RESOLUTION NO. 03- 9 16
A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH
ATTACHMENT(S), MAKING PROVISIONS FOR HOLDING A
SPECIAL MUNICIPAL ELECTION ON NOVEMBER 4, 2003,
FOR THE PURPOSE OF SUBMITTING TO THE ELECTORATE
AT SAID ELECTION THE FOLLOWING REFERENDUM
BALLOT QUESTION, TO BE KNOWN AS BALLOT QUESTION
NO. 1: "DO YOU ENDORSE A CONTINUING PARKING
SURCHARGE, TO BE COLLECTED BEGINNING OCTOBER 1,
2004, OF FIFTEEN PERCENT CHARGED PER VEHICLE
FOR THE SALE, LEASE, OR RENTAL OF SPACE AT
PUBLIC PARKING FACILITIES IN MIAMI, EXCEPT AT
CERTAIN COUNTY FACILITIES, AIRPORTS, AND
SEAPORTS, IF THE PROCEEDS MAY BE USED FOR SUCH
PURPOSES AS THE REDUCTION OF FEES AND AD
VALOREM TAXES, AND ARE REQUIRED TO BE USED FOR
TRANSPORTATION IMPROVEMENTS IN DOWNTOWN OR

BOOKS AND RECORDS MAINTAINED UNDER THE
PROVISIONS OF THE GENERAL LAWS OF FLORIDA AND
CHAPTER 16 OF THE CODE OF THE CITY OF MIAMI,
FLORIDA, AS AMENDED, WHICH THE CITY HAS ADOPTED
AND DESIRES TO USE FOR HOLDING SUCH SPECIAL
MUNICIPAL ELECTION; DESIGNATING AND APPOINTING
THE CITY CLERK AS THE OFFICIAL REPRESENTATIVE
OF THE CITY COMMISSION WITH RESPECT TO THE USE
OF SUCH REGISTRATION BOOKS AND RECORDS;
AUTHORIZING AND DIRECTING THE CITY CLERK TO
PUBLISH NOTICE OF THE ADOPTION OF THIS
RESOLUTION AND THE PROVISIONS THEREOF PURSUANT
TO APPLICABLE LAW; AND DIRECTING THE CITY CLERK
TO CAUSE A CERTIFIED COPY OF THE HEREIN
RESOLUTION TO BE DELIVERED TO THE SUPERVISOR OF
ELECTIONS OF MIAMI-DADE COUNTY, FLORIDA,
PURSUANT TO APPLICABLE LAW.
BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:

Section 1. A special municipal election is called and
directed to be held in the City of Miami, Florida, on Tuesday,
November 4, 2003, from 7:00 A.M. until 7:00 P.M., for the purpose
of submitting the following question to the qualified electors of
the City of Miami for their approval or disapproval:
"DO YOU ENDORSE A CONTINUING PARKING
SURCHARGE, TO BE COLLECTED BEGINNING
OCTOBER 1, 2004, OF FIFTEEN PERCENT CHARGED
PER VEHICLE FOR THE SALE, LEASE, OR RENTAL
OF SPACE AT PUBLIC PARKING FACILITIES IN
MIAMI, EXCEPT AT CERTAIN COUNTY FACILITIES,
AIRPORTS, AND SEAPORTS, IF THE PROCEEDS MAY
BE USED FOR SUCH PURPOSES AS THE REDUCTION
OF FEES AND AD VALOREM TAXES, AND ARE
REQUIRED TO BE USED FOR TRANSPORTATION
IMPROVEMENTS IN DOWNTOWN OR URBAN CORE
AREAS?"
Section 2. The election shall be held at the voting
places in the precincts designated on Exhibit No. 1, attached and
incorporated, or as may be designated by the Supervisor of
Elections of Miami -Dade County, in conformity with the provisions
of the general laws of the State. A description of the
registration books and records which pertain to election
precincts wholly or partly within the City and which the City is
adopting and desires to use for holding such elections is as
follows: all registration cards, books, records and certificates
pertaining to electors of the City and established and maintained

