RESOLUTION NO. X13 679
A RESOLUTION OF THE MIAMI CITY COMMISSION
AUTHORIZING THE CITY MANAGER TO TAKE ANY
ACTIONS NECESSARY OR REQUIRED TO REQUEST
THAT FLORIDA DEPARTMENT OF TRANSPORTATION
AMEND THE STREET TREE SPACING STANDARDS FROM
ONE HUNDRED THIRTY (130) FEET TO A MAXIMUM
OF THIRTY (30) FEET ALONG THE SIDEWALKS ON
BOTH SIDES OF BISCAYNE BOULEVARD, AND WITHIN
MEDIANS, BETWEEN NORTHEAST 37TH STREET AND
NORTHEAST 87TH STREET, MIAMI, FLORIDA (CITY
LIMITS).
WHEREAS, the Florida Department of Transportation standards
require a minimum of one hundred thirty (130) feet between large
canopy shade trees or palms (approximately one to two shade
trees per block) for sight -line clearance related to vehicle
speeds; and
WHEREAS, the City of Miami seeks a configuration of a
continuous canopy of shade at a maximum of thirty (30) feet on
center where all shade trees are linearly aligned to the face of
the curb to provide pedestrian safety, shade, and comfort while
conforming to the safety standards of the Florida Department of
Transportation; and

WHEREAS, the configuration would continue the full length
of the boundaries of the Upper Eastside Biscayne Boulevard
street improvement project from Northeast 37th Street to
Northeast 87th Street, Miami, Florida (City limits); and
WHEREAS, the City of Miami Department of Planning and
Zoning has met with the community of the Upper Eastside, which
supports the proposal for a continuous canopy of shade along the
corridor; and
WHEREAS, rows of trees closely spaced characterize great
boulevards and become significant elements to define such
streets;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are adopted by reference and
incorporated as if fully set forth in this Section.
Section 2. The City Manager is authorized!' to take any
actions necessary or required to request that Florida Department
of Transportation amend the street tree spacing standards from

one hundred thirty (130) feet to a maximum of thirty (30) feet
along the sidewalks on both sides of Biscayne Boulevard, and
within medians, between Northeast 37th Street and Northeast 87th
Street, Miami, Florida (City limits).
Section 3. This Resolution shall become effective
immediately upon its adoption and signature of the Mayor.�'

If the Mayor does not sign this Resolution, it shall become
effective at the end of ten calendar days from the date it was
passed and adopted. If the Mayor vetoes this Resolution, it
shall become effective immediately upon override of the veto by
the City Commission.
