HomeMy WebLinkAboutR-03-0724J-03-572 06/18/03 RESOLUTION NO. 03- 724 A RESOLUTION OF THE MIAMI CITY COMMISSION BY A FOUR/FIFTHS (4/5"s) AFFIRMATIVE VOTE, RATIFYING, APPROVING AND CONFIRMING THE EXECUTIVE DIRECTOR OF BAYFRONT PARK MANAGEMENT TRUST'S (-TRUST") FINDING OF AN EMERGENCY, WAIVING THE REQUIREMENTS FOR COMPETITIVE SEALED BIDDING PROCEDURES AND ACCEPTING THE BID OF GANCEDO TECHNOLOGIES, INC. TO REPAIR ADDITIONAL CODE VIOLATIONS NECESSARY TO COMPLETE THE RE-PULL OF MAIN POWER TO THE MILDRED AND CLAUDE PEPPER FOUNTAIN AND PUMP HOUSE AT BAYFRONT PARK, IN AN AMOUNT NOT TO EXCEED $29,710; ALLOCATING FUNDS FROM THE CAPITAL IMPROVEMENT BUDGET OF THE TRUST. WHEREAS, the Mildred and Claude Pepper Fountain ("Fountain") located at Bayfront Park, serves as the center piece of downtown Miami and operates 24 hours a day, 365 days per year; and WHEREAS, on August 26, 2002, the Bayfront Park Management Trust ("Trust") received notification of an electrical violation (Reference CR #01-11452) from Mr. Orestes Castillo, Chief of the Electrical Section of the City of Miami; and CITY CON ISSION MEETING OF J U N 2 5 2001 Resolution No. 03- 724 WHEREAS, the violation warranted "hazardous wiring conditions" existing at the Fountain and pump house at Bayfront Park; and WHEREAS, Trust Resolution No. 02-056, adopted at the September 30, 2002 Board meeting, authorized the Executive Director to proceed with this emergency repair; and WHEREAS, Bayfront Park staff put the repair project out to bid using the City's approved contractor list; and WHEREAS, a pre-bid meeting was held at Bayfront Park where four contractors participated of which one contractor responded with a bid; and WHEREAS, that contractor, Gancedo Technologies, was awarded the contract; and WHEREAS, The Trust, at the November 25, 2002 Board meeting authorized the expenditure for the re-pull of main power in an amount not to exceed $96,400, through Trust Resolution No. 02-070; and WHEREAS, Miami City Commission Resolution No. 03-035, adopted January 9, 2003, ratified the finding of an emergency; and WHEREAS, subsequent to Resolution No. 03-U3b, that authorization the City's Electrical Inspectors identified additional code violations at the Fountain; and WHEREAS, Gancedo Technologies was on site and in process of effecting overall repairs to the system; and Page 2 of 4 03- '724 WHEREAS, the repair of those violations was deemed as an emergency because the immediate repair of the electrical problem was essential to the safety and convenience of the Trust and the City; and WHEREAS Trust Resolution Nos. 03-022 and 03-032, adopted on March 24, 2003 and April 27, 2003, respectively, approved these additional expenditures; and WHEREAS, funds are available from Trust's Capital Improvement Budget; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. By a four-fifths (4/5ths) affirmative vote, the Trust's Executive Director's finding of an emergency, waiving the requirements for competitive sealed bidding procedures and accepting the bid of Gancedo Technologies, Inc. to repair the additional code violations necessary to complete the re-pull of main power to the Fountain and pump house at Bayfront Park is ratified, approved and confirmed, in an amount not to exceed $29,710, with funds allocated from the Capital Improvement Budget of the Trust. Page 4 of 4 63- 724 TO: The Honorable Mayor and DATE: Members of the City Commission k0♦ Executive Director RECOMMENDATION May 28, 2003 SUBJECT: Resolution — Ratifying the Executive Director of Bayfront Park's Finding of an Emergency waiving the requirements for competitive sealed bids and approving the repair of code violations necessary to complete the re-pull of main power to the Mildred and Claude Pepper Fountain and pump house at Bayfront Park It is respectfully recommended that the Miami City Commission adopt the attached Resolution ratifying, approving and confirming the Executive Director of the Bayfront Park Management Trust's finding of an emergency, waiving the requirements for competitive sealed bids and approving the repair of code violations necessary to complete the re-pull of main power to the Mildred and Claude Pepper Fountain and pump house at Bayfront Park in an amount not to exceed $29,710.00 payable to Gancedo Technologies. Funding is available from the Bayfront Park Management Trust Capital Improvement Budget. BACKGROUND The Bayfront Park Management Trust was created by the Miami City Commission to direct, operate, manage and maintain all aspects of Bayfront Park. Bayfront Park is the City of Miami's premier public park, hosting 50 special events and concerts annually. The Mildred & Claude Pepper Fountain operates 24 hours a day, 365 days per year. The fountain serves the center -piece of downtown Miami. On August 26, 2002, the Trust received notification of an electrical violation (Reference CR # 01-11452) from Mr. Orestes Castillo, Chief of the Electrical Section of the City of Miami. The violation warranted "hazardous wiring conditions" existing at the Mildred and Claude Pepper Fountain and pump house at Bayfront Park. Subsequent to that authorization, City of Miami Electrical Inspectors identified additional code violations. The repair of those violations was deemed an emergency because the immediate procurement of these services is essential to the safety and convenience of the Trust and the city. Gancedo Technologies was on site and in process of effecting overall repairs to the system. The Trust approved these additional expenditures through Trust Resolutions No. 03-022 and No. 03-032 at meetings held on March 24, 2003 and April 27, 2003, respectively. Additional Work is required by Gancedo Technologies to complete this Project. There are three reasons for the price increase, and they are the following: 1) Measurements from the ground box to the Fountain control booth were incorrect in the original drawings done by City of Miami Engineer. 2) The main transfer switch may need to be replaced because the size of the wiring to the main offices is larger than necessary. Andre Brain, City of Miami Engineer, will determine this. 3) Secondary irrigation components will be replaced with new ones, which was not included in the original bid. Finding of an Emergency On August 26, 2002, the Bayfront Park Management Trust received notification of an electrical violation from Orestes Castillo, Chief Electrical Section of the City of Miami, identifying hazardous wiring conditions in Bayfront Park. Staff immediately began process to procure repair services to the said condition. The Trust authorized the Executive Director to proceed with emergency repair at its September 30, 2002, meeting. A foreshortened bid process was undertaken with the assistance of the City of Miami Procurement Department, wherein four (4) electrical contractors were contacted from the approved bid list. A pre-bid meeting was held at Bayfront Park where four contractors participated. From those four, one contractor responded with a bid. Gancedo Technologies was awarded the contract. The Trust, at the November 25, 2002, Board meeting, approved the expenditure for repair of the re-pull of main power in an amount not to exceed $96,4000.00 through Trust Resolution No. 02-070. At the January 9, 2003, City Commission Meeting, the commission ratified the finding of the emergency and authorized the Trust to proceed with the required repairs, through City of Miami Resolution No. 03-035. On subsequent visits to the site, inspectors identified additional violations, which required increased expenses to affect the necessary repairs. In as much as Gancedo Technologies had already begun the repair process staff elected, subject to Trust approval, to continue with that contractor to complete the repairs. An additional $15,839 expense was approved through Trust resolution No. 03-022 at the March 24, 2003 meeting and $13,871 through Trust Resolution No. 03-032 at the May 28, 2003 meeting. Project expenses total $126,110, which exceed budgeted amount by $1,110. Four electrical contractors where contacted from the cities contractor list to bid on this project. A pre bid meeting was held at Bayfront Park and all four contractors showed up for the meeting. Only one contractor responded with a bid. Remove glass windows from control booth. Block opening with concrete blocks. Stucco and paint both sides to match surrounding areas. 3. Remove worktable and cabinets from control booth upper level. Paint walls to match surrounding area. 4. Remove wires from underground conduits that run from the FPL vault to the panel board "MDF" at the control booth, and from pull box #1 (PB #1) to the fenced area. 5. Fill underground conduits from panel board "MDF" to pull box #1 with weatherproof, water resistant material and cap. Submit product cut sheet of material for approval. CONTROL BOOTH 6. Provide and install 2'X2' fixed window with impact resistant glass as per Miami -Dade County approval. 7. Provide and install steel grating to cover opening located below worktable. S. Provide and install one 800 AMP, heavy duty, fusible safety switch at upper level. 9. Provide and install conduits and -wires from the new 800 AMP safety switch to panel board 'MDF" at the lower level: 10. Provide and install conduits from the upper level to pull box #1. 11. Provide and connect temporary 400 KW standby generator system. Generator shall provide electrical power to the service building during the replacement of the #400 MCM copper wires. 17.
