A RESOLUTION OF THE MIAMI CITY COMMISSION,
WITH ATTACHMENT(S), BY A FOUR-FIFTHS (4/5THS )
AFFIRMATIVE VOTE, RATIFYING, APPROVING AND
CONFIRMING THE CITY MANAGER'S FINDINGS OF AN
EMERGENCY(S), WAIVING THE REQUIREMENTS FOR
COMPETITIVE SEALED BIDDING PROCEDURES AS
DESCRIBED ON THE EXHIBITS) ATTACHED AND
INCORPORATED; ALLOCATING FUNDS FROM THE
BUDGETS OF VARIOUS USER DEPARTMENT ACCOUNTS.
BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. By a four-fifths (4/5ths) affirmative vote,
the City Manager's findings of an emergency(s), waiving the
requirements for competitive sealed bidding procedures as
described on the exhibit(s) attached are ratified, approved and
confirmed, with funds allocated from the budgets of various user
department accounts.

Supplement to Emergency Finding
For City Commission Chambers

ENCLOSURES:
This memo serves to request your authorization for a supplemental revision to the "Emergency
Finding" regarding the restoration and improvements to the City Commission Chambers at City
Hall dated July 3, 2002.
Ongoing work in the City Commission Chamber and in City Hall has encountered various Code
and Life Safety issues regarding numerous wiring deficiencies. Additionally, these wiring
deficiencies are below current standards in technology precluding expansion and improvements
to levels of service. This supplement is to authorize the City to pursue correcting these
deficiencies mostly through the existing contract with Miami Business Telephone Corp.,
purchasing hardware through Coleman Technologies and minor construction work through
McCartney Construction. The cost for this work is estimated to be no higher than $ 110,000.
Due to the emergency nature, available funding has been identified in CEP No. 311049.
However, your approval below will allow for these costs to be transferred to the City
Hall Renovations project, CIP No. 311050, upon appropriation of additional funds. If approved,
this "EMERGENCY FINDING" will be placed on the next available City Commission Agenda
for ratification and approval after the construction is completed.

Based on my investigation of numerous stormwater flooding complaints throughout the
City, 1 have found that an EMERGENCY exists which justifies the selection of a
contractor by informal bids.
As a result of severe rainstorms, - the City has experienced stormwater flooding at
different localized sites. The mogr6de of the work exceeds the construction capability
of the Public Works Operations Division and the services of a private contractor arc
needed. The construction work must begin immediately at the locations fisted in the
Attachment to address the c=W rainy season.
Because of the severe flooding at these locations, there is a need for extraordinary
measures to expedite the installation of adequate stormwater drainage systems. in order
to initiate the construction of the new stormwater drainage systems as soon as possible.
formal competitive sealed bid procedures shall 'be waived for the. procurement of
contracting services required for said EMERGENCY pursuant to sections 1 "3 and 16-
84 of the City Code.' Informal bids shall be obtained and a contract shall be awarded to
the lowest responsive and responsible bidder. Alf costs of this project will be funded from
the CIP No. 352216. Estimated total cost for the project is $806,100.00. This action shall
be ratified at the next available City Commission meeting.
