AUTHORIZING THE CITY MANAGER TO ACCEPT TWO
SEPARATE DONATIONS OF VARIOUS TREES, PALMS,

PLANTED ON WATSON ISLAND AT NO COST TO THE
CITY FOR USE AT THE PARROT JUNGLE AND GARDENS
OF WATSON ISLAND BOTANICAL GARDEN ATTRACTION,
FROM ELAINE SPEAR AND HER CHILDREN, M. GLENN

COMAS, WITH A COMBINED VALUE OF APPROXIMATELY
$504,615; AUTHORIZING THE CITY MANAGER TO
EXECUTE THE NECESSARY DOCUMENTS, IN A FORM
ACCEPTABLE TO THE CITY ATTORNEY, FOR SAID
PURPOSE.
WHEREAS, Elaine Spear and her children, M. Glenn Spear and
Laurie A. Spear, in memory of Simeon D. Spear, wish to donate a
variety of trees, palms, and shrubs to the City of Miami ("City")
to be relocated and planted on Watson Island at no cost to the
City, having an appraised value of approximately $484,615; and
WHEREAS, Michael Alan Fine Architecture, P.A. located at
Gables 1 Tower, 1320 S. Dixie Highway, Suite 902, Coral Gables,
Florida, also wishes to make a donation on behalf of Lucia M.
Comas of 201 West San Marino Island, Miami Beach, Florida, that
includes a mixed variety of landscaping materials that

incorporates, trees, palms, shrubs, and ground cover, having an
approximate value of $20,000 to the City to be relocated and
planted on Watson Island at no cost to the City; and
WHEREAS, the landscape material is intended for future use
at the Parrot Jungle & Gardens of Watson Island botanical garden
attraction;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are adopted by reference and
incorporated as if fully set forth in this Section.
Section 2. The City Manager is authorized!' to accept
two separate donations of various trees, palms, shrubs, and
ground cover to be relocated and planted on Watson Island at no
cost to the City for use at the Parrot Jungle and Gardens of
Watson Island botanical garden attraction from Elaine Spear and
her children, M. Glenn Spear and Laurie A. Spear, and the second
donation from Michael Alan Fine Architecture, P.A., on behalf of
Lucia M. Comas of 201 West San Marino Island, Miami Beach,
Florida, with a combined value of approximately $504,615.
1� The herein authorization is further subject to compliance with
all requirements that may be imposed by the City Attorney,
including but not limited to those prescribed by applicable
provisions of the City Charter and Code.

Section 3. The City Manager is authorized!/ to execute
the necessary documents, in a form acceptable to the City
Attorney, for said purpose.
Section 4. This Resolution shall become effective
immediately upon its adoption and signature of the Mayor./

Resolution No. 03-953, adopted September 11, 2003, contained a scrivener's error in
the name and spelling of those donating landscaping materials for use at The Parrot Jungle
and Gardens of Watson Island Botanical Garden Attraction. On October 20, 2003 you
received a memorandum with the corrected names and spelling to indicate one of the two
donors names to be Michael Alan Fine Architecture, P.A., on behalf of Lucia M. Comas of
201 West San Marino Island, Miami Beach, Florida.
Review of the backup material has revealed that the donation amounts in the resolution
have been reversed and that the name of the other donor was incorrect.
Attached is a substitute original resolution to replace the document you presently
possess as Resolution No. 03-953, which has been corrected to reflect the proper information,
spelling and amount of the contributions.
After the correct document has been executed, please forward a copy to this Office.
This memorandum may be attached to Resolution No. 03-953 so that any concern regarding
the substitution of said Resolution is clarified.

RECOMMENDATION
The administration recommends that the Miami City Commission adopt the attached Resolution
authorizing the City Manager to accept the donation of various landscape material made from
Elaine Spear and her children M. Glenn Spear and Lourie N. Spear in memory of Simeon D.
Spear and a second donation from Michael Fein, of Michael A. Fein P.A. Architecture, with an
approximate combined total value of $503,390 to be relocated and planted on Watson Island at
no cost to the City for use at the Parrot Jungle and Gardens of Watson Island Botanical Garden
attraction.
BACKGROUND
The City of Miami entered into a Lease and Development Agreement on September 2, 1997, as
amended, for the development of a botanical garden attraction and related uses on 18.6134 acres
of City owned waterfront property.
At this time Elaine P. Spear and her children M. Glenn Spear and Lourie N. Spear desire to
donate a variety of landscaping material in memory of Simeon D. Spear who recently passed
away; see Attachment `A' for species, size, and quantity of the intended donation. Although the
donation has not been formally appraised, it is estimated that the value of the donated material is
$20,000. The donation includes approximately 11 palm trees, 3 shade trees and approximately
28 shrubs of landscaping material, intended for future use at Parrot Jungle and Gardens to be
relocated and planted on Watson Island at no cost to the City.
A second donation is being made by Michael Fein from Michael A. Fein P.A. Architecture
located at Gables 1 Tower, 1320 S. Dixie Highway, Suite 902, Coral Gables, Florida 33146.
This donation of approximately 3,220 species, includes a mixed variety of landscaping material
for trees, palms, shrubs, and ground covers, and has an appraised value of $483,390; see
Attachment `B' for species, sizes, quantities, and value. This donation is intended for future use
at Parrot Jungle and Garden and will be relocated and planted on Watson Island at no cost to the
City.

and Gardens leased parcel.
