RESOLUTION NO. 03— S 1 8
A RESOLUTION OF THE MIAMI CITY COMMISSION
STATING THE CITY COMMISSION'S INTENT THAT
ALL THOSE PERSONS RECEIVING A PENSION FROM
THE CITY OF MIAMI SHALL NOT HAVE EXISTING
PENSION BENEFITS DIMINISHED OR TAKEN FROM
THEM OR THEIR BENEFICIARIES UNDER ANY
CIRCUMSTANCES BY THE CITY OF MIAMI OR ANY OF
ITS PENSION BOARDS
WHEREAS, the City of Miami contributes to certain pension
plans for its employees; and
WHEREAS, those retirement plans pay benefits to those
employees who have rendered long and loyal service to the City
of Miami; and
WHEREAS, there are numerous city employees who are not
enrolled in the Social Security system and the City does not
make contributions on these persons' behalf; and
WHEREAS, the retirees of the City of Miami, in many cases,
their widows and widowers, rely on the retirement benefits that

they receive to provide them the necessities of life and dignity
as they grow old; and
WHEREAS, the City Commission believes that in a free
democratic state, governments should not have the power to
deprive persons of the means of their livelihood and their
dignity;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are adopted by reference and
incorporated as if fully set forth in this Section.
Section 2. It is the City Commission's intent that all
those persons receiving a pension from the City of Miami shall
not have existing pension benefits diminished or taken from them
or their beneficiaries under any circumstances by the City of
Miami or any of its Pension Boards.

Section 3. This Resolution shall become effective
immediately upon its adoption and signature of the Mayor.!'

i� If the Mayor does not sign this Resolution, it shall become effective at
the end of ten calendar days from the date it was passed and adopted. If
the Mayor vetoes this Resolution, it shall become effective immediately
upon override of the veto by the City Commission.