as official by the Supervisor of Elections of Miami -Dade County,
in conformity with the provisions of the general laws of the
State, are adopted and declared to be, and shall hereafter be
recognized and accepted as, official registration cards, books,
records and certificates of the City of Miami.
Section 3. The Precinct Election Clerks and Inspectors
to serve at said polling places on said election date shall be
designated by the Supervisor of Elections of Miami -Dade County,
Florida, for such purposes in accordance with the general laws of
the State. The registration books and records for the
registration of persons qualified to vote in said elections shall
be those maintained by the Supervisor of Elections of Miami -Dade
County.
Section 4. For the purpose of enabling persons to
register who are qualified to vote in said special municipal
election to be held on November 4, 2003, and who have not
registered under the provisions of the general laws of Florida
and Chapter 16 of the Code of the City of Miami, Florida, as

amended, or who have transferred their legal residence from one
voting precinct to another voting precinct in the City, they may
register at the following place and times:
MIAMI-DADE COUNTY
ELECTIONS DEPARTMENT
111 Northwest 1st Street, Miami, Florida
Monday to Friday, inclusive: 8:00 A.M. - 5:00 P.M.
In addition to the above place and times, qualified persons
may register at such branch offices and may also use any mobile
registration van for the purpose of registration to vote in the
herein described election during such times and on such dates as
may be designated by the Supervisor of Elections of Miami -Dade
County.
Section 5. In compliance with applicable law, the City
Clerk is authorized and directed to publish notice of the
adoption of the herein Resolution and of the provisions hereof,
which notice shall be substantially as set forth in the following
form:

PURSUANT TO RESOLUTION NO. 03-
A special election will be held on Tuesday,
November 4, 2003, from 7:00 A.M. until 7:00 P.M., in
the City of Miami, Florida, at the polling places in
the several election precincts designated by the Board
of County Commissioners of Miami -Dade County, Florida,
as set forth herein, unless otherwise provided by law,
for the purpose of submitting to the qualified electors
of the City of Miami, Florida, the following ballot
question, known as Ballot Question No. l:
"Do you endorse a continuing parking
surcharge, to be collected beginning
October 1, 2004, of fifteen percent charged
per vehicle for the sale, lease, or rental
of space at public parking facilities in
Miami, except at certain county facilities,
airports, and seaports, if the proceeds may
be used for such purposes as the reduction
of fees and ad valorem taxes, and are
required to be used for transportation
improvements in downtown or urban core
areas?"
Ballot Question No. 1 polls the electors of the
City of Miami as to whether the citizens endorse a
continuing parking surcharge, to be collected beginning
October 1, 2004, equal to fifteen percent of the charge
per vehicle for the sale, lease, or rental of space at
public parking facilities in Miami, except at certain
county facilities, airports, and seaports, if the
proceeds may be used for such purposes as the reduction
of fees and ad valorem taxes, and are required to be
used for transportation improvements in downtown or
urban core areas.

Section 6. The official ballot to be used in said
election shall be in full compliance with the laws of the State
of Florida with respect to absentee ballots and to the use of the
mechanical voting machines or Computer Election System (CES) and
shall be in substantially the following form, to wit:

Section 7. Electors desiring to vote for approval
of Ballot Question No. 1 described above, shall be instructed to
vote their selection on the iVotronic Voting Process Equipment
next to the word "YES" within the ballot frame containing the
statement relating to the Question. Electors desiring to vote to
disapprove Ballot Question No. 1, shall be instructed to vote
their selection on the iVotronic Voting Process Equipment next to
the word "NO" within the ballot frame containing the statement
relating to the Question. Once individuals are satisfied with
their choice, they shall press the "Vote" button on the iVotronic
Voting Process Equipment and the ballot shall be cast.
Section 8. PRISCILLA A. THOMPSON, the City Clerk of the
City of Miami, Florida, or her duly appointed successor, is
designated and appointed as the official representative of the
Commission of the City of Miami, Florida, in all transactions
with the Supervisor of Elections of Miami -Dade County in relation
to matters pertaining to the use of the registration books for
the holding of the herein special municipal election.
Section 9. The City Clerk shall cause to be prepared
absentee ballots for the use of absentee electors entitled to
cast such ballots in said election.

