RESOLUTION NO. +� 3 - 822
A RESOLUTION OF THE MIAMI CITY COMMISSION,
WITH ATTACHMENT(S), CLOSING, VACATING,
ABANDONING AND DISCONTINUING FOR PUBLIC USE
THAT PORTION OF A PUBLIC RIGHT-OF-WAY, BEING
THE PORTION OF APPROXIMATELY NORTHWEST 7TH
STREET BETWEEN NORTHWEST IT COURT AND THE
METRORAIL RIGHT-OF-WAY, MIAMI, FLORIDA,
LEGALLY DESCRIBED IN ATTACHED "EXHIBIT A."
WHEREAS, the Miami Zoning Board at its meeting of January
27, 2003, Item No. 2, duly adopted Resolution No. ZB 2003-0677
by a five to zero (5-0) vote, RECOMMENDING APPROVAL of closing,
vacating, abandoning, and discontinuing a portion of the public
right-of-way as set forth herein; and
WHEREAS, the Department of Public Works and the Plat and
Street Committee have studied the subject vacation and closure
and determined that it will not affect pedestrian or vehicular
traffic circulation or access for public service; and
WHEREAS, the Plat and Street Committee has reviewed the
subject tentative plat and determined that all technical

requirements have been met, and found the vacation and closure
of the subject right-of-way would benefit the general public and
therefore recommended approval; and
WHEREAS, the City Commission, finds that it is in the best
interest of the general welfare of the City of Miami and its
inhabitants to grant the vacation and closure of a portion of
the public right-of-way as hereinafter described, and deems it
advisable to do so;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are adopted by reference and
incorporated as if fully set forth in this Section.
Section 2. A portion of public right-of-way, being a
portion of Northwest 7th Street between Northwest 1St Court and
the Metrorail Right -of -Way, Miami, Florida, as legally described
in attached "Exhibit A," is closed, vacated, abandoned and
discontinued for public use.

Section 3. This Resolution shall become effective
immediately upon its adoption and signature of the Mayorll.

THE EXPECTED USE OF THE LAND, AS CLASSIFIED IN THE "MINIMUM TECHNICAL STANDARDS FOR LAND SURVEYING IN THE
TATE OF FLORIDA," PURSUANT TO RULE 61G17-6 OF THE FLORIDA ADMINISTRATIVE CODE IS "COMMERCIAL/HIGH RISK."
1E MINIMUM RELATIVE DISTANCE ACCURACY FOR THIS TYPE OF BOUNDARY SURVEY IS 1 FOOT IN 10,000 FEET.
ALTHOUGH A BOUNDARY SURVEY WAS NOT CONDUCTED THE ACCURACY OBTAINED BY MEASUREMENT AND CALCULATION

VACATION AND CLOSURE OF A PUBLIC RIGHT OF WAY, BEING THE
PORTION OF NW Th STREET BETWEEN NW IST COURT AND METRO -
RAIL RIGHT-OF-WAY.
Pursuant to Section 55-15 (c) of the Miami City Code, the Planning and Zoning Department
has reviewed the proposed right-of-way vacation to determine whether it is in the public
interest, or whether the general public would benefit from the vacation of the right-of-way.
The following findings have been made:
• It is found that the proposed right of way to be vacated is located immediately East of
NW 1St Court and Metrorail right-of-way at NW 7th Street.
• It is found that the vacation of the right of way is required to complete a safe drop off
and pick up area for transit patron vehicles at Overtown Metrorail Station site.
• It is found that Overtown Metrorail Station site will enhance the Downtown Area by
providing a link between NW 1St Court and the station via a pedestrian access walkway.
• It is found that the proposed vacation of the right of way is therefore in the public
interest.
Based on these findings, the Planning and Zoning Department recommends
approval of the request.

On March 7, 2002, the Plat and Street Committee reviewed the tentative plat of
"Overtown Station" and determined that all technical requirements contained in
the Miami City Code Subdivision Regulations have been met and has approved
the tentative plat. The members of the Plat and Street Committee have further
considered the request for vacation and closure of this roadway with respect to
Miami City Code requirements and have voted unanimously in favor of this
roadway vacation and closure request.

above tentative plat subject to the following revisions being made to the tentative plat, additional
information being provided and/or variances being granted. Please be advised that the
processing of your tentative plat cannot proceed until these conditions have been satisfied.
1. Label Plat Book B, Page 41, as MIAMI on the tentative plat.
2. Delete the quotation marks from the proposed plat name.
3. Provide total right-of-way width for all adjacent streets in the main sketch.
4. Show proposed lots and blocks or tracts. Also provide square footage area for each lot or
tract.
5. In Article IX, Client Information, state that Miami -Dade County is the owner.
6. In Article IX, "Easements and Zoning", reference zoning information as according to Zoning

