A RESOLUTION OF THE MIAMI CITY COMMISSION,
WITH ATTACHMENT(S), BY A FOUR-FIFTHS (4/5 THS)
AFFIRMATIVE VOTE, RATIFYING, APPROVING AND
CONFIRMING THE CITY MANAGER'S FINDINGS OF AN
EMERGENCY(S), WAIVING THE REQUIREMENTS FOR
COMPETITIVE SEALED BIDDING PROCEDURES AS
DESCRIBED ON THE EXHIBIT(S) ATTACHED AND
INCORPORATED; ALLOCATING FUNDS FROM THE
BUDGETS OF VARIOUS USER DEPARTMENT ACCOUNTS.
BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. By a four-fifths (4/5ths) affirmative vote,
the City Manager's findings of an emergency(s), waiving the
requirements for competitive sealed bidding procedures as
described on the exhibit(s) attached are ratified, approved and
confirmed, with funds allocated from the budgets of various user
department accounts.

Section 2. This Resolution shall become effective
immediately upon its adoption and signature of the Mayor.11

passed and adopted. If the Mayor vetoes this Resolution, it shall

Emergency Increase in Contract

The Eaton Park Day Care Center Building is a priority project of the Safe Neighborhood
ParlF's Bond Program -'Ne project consists of the demolition of the old Eaton Park Day
Care Center Building and the construction of a new facility. The project was originally
bid and awarded in the amount of $384,995.00 to Jessla Construction Corporation.
Some project additions not anticipated when the contract was issued includes the removal
and disposal of asbestos and a new fence required by the Departmedt of Children and
Families.
In order to complete the project on a timely basis, the Department of Public Works is
requesting your approval to increase the contract of Jessla Constructiof� in the amount not
to exceed $50,000.00 from $384,995.00 to S 434,995.00. Funding in the amount of
$50,000.00 is available from CIP No 33-1369.
We are requesting your approval to authorize the contractor to proceed with the
additional work on an "emergency" basis.

EMERGENCY FINDING
Increase in Contract with
Greater Caribbean Energy
and Environment Foundation

Public Works Department Maintenance Project
On December 19, 2000, the City awarded the Citywide Canal Maintenance, Project B-5656
to Greater Caribbean Energy and Environment Foundation. The project work consists in the
cleaning of various City maintained canals and waterfronts and the spraying of aquatic
vegetation control chemical. This contract was for one year with two one-year renewals.
The contract was renewed for one year in December 2001. The present contract amount is
S 167,700.00.
A 0.6 mile section of Wagner Creek, not included in the canal cleaning contract, has
underwater debris, floatables and extensive creek bank vegetation that needs to be removed.
The creek obstructions seriously hamper the conveyance of water flow tb the Miami River.
Commissioner Gonzalez and residents along the creek request that the creek be cleaned and
cleared. Grater Caribbean Energy and Environmental Foundation (GCEEF),contractor, has
proposed to perform the work for 554,973.50. It is most important to clean the creek and
open this restriction to creek flow thereby preventing flooding in the headwater of Wagner
Creek in the Ailapattah arra.
This memo is to- request your approval to increase in the canal cleaning contract on an
emergency basis by $54,973.50 and to proceed with the work.
Funds for the aforesaid increase in contract are available from Public Works Salary Savings.
This request is that Public Works salary savings funds be transferred to increase GCEEF's
contract creek cleaning work. This finding of an emergency will be placed on the next
available agenda for ratification and approval by the City Commission.