Section 10. All qualified electors of said City shall be
permitted to vote in said special municipal election and the
Supervisor of Elections of Miami -Dade County is requested,
authorized, and directed to furnish, at the cost and expense of
the City of Miami, a list of all qualified electors residing in
the City of Miami as shown by the registration books and records
of the Office of said Supervisor of Elections and duly certify
the same for delivery to and for use by the election officials
designated to serve at the respective polling places in said
election precincts.
Section 11. The City Clerk is authorized and directed to
cause a certified copy of this Resolution to be delivered to the
Supervisor of Elections of Miami -Dade County pursuant to
applicable law.
Section 12. This Resolution shall become effective
immediately upon its adoption and signature of the Mayor.'/
lj If the Mayor does not sign this Resolution, it shall become effective at
the end of ten calendar days from the date it was passed and adopted.
If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.

RE: Special City Commission Meeting - September 5, 2003
Proposed Referendum — Parking Surcharge
During the 2003 Legislative Session, §166.271, Fla. Stat. was enacted to require, by
referendum approval of the voters in the City of Miami, whether a municipal facility
parking fee surcharge may be imposed on a vehicle utilizing space at public parking
facilities. The Statute in its entirety is attached.
Draft alternative questions will be distributed and are intended to provide a basis for
City Commission discussion regarding the language to be presented to the voters in Miami.
When the City Commission approves the final language, a resolution including the question
will place the question before the voters at the November 4, 2003 election.

Committee Substitute for Senate Bill No. 1842
An act relating to municipal parking facility space surcharges; creat-
ing s. 166.271, F.S.; authorizing certain municipalities to impose
and collect a surcharge on certain parking facility space sale, lease,
or rental charges; requiring referendum approval; providing for a
maximum surcharge rate; providing an exception; providing a limi-
tation; specifying uses and limits of surcharge proceeds; providing
for local administration of the surcharge; providing an effective date.
Be It Enacted by the Legislature of the State of Florida:
Section 1. Section 166.271, Florida Statutes, is created to read:
166.271 Surcharge on municipal facility parking fees.—

These are three possible versions of the Parking Surcharge questions which are intended to provide the
basis for your discussion regarding the referendum question.
PROPOSED ALTERNATIVE QUESTIONS:
IMPOSITION OF A MUNICIPAL FACILITYPARKING FEE SURCHARGE ON A
VEHICLE UTILIZING SPACE AT PUBLIC PARKING FACILITIES
1. Do you endorse a continuing parking surcharge, to be collected beginning October 1, 2004,
equal to fifteen percent of the charge per vehicle for the sale, lease, or rental of space at
public parking facilities in Miami, if the proceeds may be used for such purposes as the
reduction of fees and ad valorem taxes, and are required to be used for transportation
improvements in downtown or urban core areas?. (71 words)
or
2. Shall the City of Miami apply a per -vehicle surcharge, to be collected beginning October 1,
2004, of fifteen percent of the amount charged for the sale, lease, or rental of space at
parking facilities in Miami and open to the public for purposes that include, but are not
limited to, the reduction of fees and ad valorem taxes, and transportation improvements in
downtown or urban core areas, as directed by law?. (72 words)
Or
3. It is proposed that commencing on October 1, 2004, a 15% surcharge be imposed by City
ordinance on the amount charged per vehicle for the sale, lease or rental of space at general
public parking facilities within the City, except at airports, seaports, certain county
facilities. Surcharge proceeds shall be used to improve transportation in City downtown or
urban core areas, and as expressly authorized by law. Shall this parking surcharge be
adopted? (73 words)
