A RESOLUTION OF THE MIAMI CITY COMMISSION,
WITH ATTACHMENT(S), MAKING PROVISIONS FOR
HOLDING A GENERAL MUNICIPAL ELECTION ON
NOVEMBER 4, 2003, FOR THE NOMINATION OF
CANDIDATES FOR THE OFFICES OF THREE
COMMISSIONERS, AND FOR HOLDING A LATER
RUNOFF ELECTION ON NOVEMBER 18, 2003, UNLESS
ALL OF SAID OFFICES HAVE BEEN FILLED IN THE
GENERAL MUNICIPAL ELECTION; PROVIDING FOR
THE REGISTRATION OF PERSONS QUALIFIED TO
VOTE IN SAID GENERAL MUNICIPAL AND RUNOFF
ELECTIONS; DESCRIBING PERSONS QUALIFIED TO
VOTE IN SAID GENERAL MUNICIPAL AND RUNOFF
ELECTIONS; DESCRIBING THE REGISTRATION BOOKS
AND RECORDS MAINTAINED UNDER THE PROVISIONS
OF THE GENERAL LAWS OF FLORIDA AND
CHAPTER 16 OF THE CODE OF THE CITY OF MIAMI,
FLORIDA, AS AMENDED, WHICH THE CITY HAS
ADOPTED AND DESIRES TO USE FOR HOLDING SUCH
GENERAL MUNICIPAL AND RUNOFF ELECTIONS;
DESIGNATING AND APPOINTING THE CITY CLERK AS
THE OFFICIAL REPRESENTATIVE OF THE CITY
COMMISSION WITH RESPECT TO THE USE OF SUCH
REGISTRATION BOOKS AND RECORDS; AND
DIRECTING THE CITY CLERK TO GIVE NOTICE BY
PUBLICATION OF THE ADOPTION OF THIS
RESOLUTION AND THE PROVISIONS HEREOF.

Section 1. In accordance with the provisions of
Section 7 of the City Charter (Chapter 10847, Laws of Florida,
1925, as amended), a general municipal election is directed to be
held in the City of Miami, Florida, at the polling places
designated on in Exhibit No. 1, attached and incorporated, on
Tuesday, November 4, 2003, from 7:00 A.M. until 7:00 P.M., for
the purpose of nominating candidates for three District
Commissioners of the City of Miami to be each voted upon at the
general municipal election which is to be held, as provided in
said Section 7 of the City Charter unless in the general
municipal election a candidate for a City Commission District
receives a majority vote for the prospective office for which he
or she is a candidate, in which case he or she shall be elected
to said office.
Section 2. A runoff election is directed to be held in
the City of Miami, Florida, at the polling places designated in
said Exhibit No. 1, from 7:00 A.M. until 7:00 P.M., on Tuesday,
November 18, 2003, for the purpose of electing three District
Commissioners of the City of Miami unless a candidate for a City
Commission District shall have received a majority vote for the
prospective office for which he or she is a candidate at the
general municipal election held on November 4, 2003.
Section 3. The candidates who shall receive the highest
number of votes in Districts 1, 2 and 4 shall serve as
Commissioners of the City of Miami each for a period of four (4)

years from 12:00 o'clock noon of the day after the canvass of the
vote and the declaration of the result of said general election.
Section 4. The Precinct Election Clerks and Inspectors
to serve at said polling places on said dates shall be designated
by the Supervisor of Elections of Miami -Dade County, Florida, for
such purposes in accordance with the general laws of the State.
Section 5. For the purpose of enabling persons to
register who are qualified to vote in said elections and who have
not registered under the provisions of the general laws of
Florida and Chapter 16 of the Code of the City of Miami, Florida,
as amended, or who have transferred their legal residence from
one voting precinct to another voting precinct in the City, they
may register at such branch offices as may be approved by the
Supervisor of Elections of Miami -Dade County and at said
Supervisor's office which will be open during the following
location and times:
MIAMI-DADE COUNTY
ELECTIONS DEPARTMENT
111 Northwest 1st Street, Miami, Florida
Monday to Friday, inclusive: 8:00 A.M. - 5:00 P.M.
In addition to the above, said qualified persons may
register at branch offices and may also use any mobile
registration van for the purpose of registration to vote in the
herein described elections during such times and on such dates as

may be designated by the Supervisor of Elections of Miami -Dade
County.
Section 6. The elections shall be held at the voting
places in the precincts designated on said Exhibit No. 1, or as
may be designated by the Supervisor of Elections of Miami -Dade
County, in conformity with the provisions of the general laws of
the State. A description of the registration books and records
which pertain to election precincts wholly or partly within the
City and which the City is adopting and desires to use for
holding such elections is as follows: All registration cards,
books, records and certificates pertaining to electors of the
City and established and maintained as official by the Supervisor
of Elections of Miami -Dade County, in conformity with the
provisions of the general laws of the State, are adopted and
declared to be, and shall hereafter be recognized and accepted
as, official registration cards, books, records and certificates
of the City.
Section 7. The ballots to be used in said elections
shall be so prepared that the names of the qualified candidates
will appear on said ballots in alphabetical order according to
surname for each district; provided, however, that the ballots
and their preparation shall comply with the laws of the State of
Florida with respect to absentee ballots, and as to the use of
the iVontronic Voting Process Equipment.

