A RESOLUTION OF THE MIAMI CITY COMMISSION,
BY A FOUR-FIFTHS (4/5THS ) AFFIRMATIVE VOTE
AFTER A DULY ADVERTISED PUBLIC HEARING,
RATIFYING, APPROVING AND CONFIRMING THE CITY
MANAGER'S FINDING OF SOLE SOURCE; WAIVING
THE REQUIREMENTS FOR COMPETITIVE SEALED
BIDDING PROCEDURES AND APPROVING THE USE OF
THE SCAVENGER 2000 DEPOLLUTION VESSEL, FOR
THE DEPARTMENT OF MUNICIPAL SERVICES FOR

WHEREAS, the Department of Municipal Services wishes to use
the Scavenger 2000 Depollution Vessel for surface cleaning of
the City's waterfront, including the Miami River, navigable
canals, and Biscayne Bay; and

WHEREAS, the Scavenger 2000 Depollution Vessel has the
capability of treating the water, in addition to debris removal
and oil sheen recuperation, as it uses a decontamination and
oxygenating process that consists of deep injection of pure
oxygen into the waterways; and
WHEREAS, the Scavenger 2000 Depollution Boat can only be
acquired from Water Management Technologies, the sole source
provider, as the vessel has proprietary technology with a patent
pending due to its uniqueness; and
WHEREAS, the Chief Procurement Officer has adopted a
finding that Water Management Technologies is the only provider
of the Scavenger 2000 Depollution Vessel to provide this unique
and valuable service; and
WHEREAS, the finding of the Chief Procurement Officer has
been approved and adopted as the finding of the City Manager;
and
WHEREAS, the City Manager and the Acting Municipal Services
Director recommend that the requirements for competitive formal
sealed bids be waived and the procurement of the above service
as specified be approved;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:

Section 1. The recitals and findings contained in the
Preamble to this Resolution are adopted by reference and
incorporated as if fully set forth in this Section.
Section 2. By a four-fifths (4/5ths) affirmative vote,
after a duly advertised public hearing, the City Manager's
finding of sole source is ratified, approved and confirmed, the
requirements for competitive sealed bidding procedures are
waived, and the use of the Scavenger 2000 Depollution Vessel is
approved for the Department of Municipal Services for surface
cleaning of the City's waterfront utilizing a unique proprietary
process from Water Management Technologies, the sole source
provider, for a total amount not to exceed $200,000, with funds
allocated in amounts not to exceed (1) $50,000 from the Public
Works Operations Budget Account No. 001000.311002.6.670,
(2) $50,000 from General Fund - Non Departmental Account
No. 001000.921002.6.930, (3) $75,000 as in-kind contributions
from the Florida Export Finance Corporation, and (4) $25,000
from the Miami River Commission.
Section 3. The City Manager is authorizedll to execute
an agreement, in a form acceptable to the City Attorney, with
Water Management Technologies, for said purpose.

requirements that may be imposed by the City Attorney, including but
not limited to those prescribed by applicable City Charter and Code
provisions.

It is respectfully recommended that the City Commission adopt the attached Resolution
by a four-fifths (4/5ths) affirmative vote of the members of the City Commission, after a
duly advertised public hearing, ratifying, approving and confirming the City Manager's
finding of sole source, waiving the requirements for competitive sealed bids, and
approving the acquisition of the unique services of the "Scavenger 2000 Depollution
Boat" from Water Management Technologies, located at 1510 S.W. 13 Street, Ft.
Lauderdale, Florida 33312 for surface cleaning of the City's waterfront, for a total
amount not to exceed $200,000.00. Funding has been secured in the amounts of
$50,000 from the Public Works Operations Budget Account Number
001000.311002.6.670 and $50,000 from the General Fund — Non Departmental
Account Number 001000.921002.6.930. The City will also receive in-kind contributions
in the amount of $75,000 from the Florida Export Finance Corporation and $25,000 from
the Miami River Commission totaling $100,000.
BACKGROUND
The utilization of the "Scavenger 2000 Depollution Boat" from Water Management
Technologies will help reduce the contamination and pollution of the waters at the Miami
River, navigable canals and Biscayne Bay. This vessel is a surface trash collector and
uses a decontamination and oxygenation process that is proven to be beneficial to all
navigable waterways encountered by deep injection of pure oxygen. In addition, 262
outfalls will be cleaned as part of the National Pollutant Discharge Environmental
System (NPDES) Permit educational requirements.

