WITH ATTACHMENT(S), BY A FOUR-FIFTHS (4/5THS )
AFFIRMATIVE VOTE, RATIFYING, APPROVING AND
CONFIRMING THE CITY MANAGER'S FINDINGS OF AN
EMERGENCY(S), WAIVING THE REQUIREMENTS FOR
COMPETITIVE SEALED BIDDING PROCEDURES AS
DESCRIBED ON THE EXHIBIT(S) ATTACHED AND
INCORPORATED; ALLOCATING FUNDS FROM THE

BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. By a four-fifths (4/5th,) affirmative vote,
the City Manager's findings of an emergency(s), waiving the
requirements for competitive sealed bidding procedures as
described on the exhibit(s) attached are ratified, approved and
confirmed, with funds allocated from the budgets of various user
department accounts.

The Department of Fire -Rescue respectfully requests your approval for an emergency purchase order for
the construction of a Motorola equipment room from R.L. Fenton Construction, a Dade/Hispanic vendor
located at 275 Fontainebleau Blvd., Suite 170, Miami, Florida, 33172, for a total amount not to exceed
$37,464.00.
As you are aware, the City is in the process of converting a portion of the Fire College for Fire -Rescue
dispatch operations, and as a backup to police dispatch operations. On October 25, 2001, Resolution Nos.
01-1134 and 01-1135 was adopted and passed by the City Commission authorizing the acquisition of a
turn -key process for installation of equipment, components and accessories to upgrade the existing City
of Miami MHz trunked radio system and for the acquisition, installation, optimization and interface of
the CM6HC digital microwave system with the 800 MHz trunked radio system on behalf of the General
Services Administration, in an amount not to exceed $7,439,143. This upgrade will improve the
reliability of the system, and will provide the City with a technology that enables the revitalized system
to have a life expectancy well into the next decade, and will ensure the continued safety of the City's
firefighters, police officers and residents.
A blanket purchase order was issued by the Purchasing Department in March 2002, for acquisition of
communication equipment, installation and upgrades. Recently, the General Services Administration
advised our department that said aforementioned communication equipment is scheduled for delivery in
mid July 2002. However, the Department of Fire -Rescue does not have an existing room to
accommodate the Motorola communication equipment; whereas, required in the existing contract
between the City of Miami and Motorola, Inc. Time is critical and the Department of Fire -Rescue has an
immediately need for the construction of a Motorola equipment room to be completed by mid July 2002
to begin the upgrades and installation of said communication equipment. This room will be located on
the sixth floor of the existing Fire College Training Facility, at 3425 Jefferson Street, Coconut Grove,
Florida.
The Motorola equipment room will house the microwave equipment that is a critical component of the
City's communication system including the Department of Police and Fire -Rescue. Also, this Motorola
room will house the Central Electronic Bank (CEB) and the back-up emergency power system. The
Department of Fire -Rescue Support Services Division has prepared and submitted specifications to three
(3) vendors requesting informal bids. We have received written quotes from two (2) of these vendors,
and the lowest responsible and most responsive bidder was R.L. Fenton Construction.

It is imperative that we construct this Motorola equipment room immediately to ensure this first line
equipment is not damaged or interrupted upon installation and to avoid additional cost of $200,000 to
have the equipment relocated to its final destination.
Should you approve this purchase, funding is available in the amount of $37,464.00, from the Capital
Improvement Project Number 313302, Account Code 289301.6.860, as funded by the Fire Assessment.

The Department of Fre-Rescue respectfully requests the emergency replacement of roofs 214Fue Station
No. 3/Fire riarage complex roofs. The emma status of these roofs is deplorable; they have leaks in
several locations. They have been repaired. an numerous occasions, but their age and condition warrants
complete replacement. Continual repairs Mill no longer solve the problem and just lead to increase for
substructure repairs.
Based on your approval granted on the attached memorandum for the emergency roofs installation at Fire
Station No. 31Fire Garage complex roofs, the Departmam of Fre-Rescue and Public Works prepared
specifications and submitted them to six (6) -companies for bids The bids were evaluated and the most
responsive bidder was Weiss do Woolrich Southern Enterprises, Inc., 1431 SW 30* Avenue, Deerfield
Beach, Florida 33442.
In addition, Independent Roof Testing and Consultant (IRT) conducted a Roof.' Moisture and Visual
-= Survey, comprising of 7 main roofs on three separate buildings with approximately 38.000 square foot.
As result of the surveLv the following are necessary:
1) Remove existing roofing and LWC down to structural deck
2) Install a new roof over rigid insulation.
3) The parapet walls should be encapsulated with the roof membrane, and a metal coping at the top.
The rising walls' will need waterproofing with a good quality Elastomeric coating. Sorra stucco
repair will be necessary as well.
To accomplish these goals, it will be necessary to increase the initially approved fimdmg for the roofs
installation from 5207,620.00 to 5350,200.00. This increase is due to larger than anticipated Costs to
install and remove the old roofing.
Funding for roof installation is available in the amount of $350,200.00 from CIP Project 313302, Account

