A RESOLUTION OF THE MIAMI CITY COMMISSION,
WITH ATTACHMENT(S), BY A FOUR-FIFTHS (4/5 THS )
AFFIRMATIVE VOTE, RATIFYING, APPROVING AND
CONFIRMING THE CITY MANAGER'S FINDINGS OF AN
EMERGENCY(S), WAIVING THE REQUIREMENTS FOR
COMPETITIVE SEALED BIDDING PROCEDURES AS
DESCRIBED ON THE EXHIBIT(S) ATTACHED AND
INCORPORATED; ALLOCATING FUNDS FROM THE
BUDGETS OF VARIOUS USER DEPARTMENT ACCOUNTS.
BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. By a four-fifths (4/5th,) affirmative vote,
the City Manager's findings of an emergency (s), waiving the
requirements for competitive sealed bidding procedures as
described on the exhibit(s) attached are ratified, approved and
confirmed, with funds allocated from the budgets of various user
department accounts.

Section 2. This Resolution shall become effective
immediately upon its adoption and signature of the Mayor.!'

Miami High School Bungalow -
Relocation and Stabilization Project

This memorandum serves to request your authorization for an "EMERGENCY
FINDING" waiver of formal bids and building permit fees and the award of a purchase
order contract for the relocation and stabilization of the original Miami High School
Bungalow building.
At the October 10, 2002 City Commission meeting, a resolution was passed authorizing
the City Manager to schedule a public hearing at a regular Commission meeting on
October 29, 2002 to consider the donation of the original Miami High School Bungalow
building to the City. If the donation is approved by the Commission, the City Manager is
authorized to execute an agreement with the donor to transfer the building to the City
and to accept two (2) donations from the Dade Heritage Trust totaling $76,351 for the
moving and stabilization of the Bungalow building. The Commission also passed
another resolution authorizing the City Manager to negotiate and execute a Professional
Services Agreement in the amount of $67,500 with R.J. Heisenbottle Architects, PA. to
prepare construction documents and provide construction administration services for
the project. The architect has been sent a "Notice to Proceed".
The project consists of moving the original Miami High School building from its present
site at 79 SW 12 Street to a nearby site in South Side Park at 100 SW 11 Street. The
building needs to be restored to its original appearance. Later it will be renovated for
use as a municipal, public, civic, educational or related facility. To relocate the building
the roof structure must be removed in order to pass under the adjacent MetroMover
guideway structure. The project has a very tight time schedule and, according to Asset
Management, the Bungalow must be relocated no later than January 11, 2003, as per
an agreement with the donor. In order to meet the above relocation schedule and for
the convenience of the City under Sec. 18-84 of the Miami Code, it is recommended
that formal bids and building permit fees be waived and that a purchase order contract
be awarded to the lowest responsive and responsible bidder for the relocation,
stabilization and related restoration work of the Miami High School Bungalow building.

There is existing funding available under CIP 327001 `Historic Preservation Initiatives"
of up to $250,000 through the Homeland Defense Neighborhood Improvements Bond.
This existing fund should cover the architectural services and the Bungalow relocation.
The anticipated donations from Dade Heritage Trust in the amount of $76,351 will be
used to restore the building. The architect's preliminary estimate of probable relocation
' cost is approximately $250,000. If app rov , the EMERGENCY FINDING will be placed
on the next available Commission or satisfaction and approval.

We are requesting your authorization to award a purchase order contract to Tumkey
Construction Inc. in the amount of $258,000 for the relocation and stabilization of the original
Miami High School Bungalow building.
On December 17"' the Department of Capital Improvement (CIP) received bids on the above
referenced project. It is necessary to update the original "EMERGENCY FINDING" dated
10/21/02 in order to expedite the purchase order contract between the City and the low bidder,
Turnkey Construction Inc.
The total amount of funds currently available in the project CIP No. 327001 is $326,351. After
00.s`' educting tWfee he amount remaining for construction is $258,851. The total base bid from
4the low bidder is $270,800 which covers the relocation and stabilization of the Bungalow
�6 '"'k�u building. There are two (2) additive alternate bids. One is for restoring the porch in the amount
of $43,000 and the other is for installing shaker shingles in the amount of $29,000. The primary
goal is to relocate the Bungalow within available funds. To achieve this goal, the architect will
issue a post bid addendum to delete a $10,000 cash allowance and delete another $2,800 by
value engineering, both of which are acceptable to the low bidder. Subject to this approval, a
purchase order contract will be issued for the immediate relocation and stabilization work for
which the City has an agreement with the developer who donated the Bungalow to the City.
Once the Bungalow is relocated, it is estimated that another $100,000 will be required later to
restore the porch, install shaker shingles, and do related restoration work to restore the
Bungalow to its original exterior appearance.

Based on a field investigation by our inspector and on the number of requests for curb
and - curb and gutter replacement at locations citywide, 1 have found that an
EMERGENCY exists concerning the condition of the concrete c urbbV which kistifies
increasing the contract of Metro Express, Inc., a Hispanic minority control corporation
with offices at 3594 SW 143 Court, Miami. Florida, 33175, by $130,000, from '$ 77,750,
to $ 207,750.
Due to the hazardous condition of the concrete subs at several locations citywide, it is
necessary that additional work be performed regard -ung replacement of concrete curb
and curb and gutter in order to improve safety within our neighborhoods.
This emergency increase of $130,000 to B-4646, is necessary in order to keep the curbs
and curb and gutters within the City of Miami in good condition and to protect the heath.

This is an amendment to previous EMERGENCY FINDING increasing the amount of
the contract with Metro Express, Inca for the sidewalk and curb and gutter replacements
at Citywide locations. The amount of this increase in contract is for $100,000, bringing
the total amount of the contract with Metro Express to $307,750.
It is imperative that we proceed with this increase in contract to replace the sidewalk
pavers on McFarlane Road, South side. The area has been demolished due to a joint
City/County project to rebuild McFarlane Road from Main Highway to South Bayshore
Drive. The City's contribution to this project is the replacement of the sidewalk pavers
at the South side of the roadway.
This increased amount of $100,000 is funded from Capital Improvement Project No.
341183. Prior increases in this contract are funded as follows from Capital
Improvement Project Nos. 341170 ($60,000) and 341182 ($70,000). This increase,
along with the prior increases, shall be ratified at the next available City Commission
meeting.