Acquisition of Services Utilizing
Scavenger 2000 Depollution Boat
An investigation was conducted by staff to determine whether Water Management Technologies, located at
at 1510 S.W. 13 Street, Ft. Lauderdale, Florida 33312, is the sole source service provider for the surface
cleaning of the City's waterfront utilizing a decontamination and oxygenation process, for the Department of
Municipal Services, Public Works Division.
The Department of Municipal Services is requesting the utilization of the "Scavenger 2000 Depollution
Boat" from Water Management Technologies. This vessel will be used to clean and decontaminate the
Miami River, Biscayne Bay, and all navigable tributaries and canals, and has the capability of treating the
water, in addition to debris removal and oil sheen recuperation. Additionally, 262 outfalls will be cleaned as
part of the National Pollutant Discharge Environmental System (NPDES) Permit educational requirements.
The Scavenger 2000 Depollution Boat is a surface trash collector and uses a decontamination and
oxygenation process that has proven to be beneficial to all navigable waterways encountered by deep
injection of pure oxygen into the waterways. The City, along with the Miami River Commission, desires to
allow this unique technique to be utilized in the navigable water within the City. According to Water
Management Technologies, its Scavenger 2000 Depollution Boat contains proprietary technology, with a
patent pending, unique only to the Scavenger 2000. Further, the Florida Export Finance Corporation, created
and funded by the State of Florida, and the District of Columbia, Water and Sewer Authority, also
determined the vessel to have proprietary technology for the treatment of water for detoxification and this
technology was not available on other types of cleaning vessels.
Accordingly, I am recommending that the requirements for formal competitive sealed bidding be waived,
and these findings be approved: Florida Transportation Systems, Inc., located at 1510 S.W. 13 Street, Ft.
Lauderdale, Florida 33312, is the sole source service provider for the utilization of the Scavenger 2000
Depollution Boat, with a total amount required for the contractual services with Water Management
Technologies not to exceed $200,000. Funding has been secured in the amounts of $75,000 from the
Florida Export Finance Corporation; $25,000 from the Miami River Commission; $50,000 from the
Public Works Operating Budget Account Number 0 000.311002.6.670 and $50,000 from General
Fund —Non Departmental Account Number 0010.92 1002.6.930.

This Department is requesting your determination and approval that an award may be made on
a sole -source basis for the "Scavenger 2000 Depollution Boat".
The technology used by this vessel is unique and is not available on other types of cleaning
vessels. This vessel is a surface trash collector, and in addition, uses a decontamination and
oxygenating process that is proven to be beneficial to all navigable waterways which consists of
deep injection of pure oxygen into the waterways. Please find two attached letters from the
Florida Export Finance Corporation and The District of Columbia Water and Sewer Authority
stating that the technology used by this vessel is considered unique and sole -source. This
Department, along with the Miami River Commission, desire to allow this technique to be used
in the navigable water within the City of Miami such as the Miami River, Biscayne Bay and all
the navigable tributaries. This department certifies that terms and conditions for award of a
contract have been negotiated so as to obtain the most favorable terms and conditions,
including price, which may be offered to other customers or clients by the proposed contractors.
The vessel will also clean the 262 outfalls located along the Miami River, all canals and
Biscayne Bay. This work will contribute to the efforts of the City of Miami to comply with the
National Pollutant Discharge Elimination System (NPDES) Permit requirements for cleaning of
outfalls and the waters of the State and the education of the public.
Please provide a determination for the "Scavenger 2000 Depollutant Boat" as a sole -source
service due to its unique cleaning and oxygenating technology so this department can proceed
with awarding a contract to Water Management Technologies.

