RESOLUTION NO. 03— 850
A RESOLUTION OF THE MIAMI CITY COMMISSION,
WITH ATTACHMENT(S), EXPRESSING ITS INTENT TO
GRANT FLORIDA POWER AND LIGHT COMPANY
("FP&L") A FIFTEEN (15) FOOT STRIP PERPETUAL,
NON-EXCLUSIVE EASEMENT ON THE PROPERTY
LOCATED AT APPROXIMATELY 1050 MACARTHUR
CAUSEWAY, MIAMI, FLORIDA, AT SUBSTANTIALLY
THE LOCATION DEPICTED IN "EXHIBIT A,"
ATTACHED AND INCORPORATED, FOR THE
CONSTRUCTION, OPERATION AND MAINTENANCE OF
UNDERGROUND ELECTRIC UTILITY FACILITIES, WITH
THE RIGHT TO RECONSTRUCT, IMPROVE, CHANGE THE
VOLTAGE, AND REMOVE SUCH FACILITIES OR ANY OF
THEM WITHIN THE EASEMENT, WITH SAID EASEMENT
TO BE PROVIDED FOR THE OVERHEAD TO
UNDERGROUND CONVERSION OF ELECTRICAL
DISTRIBUTION FACILITIES THAT EFFECT THE
OPERATION OF THE AVIATION AND VISITORS CENTER
ON WATSON ISLAND; DIRECTING THE CITY MANAGER
TO PRESENT A GRANT OF EASEMENT, IN A FORM
ACCEPTABLE TO THE CITY ATTORNEY, TO THE CITY
COMMISSION ONCE THE EXACT SPECIFICS OF THE
EASEMENT HAVE BEEN DETERMINED.
WHEREAS, it is necessary to relocate and convert to
underground, the overhead distribution facilities that affect the
operation of the Aviation and Visitors Center on Watson Island;
and
WHEREAS, Florida Power & Light Company has requested a grant
of a fifteen (15) foot strip easement on City property to
construct, operate and maintain underground electric utility

facilities (including wires, cables, conduits and appurtenant
equipment) to be installed from time to time, with the right to
reconstruct, improve, change the voltage, and remove such
facilities or any of them within the easement, with full right of
ingress and egress; and
WHEREAS, it is in the best interest of the City to express
its intent to grant an easement to Florida Power and Light
Company to facilitate the overhead to underground conversion and
allow Florida Power and Light Company to obtain all necessary
permits for the necessary work; and
WHEREAS, the City Manager will present the Grant of Easement
to the City Commission once the exact specifics of the easement
has been determined;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are adopted by reference and
incorporated as if fully set forth in this Section.
Section 2. The intent of the City Commission to grant to
Florida Power and Light a fifteen (15) foot strip perpetual,
non-exclusive easement on the property located at approximately

1050 MacArthur Causeway, Miami, Florida, at substantially the
location depicted in "Exhibit A," attached and incorporated, for
the construction, operation and maintenance of underground
electric utility facilities, with the right to reconstruct,
improve, change the voltage, and remove such facilities or any of
them within the easement, with said easement to provide for the
overhead to underground conversion of electrical distribution
facilities that effect the operation of the Aviation and Visitors
Center on Watson Island is expressed.
Section 3. The City Manager is directed to present the
Grant of Easement, in a form acceptable to the City Attorney,
once the exact specifics of the easement have been determined.
Section 4. This Resolution shall become effective
immediately upon its adoption and signature of the Mayor.11
1� If the Mayor does not sign this Resolution, it shall become
effective at the end of ten calendar days from the date it was
passed and adopted. If the Mayor vetoes this Resolution, it
shall become effective immediately upon override of the veto by
the City Commission.

