A RESOLUTION OF THE MIAMI CITY COMMISSION,
WITH ATTACHMENT(S), BY A FOUR-FIFTHS (4/5 THS)
AFFIRMATIVE VOTE, RATIFYING, APPROVING AND
CONFIRMING THE CITY MANAGER'S FINDINGS OF AN
EMERGENCY(S), WAIVING THE REQUIREMENTS FOR
COMPETITIVE SEALED BIDDING PROCEDURES AS
DESCRIBED ON THE EXHIBIT(S) ATTACHED AND
INCORPORATED; ALLOCATING FUNDS FROM THE
BUDGETS OF VARIOUS USER DEPARTMENT ACCOUNTS.
BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. By a four-fifths (4/5th,) affirmative vote,
the City Manager's findings of an emergency(s), waiving the
requirements for competitive sealed bidding procedures as
described on the exhibit(s) attached are ratified, approved and
confirmed, with funds allocated from the budgets of various user
department accounts.

Section 2. This Resolution shall become effective
immediately upon its adoption and signature of the Mayor.11

It is hereby requested that the City Manager issue a finding that it is necessary to procure
the services of an experienced firm to conduct a survey of AT&T Broadband customers
for the purpose of ascertaining the level of performance of AT&T Broadband in the
delivery of cable television services on. an emergency basis by executing the necessary
documents, in a form acceptable to the City Attorney, for this acquisition. It has been
opined by Maria Chiaro, Assistant City Attorney, that the motion 02-223, passed by the
Miami City Commission on March 7, 2002, and motion 02-158, passed by the Miami
City Commission on February 14, 2002, do not carry the force and effect of law nor do
these motions substitute the requirements of the Procurement Code. Therefore it has been
determined to be necessary to request the City Manager to issue -'a finding of an
emergency for the procurement of these services.

This memorandum serves to request that the current Professional Services Agreement for executive
search firms be increased on an emergency basis by 5200,000. This amount would cover services on an
as -needed basis through November 2004, the remaining optional renewal period of the contract.
Pursuant to Resolution 00-989, adopted on November 16, 2000, the Miami City Commission approved a
list of pre -qualified proposers to provide executive search services for the Department of Human
Resources at an estimated cost not to exceed S 100,000 for said services, for the entire term of the contract
(through November 2004). However, during fiscal year 2002, several executive level positions became
vacant, resulting in the need to utilize the services of several executive search funis. To date,
approximately $42,000 has been allocated for executive search services. Prior to the end of the fiscal
year, it is projected that an additional amount of approximately 584.000 will be required to fund the
following executive recruitments:
1) Labor Relations Officer $18.117.50
2) Human Resources Director 25,750.00
3) Community Development Director 27,900.00
4) Risk Management Administrator 11.500.00
TOTAL. $83,267.50
To avoid an interruption in services, it is requested that you approve on an emergency basis, an increase
of 5200,000 through November 2004 in the current Professional Services Agreement for executive search
• serviceamith approximately $84,000 to be allocated for this fiscal year. Should you approve this
request, legislation ratifying this emergency action will be submitted for inclusion on the October 10,
2002, City Commission Agenda.
