WHEREAS, the Miami -Dade County Water and Sewer Department has requested it be granted a water easement on City -owned property leased to the Downtown Development Authority and subleased to the DDA Downtown Charter School to construct, install, operate, and maintain water and sewer facilities for the Downtown Charter School, with full rights of ingress and egress; and WHEREAS, this easement is necessary to regulate the installation and future operations of water and sewer facilities within the leased area; C N AIS CI'T'Y COYMSSiON OF - 2903 ites::'ution No. 03- �8514 NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorizedll to execute a Grant of Easement, in substantially the attached form, with Miami -Dade County ("County"), to grant the County the right to use approximately a 20 -foot wide water easement at City -owned property known as the DDA Downtown Charter School located at 405 Northwest 3rd Avenue, Miami, Florida, as more particularly described in "Exhibit A," attached and incorporated, to be used to construct, install, operated and maintain water and sewer facilities for the DDA Downtown Charter School, subject to the DDA executing a joinder to this Grant of Easement. Section 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.V 1� The herein authorization is further subject to compliance with all requirements that may be imposed buy the city Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. ai If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. REFERENCES: City Commission Agenda July 24, 2003 ENCLOSURES: The administration recommends that the City Commission adopt the attached Resolution authorizing the City Manager to execute a Water Easement, in substantially the attached form, with Miami -Dade County ("Grantee"), for the purpose of granting Grantee the right to use approximately 20 -feet, at the DDA Downtown Charter School located at 405 Northwest 3`d Avenue, Miami, Florida, as more particularly described in Exhibit "A" attached hereto and made a part hereof to construct, install, operate and maintain water and sewer facilities for the DDA. Downtown Charter School, subject to the Downtown Development Authority, a Florida body corporate, under the authority of Laws of Florida, ch. 65-1090, executing a joinder to this Water Easement. BACKGROUND: The Miami -Dade County Water and Sewer Department has requested the City to grant a water easement on a portion of the DDA Downtown Charter School property to be used in connection with the construction and maintenance of water and sewer facilities. This easement will be used in connection with any project in the interest of the operation of water and sewers for the DDA Downtown Charter School, with full right of ingress thereto and egress therefrom. The City of Miami greatly benefits from the construction of this water and sewer facility because it will serve City residents, and the DDA Downtown Charter School. Financial impact: There is no financial impact to the City.