10. Reference Section 37 as also being James Hagan Donation.
11. NW 7 Street is a public right-of-way. Since Tentative Plat No. 1174 was never recorded,
Resolution No. 82-978 expired. Provide an expressed purpose statement.
12. An opinion of title as to reversionary rights for the right-of-way to be closed and vacated
will be required by the Zoning Board. The opinion of title must also address whether or not
there are any individuals, in addition to the abutting property owners, having an interest in
the right-of-way to be closed and vacated. A copy of the opinion must be provided to the
Public Works Department.
A sketch and legal description, with a square footage for the proposed right-of-way closure
will be required by the Zoning Board. Contact Ms. Teresita Fernandez, Chief of the
Hearing Boards, at 305-416-2030. Provide a copy to the Department of Public Works on
8'/"x11" paper.
13. The Florida Department of Transportation will have to join in and execute the final plat.
(See special exception No. 10 in the opinion of title.)
14. Show more clearly the proposed plat area in the location sketch.
15. Each phase of building needs fire flow approval.
16. The Plat 'and Street Committee in reviewing the request to close and vacate NW 7 Street
between NW 1 Court and the Metrorail right-of-way have considered the public interest
requirements found in Chapter 55 of the Miami City Code. These requirements having
been met, the Plat and Street Committee recommends approval of the vacation and
closure of the said portion of NW 7 Street subject to review and approval of the
development plans by the City of Miami Planning and Zoning Department.
In addition to the above requirements, you should be aware of the following:
1. State and local laws require the installation of various physical improvements in the public
rights-of-way when property is platted. These subdivision improvements include paving,
drainage, landscaping, sidewalks, etc. In some cases this could represent a substantial
investment on your part.
2. The alteration, relocation or installation of utilities such as storm and sanitary sewers,
electric, telephone, water, etc. caused by this plat will be at the property owner's expense.
Also, utility easements may be required on the property being platted.

3. A building permit will not be issued on the property being platted until the final plat is
recorded. Also, the Certificate of Occupancy for any building construction will be issued
only after all the required subdivision improvements have been completed.
4. Approval for fire flow requirements must be obtained from the Fire -Rescue Department prior
to the issuance of a building permit.
5. Additional items must be provided to the City of Miami Department of Public Works before
the final plat is submitted to the City Commission for approval. You will be noted in writing
as to what these items are after the amount of the bond has been determined for the
necessary subdivision improvements.
6. Tentative plat approval is only valid for one (1) year from the date of the Plat and Street
Committee meeting at which time it was approved.
If you have any questions concerning these requirements, please refer to the attached sheet for

11. NW 7 Street is a public right-of-way. Since Tentative Plat No. 1174 was never recorded,
Resolution No. 82-978 expired. Provide an expressed purpose statement.
12. An opinion of title as to reversionary rights for the right-of-way to be closed and vacated
will be required by the Zoning Board. The opinion of title must also address whether or not
there are any individuals, in addition to the abutting property owners, having an interest in
the right-of-way to be closed and vacated. A copy of the opinion must be provided to the
Public Works Department.
A sketch and legal description, with a square footage for the proposed right-of-way closure
will be required by the Zoning Board. Contact Ms. Teresita Fernandez, Chief of the
Hearing Boards, at 305-416-2030. Provide a copy to the Department of Public Works on
8%"x11" paper.
13. The Florida Department of Transportation will have to join in and execute the final plat.
(See special exception No. 10 in the opinion of title.)
14. Show more clearly the proposed plat area in the location sketch.
15. Each phase of building needs fire flow approval.
16. The Plat and Street Committee in reviewing the request to close and vacate NW 7 Street
between NW 1 Court and the Metrorail right-of-way have considered the public interest
requirements found in Chapter 55 of the Miami City Code. These requirements having
been met, the Plat and Street Committee recommends approval of the vacation and
closure of the said portion of NW 7 Street subject to review and approval of the
development plans by the City of Miami Planning and Zoning Department.
In addition to the above requirements, you should be aware of the following:
1. State and local laws require the installation of various physical improvements in the public
rights-of-way when property is platted. These subdivision improvements include paving,
drainage, landscaping, sidewalks, etc. In some cases this could represent a substantial
investment on your part.
2. The alteration, relocation or installation of utilities such as storm and sanitary sewers,
electric, telephone, water, etc. caused by this plat will be at the property owner's expense.
Also, utility easements may be required on the property being platted.

3. A building permit will not be issued on the property being platted until the final plat is
recorded. Also, the Certificate of Occupancy for any building construction will be issued
only after all the required subdivision improvements have been completed.
4. Approval for fire flow requirements must be obtained from the Fire -Rescue Department prior
to the issuance of a building permit.
5. Additional items must be provided to the City of Miami Department of Public Works before
the final plat is submitted to the City Commission for approval. You will be noted in writing
as to what these items are after the amount of the bond has been determined for the
necessary subdivision improvements.
6. Tentative plat approval is only valid for one (1) year from the date of the Plat and Street
Committee meeting at which time it was approved.

partial release, this exception will be deleted.
Reversionary rights are as follows: Title to NW 7 Street vesting in Miami -Dade
County is derived as follows: When a street is dedicated to public use, the abutting
landowners take title to the center of the street, subject to a perpetual easement in favor
of the public. Rums v. McDaniel, 140 So. 314, 316 (Fla. 1932), Donifay v. Dickson, 459
So. 2d 1089, 1095 (Fla. 1st DCA -1984).
The following paragraph of the Opinion contained an error in listing the City of Miami
rather than Miami -Dade County (error underlined)
Therefore, it is my opinion that the following parties must join in the platting of the
above described real property in order to grant CITY OF MIAMI. FLORIDA and the public,
a good and proper title to the dedicated areas shown on the final plat of the aforedescribed
property, the subdivision thereof to be known as OVERTOWN STATION.
The Immediately preceding paragraph is hereby amended to read as follows:
Therefore, it is my opinion that the following parties must join in the platting of the
above described real property in order to grant MIAMI-DADE COUNTY and the public, a
good and proper title to the dedicated areas shown on the final plat of the aforedescribed
