RESOLUTION NO. 03- 597
A RESOLUTION OF THE CITY MIAMI COMMISSION,
WITH ATTACHMENT(S), AMENDING RESOLUTION
NO. 01-1029 TO NARROW THE BOUNDARIES OF THE
LITTLE HAITI PARK PROJECT ("PARK PROJECT") BY
CHANGING TO THE FOLLOWING BOUNDARIES:
NORTHEAST 64TH TERRACE AS THE NORTHERN
BOUNDARY BETWEEN NORTHEAST 2ND AND 4TH
AVENUES, AND EXCLUDING THE AREA EAST OF
NORTHEAST 4th AVENUE TO THE FLORIDA EAST
COAST RAILROAD ("FEC") RAILROAD TRACKS
BETWEEN NORTHEAST 62ND AND 67TH STREETS,
MIAMI, FLORIDA (SEE "EXHIBIT A"), TO MINIMIZE
THE POTENTIAL LOSS OF JOBS IN THE AREA; AND
FURTHER DIRECTING THE CITY MANAGER NOT TO
ACQUIRE ANY PROPERTY THAT HAS BEEN HOMESTEAD
EXEMPTED AS OF JANUARY 1, 2001, FOR THE
PURPOSES OF ACQUIRING LAND FOR THE PARK
PROJECT.
WHEREAS, on September 25, 2001, the City Commission adopted
Resolution No. 01-1029 which directed the City Manager to take
all steps necessary to initiate and implement the development of
a first-class park in the Little Haiti area ("Park Project"); and
WHEREAS, the boundaries for the Park Project as established
by the City Commission were to be from Northeast 59th Street to
Northeast 67th Street between Northeast 2nd Avenue and the
Railroad Tracks; and

WHEREAS, on April 11, 2002, the City Commission adopted
Resolution No. 02-395 which directed the City Manager to expedite
the land acquisition for the Park Project approved in the $255
Million Homeland Defense/Neighborhood Improvement Bond Issue; and
WHEREAS, on May 8, 2003 the City Commission directed the
City Manager not to acquire any property homestead exempted
property as of January 1, 2001; and
WHEREAS, on May 8, 2003 the City Commission instructed the
City Manager to restudy and narrow the boundaries of the Park
Project to minimize the potential loss of jobs in the area; and
WHEREAS, based on the Post Buckley Schuh & Jernigan, Inc.
Report, the City Administration studied the proposed boundaries
and determined that approximately 24 businesses employing
approximately 378 employees would be preserved; and
WHEREAS, the City Administration recommends that the Park
Project boundaries be amended by making Northeast 64th Terrace
the northern boundary between Northeast 2nd and 4th Avenues and
excluding the area East of Northeast 4th Avenue between Northeast
62nd and 67th Streets (See "Exhibit A");

NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA;
Section 1. The recitals and findings contained in the
Preamble to this Resolution are adopted by reference and
incorporated as if fully set forth in this Section.
Section 2. Resolution No. 01-1029, adopted September 25,
2001, is amended to narrow the boundaries of the Little Haiti
Park Project ("Park Project") as follows::1

Section 3. The City Manager is directed not to acquire
any property homestead exempted as of January 1, 2001 for the
purposes of acquiring land for the Park Project.

Section 4. This Resolution shall become effective

If the Mayor does not sign this Resolution, it shall become
effective at the end of ten calendar days from the date it was
passed and adopted. If the Mayor vetoes this Resolution, it
shall become effective immediately upon override of the veto by
the City Commission.

RECOMMENDATION:
It is respectfully recommended that the City Commission adopt the attached Resolution amending
Resolution No. 01-1029 to narrow the boundaries of the Little Haiti Park Project (the "Park Project") as
established by the City Commission by making N.E. 64th Terrace the Northern boundary between NE 2
Avenue and NE 4th Avenue and excluding the area East of N.E. 4d' Avenue to the FEC Railroad Tracks
between NE 62 Street and NE 67 Street from consideration; see Exhibit "A". The purpose of amending the
boundary for the Park Project is to minimize the potential loss of jobs in the area. This Resolution further
directs the City Manager not to acquire property that has been homestead exempted as of January 1, 2001
for the purposes of acquiring land for the Park Project.
BACKGROUND:
On September 25, 2001 the City of Miami Commission adopted Resolution 01-1029 directing the City
Manager to take all steps necessary to initiate and implement the development of a first class park in the
Little Haiti area (the Park Project). The boundaries for the Park Project as established by the City
Commission are to be from Northeast 590' Street to Northeast 67th Street between Northeast 2nd Avenue and
the FEC Railroad Tracks.
On April 11, 2002 the City of Miami Commission adopted Resolution 02-395 directing the City Manager
to expedite the land acquisition for the Park Project approved in the $255 Million Homeland

On May 8, 2003 the City of Miami Commission directed the City Manager not to acquire property that has
been homestead exempted as of January 1, 2001 for the purposes of acquiring land for the Park Project and
further instructed the City Manager to restudy and narrow the boundaries of the Park Project in order to
minimize the potential loss of jobs in the area. Based on the Post Buckley Schuh & Jernigan, Inc. Report,
the City Administration studied the boundaries as proposed by the City Commission and determined that
