A RESOLUTION OF THE MIAMI CITY COMMISSION,
WITH ATTACHMENT(S), CLOSING, VACATING,
ABANDONING AND DISCONTINUING FOR PUBLIC USE
THAT PORTION OF A PUBLIC RIGHT-OF-WAY, BEING
THE PORTION OF APPROXIMATELY SOUTHWEST
52nd COURT LOCATED AT THE NORTHWEST CORNER OF
THE INTERSECTION OF SOUTHWEST 8th STREET AND
SOUTHWEST 52nd COURT, MIAMI, FLORIDA, LEGALLY
DESCRIBED IN ATTACHED "EXHIBIT A."
WHEREAS, the Miami Zoning Board at its meeting of June 16,
2003, Item No. 2, duly adopted Resolution No. ZB 2003-0730 by a
nine to zero (9-0) vote, RECOMMENDING APPROVAL of closing,
vacating, abandoning, and discontinuing a portion of the public
right-of-way as set forth herein; and
WHEREAS, the Department of Public Works and the Plat and
Street Committee have studied the subject vacation and closure
and determined that it will not affect pedestrian or vehicular
traffic circulation or access for public service; and
WHEREAS, the Plat and Street Committee has reviewed the
subject tentative plat and determined that all technical

requirements have been met, and found the vacation and closure
of the subject right-of-way would benefit the general public and
therefore recommended approval; and
WHEREAS, the City Commission, finds that it is in the best
interest of the general welfare of the City of Miami and its
inhabitants to grant the vacation and closure of a portion of
the public right-of-way as hereinafter described, and deems it
advisable to do so;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are adopted by reference and
incorporated as if fully set forth in this Section.
Section 2. A portion of a public right-of-way, being
the portion of approximately Southwest 52nd Court located at the
Northwest corner of the intersection of Southwest 8th Street and
Southwest 52nd Court, Miami, Florida, as legally described in
attached "Exhibit A," is closed, vacated, abandoned and
discontinued for public use.

Section 3. This Resolution shall become effective
immediately upon its adoption and signature of the Mayor'/

PLAT AND STREET COMMITTEE ANALYSIS FOR CLOSURE
AND VACATION OF A PORTION OF SW 52 COURT LOCATED
AT THE NORTHWEST CORNER OF THE INTERSECTION OF
SW 8 STREET AND SW 52 COURT
On February 6, 2003, the Plat and Street Committee reviewed the tentative plat
of "Hazelton Park First Addition" and determined that all technical requirements
contained in the Miami City Code Subdivision Regulations have been met and
has approved the tentative plat. The members of the Plat and Street Committee
have further considered the request for vacation and closure of this roadway with
respect to Miami City Code requirements and have voted unanimously in favor of
this roadway vacation and closure request.

Your tentative plat entitled HAZELTON PARK FIRST ADDITION is now being processed. As
stated in our February 7, 2003 letter, State and City laws require that the owner(s) of land
being platted or replatted enter into an agreement with the City to construct certain
improvements. To insure that these subdivision improvements are constructed, a
performance bond, letter of credit or cashier's check will be required guaranteeing the
completion of these improvements within one year from the acceptance of the new plat
by the City Commission. The amount of bond, letter of credit or cashier's check is based
upon the estimated cost of the improvements listed below:

