J-03-621 07/23/03 RESOLUTION NO. 0 848 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO EXECUTE A GRANT OF EASEMENT, IN SUBSTANTIALLY THE ATTACHED FORM, TO MIAMI-DADE COUNTY OF A TWELVE (12) FOOT WIDE PERPETUAL, NON-EXCLUSIVE EASEMENT AT THE CITY -OWNED PROPERTY DESCRIBED IN "EXHIBIT A," ATTACHED AND INCORPORATED, FOR THE CONSTRUCTION, INSTALLATION, OPERATION AND MAINTENANCE OF WATER AND SEWAGE FACILITIES, WITH THE RIGHT TO RECONSTRUCT, IMPROVE, CHANGE, AND REMOVE SUCH FACILITIES OR ANY OF THEM WITHIN THE EASEMENT. WHEREAS, Miami -Dade County has requested the grant of a twelve (12) foot wide, perpetual, non-exclusive easement at City -owned property as described in "Exhibit A," attached and incorporated, to construct, install, operate and maintain water and sewage facilities, with the right to reconstruct, improve, change, and remove all or any of the facilities within the easement, with full rights of ingress and egress; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: CITY Commmon I-1EET%NG Resolution No. 133- 848 Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorizedll to execute a Grant of Easement, in substantially the attached form, to Miami -Dade County, at City -owned property described in "Exhibit A," attached and incorporated, of a twelve (12) foot wide perpetual, non-exclusive easement, for the construction, installation, operation and maintenance of water and sewage facilities, with the right to reconstruct, improve, change, and remove such facilities or any of them within the easement. Section 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.V 1� The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. 2/ If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. The GRANTEE shall regulate the installation and future operations of the FACILITIES so as not to conflict with normal operations of the GRANTOR; however, the GRANTEE shall have full right to enter upon the EASEMENT at any time when no -nal operations or emergency repairs of the `..,,,CILITI-ES:are.requiit�d.. The GRANTEE agrees to indemnity and hold harmless the GRANTOR from all and against all suits, claims. judgments, and all loss, damage, costs or charges arising directly or indirectly from the installation or maintenance, repair, use or existence of the GRANTEE'S FACILITIES within the EASEMENT. The GRANTEE acknowledges its liability for torts to the extent provided and allowed under Section 768.28, Florida Statutes. Any contractors utilized by GRANTEE in connection with activities undertaken in connection with this water and sewer EASEMENT shall: (1) indemnify the GRANTOR and the GRANTEE for negligent, willful or intentional acts or omissions of 03- 848 the contractor and its subcontractors in connection with any activities undertaken on the Easement Parcel, (2) obtain and provide to GRANTOR evidence of comprehensive general liability insurance and auto liability insurance with minimum limits of coverage in the amount of $1,000.000.00 per occurrence, bodily and property damage combined, and (3) list GRANTOR. GRANTEE, arty Parrot Jungle and CTardcns of Watson Island, Inc., a corporation under the laws of the State of Florida, as additional insureds under such contractor's liability insurance. The GRANTOR shall be given written notice and the opportunity by the GRANTEE to attend all preconstruction meetings on installation work of the FACILITIES within the EASEMENT and shall be notified in writing well in advance of the actual start of construction within the EASEMENT. It is further understood and agreed by and between the parties hereto that GRANTOR reserves itself, its heirs and assigns, all other rights not specifically granted herein, including but not limited to the right to construct streets, cross and recross said EASEMENT, and the right to erect light or telephone lines or any other improvements which do not hinder the operation of the FACILITIES by the GRANTEE on an ongoing basis. The GRANTEE shall be held responsible for any damage to adjacent property as a result of the installation and future operation of the FACILITIES, and further, shall restore all pavement, sidewalks. curb and "utter, existing utilities, and landscaping to a condition acceptable to the GRANTOR. The GRANTEE during the course of installation and future operation of the FACILITIES, shall not encroach beyond the boundaries of the EASEMENT or any other easement than may be granted by the Ci11.nNTOR. ;Should the EASEMENT be abandollf--d or discontinued by law or otherwise. the said EASEMENT shall cease and revert with the right of immediate possession and right of entry to the GRANTOR or its successors in interest. The GRANTOR does hereby fully warrant that it has good title to the PROPERTY and that it has full power and authority to grant this EASEMENT. Cumplir anos es Cosa corriente, pero cumplir 96 y que sea Millo Ochoa, es todo un acontecimiento humano, social y politico, por ser Millo una de las figuras que honr6 el ejercicio de la politica, que algunos han vitupera- do, pero que fue honrado en forma exceptional por hombres tomo el. Nacido en la ciudad de Holguin, provincia de Oriente, Cuba, el 4 de julio de 1907, Millo fue una de las figuras political mas popula- res en Cuba. Sirvi6 8 anos Como senador de la Republica, presidi6 el Partido Ortodoxo, fue delegado a la Convenci6n Constituyente de 1940 y candidato a la vicepresiden- cia de la Republica, entre otros desempenos. Por cierto que el y el tambien popular Dr. Santiago Rey Perna, son los unicos sobre- vivientes de aquella hist6rica Convenci6n de la que sali6 el texto constitutional mas avanzado en su tiempo. La invocaci6n del acto fue hecha por ese religioso de inspiraci6n ex- traordinaria que es el reverendo Martin Anorga, y el panegirico del homenajeado fue librado a la elo- cuencia del Dr. Rafael Dfaz-Ba- lart, otra valiosa figura politica de la Cuba republicana, en la que fue legislador. El Dr. Molina comparti6 el premio N6be1 con F. Sherwood Ro- wland y Paul Crutzen. Tambien fue nombrado en 1998, entre los 20 hispanos mas sobresalientes en el Area de tecnologfa. Actuahnente, el Dr. Molina es pro- fesor del Instituto de lbcnologfa de Massachusetts. Recibi6 su grado de bachiller en ingienerfa quimica de la Universidad Nacional Aut6noma de Mexico en Ciudad de Mexico y un grado avanzado de la Universi- dad de Freiburg en Alemania. En el 1972, obtuvo su doctorado de la Universidad de.California, en Berj- keley, donde trabaj6 por un ano. Luego se uni6 a Rowland en la Uni- versidad de California, en Irvine. Ademas trabaj6 en el laboratorio de propulsion a chorro del Instituto de Tecnologia de California, en Pasa- dena, antes de convertirse en pro- fesor de MIT.
