HomeMy WebLinkAboutR-03-0549J-03-282 03/19/03 RESOLUTION NO. 03— 549 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), BY A FOUR-FIFTHS ( 4 /5Tas ) AFFIRMATIVE VOTE, RATIFYING, APPROVING AND CONFIRMING THE CITY MANAGER'S FINDINGS OF AN EMERGENCY(S), WAIVING THE REQUIREMENTS FOR COMPETITIVE SEALED BIDDING PROCEDURES AS DESCRIBED ON THE EXHIBIT(S) ATTACHED AND INCORPORATED; ALLOCATING FUNDS FROM THE BUDGETS OF VARIOUS USER DEPARTMENT ACCOUNTS. BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. By a four-fifths (4/5th,) affirmative vote, the City Manager's findings of an emergency(s), waiving the requirements for competitive sealed bidding procedures as described on the exhibit(s) attached are ratified, approved and confirmed, with funds allocated from the budgets of various user department accounts. P1 September 10, 2002 02-03-007 =!L&5636 EMERGENCY FINDING Increase in Contract with Greater Caribbean Energy `=C" and Environment Foundation John H.Jac on Z� Director ENCLos'IR=s Citywide Canal Public Works_ Department Maintenance Project J -03-282 W7091 On December 19, 2000, the City awarded the Citywide Canal Maintenance, Project B-5656 to Greater Caribbean Energy and Environment Foundation. The project work consists in the cleaning of various City maintained canals and waterfronts and the spraying of aquatic vegetation control chemical. This contract was for one year with two one-year renewals. The contract was renewed for one year in December 2001. The present contract amount is S 167,700.00. A 0.6 mile section of Wagner Creek, not included in the canal cleaning contract, has underwater debris, floatables and extensive creek bank vegetation that needs to be removed. The creek obstructions seriously hamper the conveyance of water flow to the Miami River. Commissioner Gonzalez and residents along the creek request that the creek be cleaned and cleared. Greater Caribbean Energy and Environmental Foundation (GCEEF),contractor, has proposed to perform the work for $54,973.50. It is most important to clean the creek and open this restriction to creek flow thereby preventing flooding in the headwater of Wagner Creek in the Allapattah area. This memo is to- request your approval to increase in the canal cleaning contract on an emergency basis by 554,973.50 and to proceed with the work. Funds for the aforesaid increase in contract are available from Public Works Salary Savings. This request is that Public Works salary savings funds be transferred to increase GCEEF's contract creek cleaning work. This finding of an emergency will be placed on the next available agenda for ratification and approval by the City Commission. Ja on, Director Public Works Department _ 01-02-269 f-- 1,2002 RLE B4646 Emergency Finding Increasing amount of contract with Metra Express, Inc. for B-4646 CEFERENCES ENCLOSURES: Based on a field investigation by our inspector and on the number of complaints for curb and curb and gutter replacement at locations citywide, I have found that an EMERGENCY exists concerning the condition of the concrete curbing which justifies increasing the contract of Metro Express, Inc., a Hispanic minority control corporation with offices at 3594 SW 143 Court, Miami, Florida, 33175, by $70,000, from $ 77,750, to $147,750. Due to the hazardous condition of the concrete curbs at several locations citywide, it is necessary that additional work be performed regarding replacement of concrete curb and curb and gutter in order to improve safety within our neighborhoods. This emergency increase of $70,000 to B-4646, is necessary in order to keep the curbs and curb and gutters within the City of Miami in good condition and to protect the heath, safety and welfare of residents and the public. This action shall be ratified at the next available City Commission meeting. Based on a request of the Honorable Commissioner Tomas Regalado, and on the number of requests for curb and curb and gutter replacement at the Shenandoah area, I have found that an EMERGENCY exists miming the condition of the concrete curbing which justifies increasing the centrad of Metro Express, Inc., a Hispanic minority control corporation with offices at 3534 SW 143 Court, Miami, Florida, 33175, by $100,000, from $ 307,750, to $ 407,750. Due to the hazardous condition of the concrete curbs in the Shenandoah area, it is necessary that additional work be performed regarding replacement of concrete curb and curb and gutter in order to improve safety within this area. Refer to the attached location map. This emergency increase of $100,000 to B-4646, is necessary in order to keep the curbs and curb and gutters within the Shenandoah area in good condition and to protect the health, safety and welfare of residents and the public within his District. This increase is funded from the Quality of Life Bond money from a current appropriation (311714). This action shall be ratified at the next available City Commission meeting.