You and your engineer should confer with the Department of Public Works to discuss the
proposed improvements. Your engineer will be required to prepare and seal complete
construction plans for these improvements. The plans must be submitted to the
Department of Public Works for review and approval prior to the issuance of any permits.
Reasonable time must be allocated for the proper review of the construction plans by
City personnel. A reproducible mylar of the approved plans (maximum size 24" x 36") shall
be submitted to the Department of Public Works prior to the Issuance of any building or
construction permits on the property being platted.
Construction of the subdivision improvements shall not commence until your contractor
has obtained the required permits. A line & grade permit fee must be paid by your
contractor if new sidewalk and/or curb and gutter is to be constructed. An excavation
permit fee must be paid by you* contractor if new drainage structures are to be installed.
Any construction on a state road including relocation of utility or light poles will also
require a permit from the Florida Department of Transportation. Also, your surveyor will
be responsible for the layout and final measurements of the subdivision improvements.
A copy of the "as -built" survey shall be submitted to the Highway Section for approval
prior to the release of the subdivision improvement bond.
The landscaping estimate, when included, is based on full coverage of solid sod and
planting of specified trees. The owner(s) will be required to guarantee the landscaping
for one year after the subdivision improvements have been accepted by the Department
of Public Works.
Water service requirements are not included in the improvements listed above. For
information concerning water mains and appurtenances, contact Miami -Dade Water &
Sewer Department at 305-665-7471.
When the final plat has been prepared by your surveyor, It is to be submitted to the
Department of Public Works (Survey Section) for checking and processing. The following
items are to accompany the linen or mylar tracing of the final plat and are to be received
by our Survey section no later than six (6) weeks prior to the Commission meeting at
which your plat is scheduled for City Commission approval.
1. Final plat original (inked).
2. Three (3) prints of final plat.
3. $350.00 check for platting fee.
4. Paid tax receipts for property being platted.
5. Approval letters from utility companies concerning easements and services.
6. Letter of Credit, Performance Bond or Cashier's Check for amount of subdivision
.improvements. (Forms provided by Public Works).
7. Executed agreement, in triplicate, between owner(s) and City for subdivision
improvements. (Forms provided by Public Works).

The City of Miami Plat and Street Committee, at its meeting of February 6, 2003, approved
the above tentative plat subject to the following revisions being made to the tentative
plat, additional information being provided and/or variances being granted. Please be
advised that the processing of your tentative plat cannot proceed until these conditions
have been satisfied.
In addition to the above requirements, you should be aware of the following:
in the location sketch:
a. Provide a sectional/fractional legal description.
b. Verify the section numbers.
C. Show the City of Miami limit line. This also applies to the main sketch.
2. Provide a bearing for the monument line of SW 52 Court.
3. Provide a distance along the monument line and the centerline of each adjacent
street.
4. Provide the owners address on the tentative plat.
5. Define the zoning designation and reference it as according to the City of Miami
Zoning Ordinance 11000, as amended.
6. A plat approval letter from the F.D.O.T. is required at the time of final plat submittal.
A copy of the final plat must be submitted to the F.D.O.T., not a copy of the tentative
plat.
7. Change the statement "the express purpose...." to 'an expresse d purpose....".
8. An opinion of title as to the reversionary rights for the right-of-way to be closed and
vacated will be required by the Zoning Board. The opinion of title must also address
whether or not there are individuals, in addition to the abutting property owners,
having an interest in the right-of-way to be closed and vacated. A copy of the opinion
of title must be provided to the Public Works Department.

9. A sketch and legal description, with a square footage for the proposed closure, will be
required by the Zoning Board. Contact Teresita Fernandez, Chief of the Hearing
Boards, at 305-416-2030. Provide a copy to the Department of Public Works on 81/z"x
11- paper.
10. Label Lot 10, Block 1 of PB 21, PG 75, in the main sketch.
11. Show the square footage for the proposed lot In the main sketch.
12. Remove the chain linked fence encroachment into the alley before the time of final
plat submittal.
13. State what kind of residential building is the proposed building to be and the number
of units.
14. The notary acknowledgment portion of the application for tentative plat approval
must be completed.
15. Be advised that current backup documentation will be required for all who execute
the final plat. A resolution for authority to execute documents and a Certificate of
Good Standing from the Secretary of State is required, if applicable.
16. En!arge the Zoning designation in the location sketch.
17. The Plat And Street Committee has reviewed the tentative plat of 'Hazelton Park First
Addition* and determined that all technical requirements contained In the Miami City
Code Subdivision Regulations have been met and has approved the tentative plat.
The members of the Plat and Street Committee have further considered the request
for vacation and closure of this roadway with respect to Miami City Code
requirements and have voted 4 in favor and 0 in denial of this vacation and closure
request.
In addition to the above requirements, you should be aware of the following:
1. state and local laws require the installation of various physical improvements in the
public rights-of-way when property is platted. These subdivision improvements
include paving, drainage, landscaping, sidewalks, etc. In some cases this could
represent a substantial investment on your part.
2. The alteration, relocation or installation of utilities such as storm and sanitary sewers,
electric, telephone, water, etc. caused by this plat will be at the property owners
expense. Also, utility easements may be required on the property being platted.
3. A building permit will not be issued on the property being platted until the final plat
Is recorded. Also, the Certificate of Occupancy for any building construction will be
issued only after all the required subdivision improvements have been completed.

