INC. FOR THE DEPARTMENT OF POLICE, AT A TOTAL COST NOT TO EXCEED $119,376; ALLOCATING FUNDS FROM THE LAW ENFORCEMENT TRUST FUND, PROJECT NUMBERS 690002 AND 690003, SUCH EXPENDITURES HAVING BEEN APPROVED BY THE CHIEF OF POLICE AS COMPLYING WITH THE UNITED STATES DEPARTMENT OF JUSTICE AND TREASURY, "GUIDE TO EQUITABLE SHARING." WHEREAS, the United States Department of Justice and Treasury "Guide to Equitable Sharing" authorizes the expenditure of forfeiture cash or proceeds for certain law enforcement purposes not considered normal operating expenses; and WHEREAS, the Free Trade Area of the Americas ("FTAA") Ministerial meeting will be held at the Intercontinental Hotel in Downtown Miami in November 2003; and CITY COISSION 1VIfi.E?'72NT,C; QF y (.; 11^n Resolution No. 03- 868 __ WHEREAS, the Department of Police must ensure the security of the perimeter of the site as approximately 20,000 to 30,000 demonstrators are expected; and WHEREAS, the Pro -Active Barricade System has been developed to meet and defeat the increase level of violence posed by demonstrators; and WHEREAS, the Chief Procurement Officer has adopted a finding that Premier Global Production Co. Inc., is the sole source provider of the Pro -Active Barricade System; and WHEREAS, the findings of the Chief Procurement Officer have been approved and adopted as the findings of the City Manager; and WHEREAS, the City Manager and the Chief Procurement Officer recommend that the requirements for competitive sealed bidding procedures be waived. and rental of the Pro -Active Barricade System, from Premier Global Production Co. Inc., sole source provider, be approved; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Page 2 of 4 03- 868 Section 2. By a four-fifths (4/5th,) affirmative vote, after an advertised public hearing, the City Manager's finding of sole source is ratified, approved and confirmed, requirements for competitive sealed bidding procedures are waived, and the rental of the Pro -Active Barricade System from Premier Global Production Co. Inc., sole source provider, for the Department of Police, is approved, at a total cost not to exceed $119,376, with funds allocated from the Law Enforcement Trust Fund, Project Numbers 690002 and 690003, such expenditures having been approved by the Chief of Police as complying with the United States Department of Justice and Treasury "Guide to Equitable Sharing." Section 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.1/ �i If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. Inc., a non- minority/non-local vendor located at 232 Space Park Drive South, Nashville, Tennessee 37211, at a total cost not to exceed $119,376.00. Funding is to be provided from the Law Enforcement Trust Fund, Project Numbers 690002 and 690003. BACKGROUND The Police Department will rent approximately 4,974 linear feet of barricade to include fifteen (15) gates from November 17 — 22, 2003, to include technical supervision for the setup and takedown, at a cost of $24.00 per linear foot. Governments and Police Departments are facing increasing levels of violence during world events. In preparation for the upcoming Free Trade Area of the Americas (FTAA) ministerial meeting to be held November 16 — 21, 2003, at the Intercontinental Hotel in Downtown Miami, the Police Department will be required to ensure the security of the perimeter. A large amount of demonstrators (20,000 to 30,000) are expected, to include a group who identify themselves as the "Anarchists" who may disrupt the event and portray a negative image of the City. The barricade fencing system will be erected around the perimeter of the site of the FTAA conference. The Pro -Active Barricades are designed to counteract human threats, which could materialize from protesters, anarchists, or terrorists. These threats may manifest in any of the following forms: critical mass, land based attacks by terrorists, chemical/biological terrorist attack, vehicle bomb and infrastructure attack (water or electrical supplies, police or fire stations, or other public buildings). *Should you have any questions, or require additional information regarding this item, please contact my office and I will have a Police Department representative provide you with needed information. 03- 868 The Honorable Mayor and Members of the City Commission Page 2 Sole Source Purchase; Pro -Active Barricade Fence System The key benefits of these barricades are that they cannot be pulled over, taken apart or thrown like other barricades. Their design makes scaling them nearly impossible. The barricade moat design allows for greater security, increasing in integrity as the crowd size increases. The construction of the Pro -Active Barricades panels prevents objects such as ball bearings, pucks, golf balls and marbles from passing through. The Director of the Purchasing Department has determined that Premier Global Production Co. Inc., is the sole source vendor of the Pro -Active Barricade fence system. The Department of Police requires the rental of the pro -Active Barricade fence system to ensure the safety and security at the site of the Free Trade Area of the Americas (FTAA) Ministerial meeting in downtown Miami In November, 2003. In preparation for the upcoming FTAA meeting, the z department will be required to ensure the security of the perimeter as a large amount of demonstrators is expected. The Pro -Active Barricades are designed to counteract human threats, as the barricades cannot be pulled over, taken apart, or thrown as can other barricades.
