HomeMy WebLinkAboutR-03-0850J-03-620 07/24/03 RESOLUTION NO. 03— 850 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), EXPRESSING ITS INTENT TO GRANT FLORIDA POWER AND LIGHT COMPANY ("FP&L") A FIFTEEN (15) FOOT STRIP PERPETUAL, NON-EXCLUSIVE EASEMENT ON THE PROPERTY LOCATED AT APPROXIMATELY 1050 MACARTHUR CAUSEWAY, MIAMI, FLORIDA, AT SUBSTANTIALLY THE LOCATION DEPICTED IN "EXHIBIT A," ATTACHED AND INCORPORATED, FOR THE CONSTRUCTION, OPERATION AND MAINTENANCE OF UNDERGROUND ELECTRIC UTILITY FACILITIES, WITH THE RIGHT TO RECONSTRUCT, IMPROVE, CHANGE THE VOLTAGE, AND REMOVE SUCH FACILITIES OR ANY OF THEM WITHIN THE EASEMENT, WITH SAID EASEMENT TO BE PROVIDED FOR THE OVERHEAD TO UNDERGROUND CONVERSION OF ELECTRICAL DISTRIBUTION FACILITIES THAT EFFECT THE OPERATION OF THE AVIATION AND VISITORS CENTER ON WATSON ISLAND; DIRECTING THE CITY MANAGER TO PRESENT A GRANT OF EASEMENT, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, TO THE CITY COMMISSION ONCE THE EXACT SPECIFICS OF THE EASEMENT HAVE BEEN DETERMINED. WHEREAS, it is necessary to relocate and convert to underground, the overhead distribution facilities that affect the operation of the Aviation and Visitors Center on Watson Island; and WHEREAS, Florida Power & Light Company has requested a grant of a fifteen (15) foot strip easement on City property to construct, operate and maintain underground electric utility CITY COMMISSION MEETING OF 11) L 2 4 ?Pnl Resolution No. J3-- 850 facilities (including wires, cables, conduits and appurtenant equipment) to be installed from time to time, with the right to reconstruct, improve, change the voltage, and remove such facilities or any of them within the easement, with full right of ingress and egress; and WHEREAS, it is in the best interest of the City to express its intent to grant an easement to Florida Power and Light Company to facilitate the overhead to underground conversion and allow Florida Power and Light Company to obtain all necessary permits for the necessary work; and WHEREAS, the City Manager will present the Grant of Easement to the City Commission once the exact specifics of the easement has been determined; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The intent of the City Commission to grant to Florida Power and Light a fifteen (15) foot strip perpetual, non-exclusive easement on the property located at approximately Page 2 of 4� 850 1050 MacArthur Causeway, Miami, Florida, at substantially the location depicted in "Exhibit A," attached and incorporated, for the construction, operation and maintenance of underground electric utility facilities, with the right to reconstruct, improve, change the voltage, and remove such facilities or any of them within the easement, with said easement to provide for the overhead to underground conversion of electrical distribution facilities that effect the operation of the Aviation and Visitors Center on Watson Island is expressed. Section 3. The City Manager is directed to present the Grant of Easement, in a form acceptable to the City Attorney, once the exact specifics of the easement have been determined. Section 4. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.11 1� If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. BACKGROUND: Florida Power and Light Company has requested the grant of a fifteen (15) foot wide easement on City -owned property for the construction, operation and maintenance of underground electric utility facilities. These facilities are for the overhead to underground conversion of electrical distribution facilities that affect the operation of the aviation and visitors center. This easement will be for the construction, operation and maintenance of underground electric utility facilities, with the right to reconstruct, improve, change the voltage, and remove such facilities or any of them within the easement, with full right of ingress thereto and egress therefrom. The easement shall further contain a reverter provision that if the easement shall be abandoned or discontinued, the easement shall cease and revert back to the City. Las companias de seguros resuelven casos (fuera de los tribu- nales) que podrian ganar en la Corte debido a las leyes "de mala fe" que gobiernan la forma en que ellas tratan a los medicos que esas empresas aseguran, testific6 Bob White, presidente de la First Professionals Insurance Co.