Section 8. (a) In compliance with Florida Statutes, the
City Clerk is authorized and directed to publish notice of the
adoption of the herein Resolution and of the provisions hereof,
at least twice, once in the fifth week and once in the third week
prior to the week in which the aforesaid election is to be held,
in newspaper(s) of general circulation in the City of Miami,
Florida, which notice shall be substantially as set forth in the
following form:

PURSUANT TO RESOLUTION NO. 03-
A general municipal election will be held on
Tuesday, November 4, 2003, from 7:00 A.M. until
7:00 P.M., in the City of Miami, Florida, at the
polling places in the several election precincts
designated by the Board of County Commissioners of
Miami -Dade County, Florida, at which election the
qualified electors participating therein will vote for
the nomination of candidates for the offices of three
District Commissioners of the City of Miami, Florida,
to be each voted on at the runoff election which is to
be held on Tuesday, November 18, 2003, unless in the
general municipal election a candidate for a district
receives a majority vote for the prospective office for
which he or she is a candidate.
(b) The Precinct Election Clerks and Inspectors to serve at
said polling places on said dates shall be those designated by
the Supervisor of Elections of Miami -Dade County for such purpose
in accordance with the general laws of the State. The
registration books and records for the registration of persons

qualified to vote in said elections shall be those maintained by
the Supervisor of Elections of Miami -Dade County.
(c) The official ballot shall be in substantially the

(d) In the event a runoff election is required to be held

(e) A runoff election will be held on Tuesday,
November 18, 2003, from 7:00 A.M. until 7:00 P.M., in the City of
Miami, Florida, at the polling places set forth herein, at which
election the qualified electors of the City of Miami
participating therein will vote for the election of three
District Commissioners of the City of Miami, Florida, unless a
candidate for a District Commissioner shall have received a
majority vote for the prospective office for which he or she is a
candidate at the general municipal election held
November 4, 2003. The Precinct Election Clerks and Inspectors at
said general municipal election shall be those designated by the
Supervisor of Elections of Miami -Dade County for such purpose.
The registration books and records for the registration of
persons qualified to vote in said general municipal election
shall be those maintained by the Supervisor of Elections of
Miami -Dade County.

Section 9. PRISCILLA A. THOMPSON, the City Clerk of the
City of Miami, Florida, or her duly appointed successor, is
designated and appointed as the official representative of the
Commission of the City of Miami, Florida, in all transactions
with the Supervisor of Elections of Miami -Dade County in relation
to matters pertaining to the use of the registration books for
the holding of the herein general municipal election and the
herein runoff election.
Section 10. The City Clerk shall cause to be prepared
absentee ballots for the use of absentee electors entitled to
cast such ballots in said elections.
Section 11. All qualified electors of said City shall be
permitted to vote in said general municipal election and the
Supervisor of Elections of Miami -Dade County is requested,
authorized, and directed to furnish, at the cost and expense of
the City of Miami, a list of all qualified electors residing in
the City of Miami as shown by the registration books and records
of the Office of said Supervisor of Elections and duly certify
the same for delivery to and for use by the election officials
designated to serve at the respective polling places in said
election precincts.
Section 12. The City Clerk is authorized and directed to
cause a certified copy of this Resolution to be delivered to the
Supervisor of Elections of Miami -Dade County pursuant to
applicable law.

Section 13. This Resolution shall become effective
immediately upon its adoption and signature of the Mayor.'/

Attached please find a resolution making provisions, in accordance with Sections 4, 7 and 8 of the
Charter of the City of Miami, for the holding of a General Municipal Election on November 4,
2003 for Commissioners Districts 1, 2 and 4. This resolution also calls for the holding of a Runoff
Election, should one be necessary, on November 18, 2003.
It is in order for the City Commission to consider, review and adopt said resolution. By copy of
this memorandum to the Agenda Office, we are requesting that this item be scheduled on the June
12, 2003 City Commission meeting agenda.

Pursuant to Sections 4, 7 and 8 of the Charter of the City of Miami, a general municipal election of
Commissioners Districts 1, 2 and 4 shall be held on November 4, 2003. If no candidate receives a
majority vote, a runoff election is to be held on November 11, 2003. November 11, 2003 is
Veterans Day holiday; therefore, we request that the runoff election be scheduled for November 18.
2003.
Please prepare a resolution making provisions to hold a general municipal election on November 4.
2003 and a runoff election, if necessary, on November 18, 2003.
Enclosed is a copy of Resolution No. 01-711, which may assist you in drafting the requested
legislation. We are scheduling this item on the June 12, 2003 agenda for consideration, review and
adoption by the City Commission. The deadline to submit items to the Agenda Office for the June
12'' Commission meeting is May 16th.
