A RESOLUTION OF THE MIAMI CITY COMMISSION BY A FOUR-FIFTHS (4/5T11) AFFIRMATIVE VOTE, RATIFYING, APPROVING AND CONFIRMING THE CITY MANAGER'S FINDING OF AN EMERGENCY, ND AUTHORIZING AN INCREASE IN THE CONTRACT WITH TURNKEY CONSTRUCTION, INC., IN AN AMOUNT NOT TO EXCEED $95,251, FROM $258,000 TO $353,251, FOR THE MIAMI HIGH SCHOOL BUNGALOW RELOCATION AND STABILIZATION PROJECT, B-3290; AMENDING RESOLUTION NO. 03-556, ADOPTED MAY 22, 2003, TO REFLECT SAID INCREASE; ALLOCATING FUNDS FROM CAPITAL IMPROVEMENTS PROJECT NO. 327001 FOR SAID INCREASE; FURTHER AUTHORIZING THE CITY MANAGER TO EXECUTE THE NECESSARY DOCUMENTS, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, FOR SAID PURPOSE. BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. By a four-fifths (4/5ths) affirmative vote, the City Manager's finding of an emergency and authorizing an increase in the contract with Turnkey Construction, Inc., approved by Resolution No. 03-556, adopted May 22, 2003, in an amount not to exceed $95,251, from $258,000 to $353,251,is ratified, approved and confirmed, with funds allocated from Capital Improvements Project No. 327001 for said increase. The City Manager is authorized!' to execute the necessary documents, in a form acceptable to the City Attorney, for said purpose. Section 4. If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission. Page 2 of 2 93- 965 CITY OF MIAMI, FLORIDA INTER -OFFICE MEMORANDUM TO: a HonoraMayo & Mem rs of he a�( I ion � J e rriola, City anager FROM: 2003 DATE: SEP - 2 FILE SUBJECT: Resolution - Contract Increase — Miami High School Bungalow REFERENCES: Relocation & Stabilization Project, B-3290 ENCLOSURES: RECOMMENDATION It is respectfully recommended that the City Commission adopt the attached Resolution authorizing an increase in the construction contract between the City of Miami and Turnkey Construction Inc., a non -minority firm located at 14411 South Dixie Highway, Miami, Florida in the amount of $95,251. The increase in contract will be used to stabilize and partially restore the structure. The existing construction amount will increase from $258,000 to $353,251. BACKGROUND The original Miami High School Bungalow building was located on a developer's site in the Brickell area and the City Commission agreed to save and restore the building. The Commission appropriated $250,000 Homeland Defense/Neighborhood Improvement Bond funds for the project by Resolution No. 02-1116 and approved hiring R.J. Heisenbottle Architects to effectuate the relocation, restoration and rehabilitation of the building. They also authorized the acceptance of a $76,351 donation from the Dade Heritage Trust by Resolution No. 02-1180. The Commission later amended CIP Ordinance No 12280 to provided additional funding of $100,000 for the restoration of the bungalow building. The City Manager approved two (2) Emergency Findings. The first was for the architect's agreement and fee in the amount of $67,500 and the second for expediting the building relocation and authorizing informal bidding procedures under Section 18-84 of the City Code. After receiving informal competitive bids, the City Manager approved a revision to the Emergency Finding to award a construction contract to the low bidder, Turnkey Construction Inc., in the amount of $258,000. The City Commission ratified and approved the City Manager's actions by Resolution No. 03-556 at their 5/22/03 meeting. Dade Heritage Trust made their contribution to the project and now it is necessary to increase the construction contract to cover the cost of reconstructing the front porch, installing wood shingles, and installing new floor joists and related structure to strengthen the floor. This additional work was part of the original bid as additive alternate items to be done later as funding became available. The amount of $95,251 for construction is available under CIP Project No. 327001.
