is a slightly revised version
of the previously submitted 1`1. solution.
The phrase "that permit increased density" has been added in each of the first two
paragraphs on the second page.
This specificity was inspired from a discussion with Ana Gelabert Sanchez.
Carlos Gimenez had advised that copies of this Resolution would be included in the
packages for each commissioner for the January 2411, meeting. We will appreciate your
arranging for the replacement of the previous Resolution copy with the attached revised
version.

HOMEOWNERS RESOLUTION
ASSOCIATION
The following Resolution has been duly adopted by the Brickell Home-
owners Association on Wednesday, November 14, 2001.

residential guarding Bri concerns. WHEREAS, for purposes hereof, the Brickell Area is defined as
that area bounded on the North by the South bank of the Miami River, on
the West by I-95, on the East by Biscayne Bay and on the South by S.E and
S.W. 261 Road; and
WHEREAS, traffic congestion has become intolerable in the Brick -
ell Area; and.
WHEREAS, the continued growth of development in the Brickell
Area is assured by the increased demand for housing, commercial facilities
and office space; and
WHEREAS, the viability of the Brickell area as a residential and
commercial community is severely threatened by existing traffic congestion
and future gridlock; and
WHEREAS, the present zoning laws for the Brickell Area, includ-
ing bonus Floor to Area Ratios (FAR) were enacted almost twenty (20)
years ago as an incentive to the development of the Brickell Area, which,
but for Brickell Avenue, was under -developed and/or contained poorly
maintained and/or abandoned older properties; and
WHEREAS, the need for incentive or bonus FAR s is no longer
necessary to induce development within the Brickell Area; and
WHEREAS, existing laws, rules and regulations and the manage-
ment of construction projects on the public streets are inadequate to protect

staff studies of existing zoning laws, rules and regulations governing development of the Brickell Area,
so as to eliminate all FAR and other incentive bonuses that permit increased density for all future devel-
opment; and -
THAT the City Commission and Mayor of Miami present and adopt the necessary amendments
to the Zoning Code of the City of Miami to eliminate all FAR and other bonuses that permit increased
density and adopt new laws which will limit the use of all new properties within the BrickeIl Area to a
density and use commensurate with the ability of the existing infrastructure to support same; and
THAT the City Staff, including Planning and Zoning Department, Building Department and
Public Works Department personnel, impose new rules and regulations on all developers and contractors
working on utility projects and paving improvements so that during the course of the construction of
each project, the use the public streets and sidewalks is not abused to the point that the rights of the
residents of the City to the use of the public streets and sidewalks is not adversely impacted, and further
that when and if a developer or contractor must make use of the public streets and sidewalks in the
temporary furtherance of a project, that the adverse impact of same be kept to an absolute minimum, is
done during such times of the day, night and/or weekends, so that said adverse impact is minimal and
that throughout the course of the project, adequate traffic control personnel, whether off duty law offic-
ers or flag men, are on duty to assure the orderly flow of traffic; and
THAT the City Elected Offici° is and Staff take such other and further steps as their professional-
ism and expertise may suggest to address the problems set forth above.

The City of.Mlami will be conducting a town hall meeting in connection
with quality of life issues associated with density and construction in the
Brickeh area. The meeting will be held an Monday, February 251h, 2002,
i from 11:00 a.m,-1:00 p.m. at the First Presbyterian Church of Miami locat-
ad on 809 Brickell Avenue, Miami, Florida.