The administration recommends that the City Commission adopt the attached Resolution
authorizing the City Manager to execute a Grant of Easement, in a form acceptable to the City
Attorney, to Florida Power & Light Company, of a fifteen (15) foot strip, perpetual, non-
exclusive easement on the property located at approximately 1050 MacArthur Causeway, Miami,
Florida, in substantially the location depicted in Exhibit "A" attached hereto and made a part
hereof, for the construction, operation and maintenance of underground electric utility facilities,
with the right to reconstruct, improve, change the voltage, and remove such facilities or any of
them within the easement; said easement is to be executed upon completion of the overhead to
underground conversion of electrical distribution facilities that affect the operation of the
Aviation and Visitors Center on Watson Island.
BACKGROUND:
Florida Power and Light Company has requested the grant of a fifteen (15) foot wide easement
on City -owned property for the construction, operation and maintenance of underground electric
utility facilities. These facilities are for the overhead to underground conversion of electrical
distribution facilities that affect the operation of the aviation and visitors center. This easement
will be for the construction, operation and maintenance of underground electric utility facilities,
with the right to reconstruct, improve, change the voltage, and remove such facilities or any of
them within the easement, with full right of ingress thereto and egress therefrom.
The easement shall further contain a reverter provision that if the easement shall be abandoned or
discontinued, the easement shall cease and revert back to the City.

July 24, 2003 at 9:00 a.m., in the City Commission Chambers at City Hall, located at
3500 Pan American Drive, Miami, Florida, for the purpose of considering the following

No cede el Gob. Bush acerca
de la negligencia medica

de seguros han testificado ante incontables eomisiones anteriormente,
nunca bajo juramento, de que las demandas frivolas estan causando
el aumento en el costo del seguro contra negligencia medica, causando
que las empresas aseguradoras abandonen el Estado, por to cual
los m6dicos tambi6n se van.
Pero los testimonios demostraron que aunque algunos medicos
se van (del Estado) m6s mddicos estan obteniendo licencia en
la Florida que hate cinco anos. Ademas, una ley de la Florida
promulgada hate rods de 14 anos prohibe las demandas frivolas.
Mientras tanto, la mayor empresa del Estado de seguros contra
negligencia mddica testific6 -bajo juramento- que la Florida constituye
su mereado m6s ganancioso y que continuar6 siendo ganancioso aun
si el Cuerpo Legislativo no hate ningun cambio en las leyes sobre
negligencia mddica.
Ese testimonio "realmente desbarat6 la ret6rica", dijo el presidente
de la Comisi6n Judicial del Senado Alex Villalobos, republiexano por
Miami. "El testimonio de que los mddicos estAn abandonando el Es-
tado no es exacto ... La explosi6n de demandas frivolas, que es to
que me han dicho, simplemente no es verdad".
Las companias de seguros resuelven casos (fuera de los tribu-
nales) que podrian ganar en la Corte debido a las leyes "de mala
fe" que gobiernan la forma en que ellas tratan a los medicos que
esas empresas aseguran, testific6 Bob White, presidente de la First
Professionals Insurance Co. Las demandas frivolas no tienen la
culpa:
"No creo que se pueda tener una demanda frivola en el Estado de
la Florida. Creo que la Florida arregl6 su problema de demandas
frivolas en 1988", testific6 White el lunes.
La jefa ejecutiva de la Asociacidn Mddica de la Florida (FMA),
Sandy Mortham, dijo que ella no estaba en posici6n de decir si las
demandas frivolas causaban primas de seguros m6s altas, a pesar
de que la FMA les ha echado la culpa a eras demandas en notas de
prensa y declarations en su sitio de la Internet.

Florida, for the purpose of considering the following resolution:
A Resolution of the Miami City Commission, authorizing the
City Manager to execute a Grant of Easement, in a form
acceptable to the City Attorney, to Florida Power and Light
company, of a fifteen (15) foot strip perpetual, non-exclu-
sive easement on the property located at approximately
1050 MacArthur Causeway, Miami, Florida, for the con-
struction, operation and maintenance of underground elec-
tric utility facilities, with the right to reconstruct, improve,
change the voltage, and remove such facilities or any of
them within the easement; said easement to be executed
upon completion of the overhead to underground conver-
sion of electrical distribution facilities that affect the opera-
tion of the Aviation and Visitors Center on Watson Island.
All interested persons are invited to appear and may be heard con-
cerning these items. Should any person desire to appeal any decision
of the City Commission with respect to any matter considered at this
hearing, that person shall ensure that a verbatim record of the pro-
ceedings is made, including all testimony and evidence upon which
any appeal may be based.