For the past two years we have funded U.S.A. Pelican D.B.A. Water Management Technologies.
We initiaily investigated Pelican and found their vessel to be considered proprietary technology as
it has a patent pending. Other similar vessels exist for trash removal, however, the Scavenger
2000 has the capacity to also treat the water for detoxification. This proven and tested
simultaneous ability is, to the best of our knowledge, unique therefore we consider the Pelican
vessel to be `sole source."

The heart of the Scavenger 2000 vessel is
an advanced water treatment system utilizing
redundant oxidizers. The purpose of treating
the water that enters through the bow of the
vessel (approximately 36,487 liters per minute
that can be injected into the water to a depth
of 30') is to reduce or eliminate bacteria &
viruses and to improve the clarity of the water.
In addition it will oxidize inorganics, iron, etc.
while removing odors such as sulfur, nitrogen,
and organic odors. It is also effective in algae
control, it directly kills algae and algae food
source.
Generally, the activities of humans
add significant amounts of nutrients in the
form of nitrogen, phosphorus and hydrocar-
bons to the public waterways, channels, ports
and marinas. Numerous forms of life teem

The Scavenger 2000 aeration system
is very effective. This promotes the reoxy-
genation after treatment and revitalization of
the water in which the boat is operating. The
system can reach depths of up to 30 ft. this
function is accomplished by using the rear
deflector and the thrust of the turbine.

We have available on request, water
analysis reports of efficiency testing of this sys-
tem done in Ft. Lauderdale Fl. under the
supervision of Spectrum Laboratories. A
microscopic analysis by Dr. Andrew Rogerson
of Nova Southeastern University
Oceanographic Center was performed.
The results indicated the treatment
system on board our vessel is quite effective for
treatment of contaminated surface waters.
Maximum hourly injection reaches
up to 150 cubic meters of air, enriching the
water mass with 30,000 liters of oxygen.
This substantial oxygen enrichment con-
tributes directly to reducing toxins suspend-
ed in the water.

NOTICE OF PUBLIC HEARING
A public hearing will be held by the Commission of the City of Miami, Florida,
on May 22, 2003, at 9:00 a.m., in the City Commission Chambers at City Hall,
3500 Pan American Drive, Miami, Florida, for the purpose of waiving the
requirements of obtaining sealed bids for the acquisition of the unique services of
the "Scavenger 2000 Depollution Boat" from Water Management Technologies,
located at 1510 S.W. 13 Street, Ft. Lauderdale, Florida 33312 for surface cleaning
of the City's waterfront, for the City of Miami, for a total amount not to exceed
$200,000.00. Funding has been secured in the amounts of $50,000 from the
Public Works Operations Budget Account Number 001000.311002.6.670 and
$50,000 from the General Fund - Non Departmental Account Number
001000.921002.6.930. The City will also receive in-kind contributions in the
amount of $75,000 from the Florida Export Finance Corporation and $25,000
from the Miami River Commission totaling $100,000.
Inquiries from other potential sources who feel that they might be able to satisfy
the City's requirements for this item may contact the Department of Purchasing,
attention Pamela Burns, CPPB, Sr. Procurement Contracts Officer, at (305) 416-
1905.
All interested persons are invited to appear and may be heard concerning the
proposed sole source determination. Should any person desire to appeal any
decision of the City Commission with respect to any matter considered at this
hearing, that person shall ensure that a verbatim record of the proceedings is
made, including all testimony and evidence upon which any appeal may be based

TYPE OF PURCHASE: Short Term Contract
REASON: The Department of Municipal Services, Public
Works Division, is seeking, from Water
Management Technologies, the utilization of
its Scavenger 2000 Depollution Boat to surface
clean the City's waterfront and help reduce the
contamination and pollution of the waters at the
Miami River, navigable canals, and Biscayne Bay,
utilizing its unique and proprietary technology.
RECOMMENDATION: It is recommended that the Department of
Municipal Services be authorized to secure the
services of Water Management Technologies,
the sole source provider, to provide its
Scavenger 2000 Depollution Boat to clean the
City's waterways, for a total amount not to
exceed $200,000; with funding in the amount
of $75,000 from the Florida Export Finance
