A RESOLUTION OF THE MIAMI CITY COMMISSION
AUTHORIZING AND PERMITTING THE RESTRICTION
OF VEHICULAR AND PEDESTRIAN ACCESS AT THE
ALLEY LOCATED AT SOUTHWEST 54TH AVENUE,
BETWEEN THE INTERSECTIONS OF SOUTHWEST 5TH
STREET AND SOUTHWEST 5TH TERRACE, MIAMI,
FLORIDA, DUE TO UNSAFE CONDITIONS, SUBJECT
TO CERTAIN CONDITIONS AS MORE PARTICULARLY
SET FORTH HEREIN.
BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The restriction of vehicular and pedestrian
access at the alley located at Southwest 54th Avenue, between the
intersections of Southwest 5th Street and Southwest 5th Terrace,
Miami, Florida, is authorized and permitted due to unsafe
conditions, subject to the following conditions:
(a) the Department of Municipal Services shall approve the
design of the fence and gates to prohibit vehicular
and pedestrian access, ensuring no access or private
use of the Alley unless and until the Alley is
vacated;
(b) the applicant shall obtain a revocable permit from the
Department of Municipal Services for the fence and
gates;
(c) the fence, gates and restricted portion of the public
Alley shall be maintained by the property owner of the
property at 5340 Southwest 5th Street, Miami, Florida,
with the express understanding that no private use may
be made of the Alley unless and until
vacated;

(d) all expenses resulting from this request for
prohibited access to the Alley shall be borne by the
property owner at 5340 Southwest 5th Street, Miami,
Florida.
Section 2. This Resolution shall become effective
immediately upon its adoption and signature of the Mayor.!'

1/ If the Mayor does not sign this Resolution, it shall become
effective at the end of ten calendar days from the date it was
passed and adopted. If the Mayor vetoes this Resolution, it
shall become effective immediately upon override of the veto by
the City Commission.

A public hearing will be held by the Commission of the City of Miami, Florida on
Wednesday, June 25, 2003, at 9:00 a.m., in the City Commission Chambers at City Hall,
located at 3500 Pan American Drive, Miami, Florida, for the purpose hearing objections
from any interested parties affected by the restriction of vehicular and pedestrian access
to SW 54 Avenue Alley between SW 5 Street and SW 5 Terrace.
All interested persons are invited to appear and may be heard concerning the restriction
of vehicular and pedestrian access to SW 54 Avenue Alley. Should any person desire to
appeal any decision of the City Commission with respect to any matter considered at this
hearing, that person shall ensure that a verbatim record of the proceedings is made,
including all testimony and evidence upon which any appeal may be based.