4. Approval for fire flow requirements must be obtained from the Fire -Rescue
Department prior to the issuance of a building permit.
5. Additional items must be provided to the City of Miami Department of Public Works
before the final plat is submitted to the City Commission for approval. You -will be
notified in writing as to what these items are after the amount of the bond has been
determined for the necessary subdivision improvements.
6. Tentative plat approval is only valid for one (1) year from the date of the Plat and
Street Committee meeting at which time it was approved.
If you have any questions conceding these requirements, please refer to the attached
sheet for the appropriate person `to contact.

VACATION AND CLOSURE OF A PUBLIC RIGHT OF WAY, BEING THE
PORTION OF SW 52nd COURT LOCATED AT THE NW CORNER OF THE
INTERSECTION OF SW 8th STREET AND 52nd COURT.
Pursuant to Section 55-15 (c) of the Miami City Code, the Planning and Zoning Department
has reviewed the proposed right-of-way vacation to determine whether it is in the public
interest, or whether the general public would benefit from the vacation of the right-of-way.
The following findings have been made:
• It is found that the proposed right of way to be vacated is in the NW corner of SW 52nd
Court and SW 8d' Street.
• It is found that the vacation of the right of way is required to coincide lot with all
surrounding comer lot in the area with longstanding sidewalk and street curbs.
• It is found that the proposed vacation of the right of way is therefore in the public
interest.
Based on these findings, the Planning and Zoning Department recommends
approval of the request.

Please accept the following as my opinion of title for the property located at the northwest
corner of SW 8"' Street and SW 52nd Court, Miami, Florida 33134, more particularly described as:
HAZELTON PARK FIRST ADDITION, a replat of Lot 6, Block 5, HAZELTON PARK,
according to the plat thereof, as recorded in Plat Book 42, Page 52, of the Public Records
of Miami -Dade County, Florida (the "Property").
This opinion of title shall address the reversionary rights for the right-of-way portion of the
Property to be closed and vacated. The Florida Supreme Court has ruled that owners of lots abutting a
perimeter street in a plat shall take title to the entire width of a vacated street. Caples v. Taliaferro,
197 So.861, 867 (Fla. 1940). In addition, F.S. 177.085 provides that a conveyance of lots in a
subdivision abutting a right of way "shall carry the reversionary interest in the abutting street to the
centerline or other appropriate boundary." Since the original plat of HAZELTON PARK (Plat Book 42,
Page 52) reflects that SW 52nd Court is a perimeter street to said plat and the right-of-way portion of
the Property abuts Lot 6, Block 5, HAZELTON PARK, Plat Book 42, Page 52, it is my opinion that fee
simple ownership of the vacated right-of-way portion of the Property shall revert to the existing
titleholder, M.E.D. of Miami, LLC.
This opinion of title is provided to you in accordance with the conditions for replat approval
of the Property as set forth in that certain letter dated February 7, 2003 from the Albert A.
Dominguez, P.E., Chairman, Plat and Street Committee, City of Miami, Florida, to the applicant,
M.E.D. of Miami, LLC.
Lastly, per condition number 1-3 of Mr. Dominguez's letter, please be advised that a 68 -unit
