HomeMy WebLinkAboutR-03-0559J-03-292 03/19/03 RESOLUTION NO. 03- 559 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), BY A FOUR-FIFTHS (4/5 T11 ) AFFIRMATIVE VOTE, RATIFYING, APPROVING AND CONFIRMING THE CITY MANAGER'S FINDINGS OF AN EMERGENCY(S), WAIVING THE REQUIREMENTS FOR COMPETITIVE SEALED BIDDING PROCEDURES AS DESCRIBED ON THE EXHIBIT(S) ATTACHED AND INCORPORATED; ALLOCATING FUNDS FROM THE BUDGETS OF VARIOUS USER DEPARTMENT ACCOUNTS. BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. By a four-fifths (4/5th,) affirmative vote, the City Manager's findings of an emergency(s), waiving the requirements for competitive sealed bidding procedures as described on the exhibit(s) attached are ratified, approved and confirmed, with funds allocated from the budgets of various user department accounts. Palacino, Director ' REFERENCES: Capital Improvements Dep ment List of Complaints for E-78 ENCLOSURES: Based on my investigation of numerous stormwater flooding complaints throughout the City, I have found that an EMERGENCY exists which justifies the selection of a contractor by informal bids. As a result of severe rainstorms, - the City has experienced stormwater . flooding at different localized sites. The magnitude of the work exceeds the construction capability of the Public Works Operations Division and the services of a private contractor are needed. The construction work must begin immediately at the locations listed in the Attachment to address the current rainy season. Because of the severe flooding at these locations, there is a need for extraordinary measures to expedite the installation of adequate stormwater drainage systems. In order to initiate the construction of the new stormwater drainage systems as soon as possible, formal competitive sealed bid procedures shall be waived for the. procurement of contracting services required for said EMERGENCY pursuant to sections 18-83 and 18- 84 of the City Code.* Informal bids shall be obtained and a contract shall be awarded to the lowest responsive and responsible bidder. All costs of this project will be funded from the CIP No. 352216. Estimated total cost for the project is $806,100.00. In order to immediately address- urgent requests from citim= and avoid property damage and health coerce = due to critical flooding problems, the following locations must be added to this project: • 1821 S.W. 11 Street • 2104 S.W. 11 Street • 4049 Ensefiada Avenue • 3390 N.W. 19 Street • 3730 S.W. 27 Lane • 1809 N.W. 33 Steed The total extra work results is a S 150,000 increase to the contract. 'This memo is to request an increase to the currant coastniction contract. Funding for the S150,000.00 increase' is available in CEP account number 352216.
