A RESOLUTION OF THE MIAMI CITY COMMISSION WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO EXECUTE A GRANT OF EASEMENT, IN SUBSTANTIALLY THE ATTACHED FORM, ON WATSON ISLAND, LOCATED AT APPROXIMATELY 1111 PARROT JUNGLE TRAIL, MIAMI, FLORIDA, TO BELLSOUTH TELECOMMUNICATIONS, INC. A GEORGIA CORPORATION ("BELLSOUTH"), CONTAINING APPROXIMATELY 7659.80 SQUARE FEET (A TEN (10) FOOT WIDE STRIP), AS DEPICTED IN "EXHIBIT A" ATTACHED AND INCORPORATED, FOR A PERPETUAL NON-EXCLUSIVE EASEMENT ON THE PROPERTY, TO CONSTRUCT, OPERATE, MAINTAIN, ADD, AND/OR REMOVE SUCH SYSTEMS OF COMMUNICATION, FACILITIES, STAND-BY GENERATORS AND ASSOCIATED FUEL SUPPLY SYSTEMS AS A MEANS OF PROVIDING UNINTERRUPTED SERVICE DURING COMMERCIAL POWER OUTAGES, WITH ALL WIRING, CABLE, OR CONDUITS TO BE PLACED UNDERGROUND. WHEREAS, the City Commission has authorized improvements to the public boat ramp at Watson Island; and WHEREAS, as part of these improvements, it is necessary to place utilities underground to accommodate the new design and maximize use of the area; and CITY COMMISSION MEETING OF J U N 2 F 2003 Resolution No. iJ3- 727 WHEREAS, for BellSouth to place its utilities underground, it requires the granting of 7659.80 square feet (a ten (10) foot wide strip); and WHEREAS, this easement will be used to construct, operate, maintain, add, and/or remove such systems of communications, facilities, stand by generators and associated fuel supply systems as a means of providing uninterrupted service during commercial power outages; and WHEREAS, as a special condition to the easement all wires, cable, or conduits are to be placed underground; and WHEREAS, the easement shall provide for a reverter provision, that if the easement shall be abandoned or discontinued, the easement shall cease and revert back to the City; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Page 2 of 4 "J 3 — 727 Section 2. The City Manager is authorizedll to execute a Grant of Easement, in substantially the attached form, on Watson Island, located at approximately 1111 Parrot Jungle Trail, Miami, Florida, to BellSouth Telecommunications, Inc. a Georgia Corporation ("BellSouth"), containing approximately 7659.80 square feet (a ten (10) foot wide strip), as depicted in "Exhibit A" attached and incorporated, for a perpetual non- exclusive easement on the property, to construct, operate, maintain, add, and/or remove such systems of communication, facilities, stand-by generators and associated fuel supply systems as a means of providing uninterrupted service during commercial power outages, with all wiring, cable or conduits to be placed underground. Section 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayor .2/ 1� The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted.