At the inspection of the Fire Station No. 3/Fire Garage complex roofs, it was
apparent that these roofs were in poor condition and had been leaking for sotne
time. The older roofs over Fire Station No. 3 and the Fire Garage Building were
visibly deteriorated and were at the end of their designed service fife. The roofs over
the Firefighters Credit Union and the adjacent Administration/Warehouse building
apparently had roof leak problems since they were originally constructed. It is very
apparent that a major roof replacement on these buildings is needed as soon as
possible.
The South Florida_Building Code and therefore our Building Department requires
specific roof tests to be performed and submitted as part of a re -roofing permit
application. A moisture survey and asbestos test reports are required for each roof
area. Roof cores will be taken. If there is lightweight concrete in the roof deck to
which the roof base sheet is fastened, then roof fastener pull tests and calculations
are also required. The representative of Independent Roof Testing and Consulting
(IRT) provided us with a proposal to conduct the required roof tests and to make
recommendations on the roof membrane system and specific flashing and
waterproofing details for complete and durable roof replacement project
We have a copy of your authorization of the IRT proposal to conduct the required
roof tests and to make roofing system recommendations. The estimated costs of
these tests will be in excess of the $4,500 limit for City Manager approval. In this
case, because of the need for immediate repairs, we recommend that the Fire and
Rescue Department send an "Emergency Finding" memo to the City Manager
indicating the need and request approval to have the testing done in the amount of
the proposaL In addition, the Fire Department should request authorization to
receive informal bids and have the roof replacement work done under "Emergency"
purchasing procedure.

During a roof inspection conducted by Captain Frank Moore, Deputy of Support
Services; Allan Poms, Chief Architect and Fernando Paiva Architect II, of Fire Station
No. 3, and the Fire Garage complex roofs, it was determined that these roofs were in
poor condition and leaking. It is apparent that a major roof replacement on these .
buildings is needed as soon as possible.
The South Florida Building code and therefore our Building department requires specific
roof tests to be performed and submitted as part of a re -roofing permit application.
Independent Roof Testing and Consulting (IRT) has provided us with a proposal to
conduct the required roof tests and to make recommendations on the roof membrane
system and specific flashing and waterproofing details for a complete and durable roof
replacement project.
The City of Miami Department of Fre-Rescue respectfully requests approval to have the
testing done by Independent Roof Testing and Consulting (IRT) for the amount of
$7,620.00.
In addition, the Department of Fire -Rescue is requesting authorization to receive
informal bids and have the roof replacement work done under "Emergency purchasing
procedures". The total amount for the roof replacement will not exceed $20,000.00.
Therefore, the Notal cost of this project will be $207,620.00. Funding is available in Fire
Assessment Fee Account Code 3133 .289301.270.

This memorandum will serve to request an immediate response from all
department directors that have outstanding disaster recovery projects associated
with the October 2000, Flood, bisaster 1345 -FL.
As per FEMA and the Code of Federal Regulations 44 CFR, small projects (below
$ 54,000.00) must be completed within one year of the disaster declaration date
and large projects must be completed within 18 months of 'the same date. The
declaration date for Disaster 1345 is October 2, 2000. We are already beyond
the small project deadline and are operating on a temporary grace period for the
small projects. The large project deadline is close at hand and there is a great
deal of Federal funding at stake.
The attached spreadsheet shows the entire pending project worksheets along
with the associated department, which is responsible for the project
All Department Directors that have pending projects must submit a response
detailing:
1. Status of the project.
2. Written explanation/justification for the delay.
3. A projection of the extension required to complete the referenced
project along with a projected completion date.
This is the third time this information is requested. It is imperative that you
respond by Friday March 29th, 2002 in order to prevent the loss of approved
funding. Responses should be forwarded to Bashir Wayne, Hazard Mitigation &
Recovery Specialist, Department of Fire -Rescue.

206.205 (a): "The Federal payment for small projects shall not be reduced if all
of the approved funds are not spent to complete a project However, failure to
complete may require that the Federal payment be refunded".- Therefore, any
small projects under S50,600 still pending and not yet completed will require a
time extension from the STATE OF FLORIDA/FENLL-k.

declared an emergency (FEMA -I3 -DR -FL) for the counties of
Miami -Dade, Broward, Monroe, and Collier; and
WHEREAS, the Federal Emergency Management Agency (-FOW)
has made federal funds available for disaster relief activities
in said Counties pursuant to FEMA -I3 -DR -FL; and

funds from FSMA, through the State of Florida, as reimbursement
for eligible costs incurred by the City of Miami for disaster
relief activities;

OF MIAMI, MAMMA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference and
incorporated as if fully set forth in this Section.
Section 2. The City Manager is hereby authorizedil to
execute a Disaster Relief Funding Agreement ('Agreement), in a
form acceptable to the City Attorney, with the State of Florida,
Department of Comummity Affairs, for the purpose of accepting
Federal Emergency Management Agency (FEMA") grant -funds for
reimbursement of emergency relief expenses incurred by the City
of Miami during and in the aftermath of the October South Florida
floods.
Section 3. The City Manager is further authorized to
submit related claims to FEMA and to accept payments for same.
