A RESOLUTION OF THE MIAMI CITY COMMISSION,
WITH ATTACHMENT(S), BY A FOUR-FIFTHS (4/5 THS )
AFFIRMATIVE VOTE, RATIFYING, APPROVING AND
CONFIRMING THE CITY MANAGER'S FINDINGS OF AN
EMERGENCY(S), WAIVING THE REQUIREMENTS FOR
COMPETITIVE SEALED BIDDING PROCEDURES AS
DESCRIBED ON THE EXHIBITS) ATTACHED AND
INCORPORATED; ALLOCATING FUNDS FROM THE
BUDGETS OF VARIOUS USER DEPARTMENT ACCOUNTS.
BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. By a four-fifths (4/5ths) affirmative vote,
the City Manager's findings of an emergency(s), waiving the
requirements for competitive sealed bidding procedures as
described on the exhibit(s) attached are ratified, approved and
confirmed, with funds allocated from the budgets of various user
department accounts.

Wagner Creek -Phase I and II
REFERENCES:
ENCLOSURES.
The project entitled `Wagner Creek -Phase I and 11, B-5679' was awarded at the May
21d, 2002 City Commission meeting (Resolution No. 02-585) to the lowest responsive
and qualified contractor, Shenandoah General Construction Company, pursuant to
formal invitation for bids dated March 12, 2002.
Subsequent to the awarding of the contract, it was determined that FEMA funding will
not be available for the construction of this portion of the Wagner Creek. It is now
necessary to change the funding source from FEMA Project No. 1345 to Stormwater
Utility Trust Funds. This change must be implemented on an emergency basis in order
to keep this crucial project on schedule to meet stormwater drainage demands now that
the current rainy season is well underway. Stormwater Utility Trust Funds are available
from CIP Project No. 352216, as appropriated by the Annual Appropriations and Capital
Improvement Ordinances, as amended, in the amount of $98,500 to cover the contract
cost and $30,036 to cover the estimated expenses, for an estimated total cost of
$128,536. This action shall be ratified at the next available City Commission meeting.

KzW in August 2001.
The most significant community center and gyri building a about six (6) to eight (8) weeks from completion. I( this prolect
scoduie holds, we pian to open the building in late February or early Mardi. There are certain site improvements which are not
part of the building construction cmhtrail that need to be done beige the park can be raAWed.
The most significant is the (2) exhsting small toilets in the "tows' shelter building constructed about 40 years ago which creed lo
be lot* re -furbished. in addition, there are site improvements stated by the United Way volunteers such as concrete walks th
play areas. benches. the chessboard plaza. and miscellaneous work that need to be kushed.
The general contractor wants to concentrate on fnisttirg the building and would rather not do anymore extra siteworik. The
genu contractors proposals for the extra work are priced on to high side. The proled tumdrg is tight and we are obfairw
some informal proposals from other contractors experienced in restroom reeowations. They also will guarantee completion of the
existing shelter rihhlets renovations and the ni=dWd ons additional sitework in time for to opening of the park. For e>omplo
one contractors price to renovate the two (2) existing toilets is $24,400. The price from the building general contractor. Ciao
Construction, is $70,370 for the same work. The other general contractor will also do. the miscellaneous concrete work and

To increase the Construction Contract

This memorandum serves to request your approval for an increase in the amount of the
previously approved funding for shelter renovations and sitework and for additional
funds for further needed improvements to the Virrick Park Community building. The
additional funding being requested is $9,885 for added sitework and up to another
$35,115 for necessary improvements to the Community Building as follows below.
On January 31, 2002, an emergency finding was approved for an amount up to $50,000
to renovate the existing shelter restrooms and to finish the sitework not completed by
United Way volunteers at the August 2001 "Kick -Off Event." After the original
Emergency Finding (dated 1/31/02) was approved, Public Works obtained informal bids
from three general contractors to do the work indicated above. The lowest bidder was
Professional General Contractors and they did a very good job of completing the work.
As the Virrick Community Center and the surrounding park were nearing completion,
there was some additional unexpected sitework that needed to be done for the opening
of the park.
Additional Site Work
The additional sitework included more ceramic file work for the pool building main
entrance, extra file for the shelter building,' extra tile for benches and the installation of
the 50 sculpture benches, site benches, replacement of two (2) pool building exterior
doors, installation of a new shelter restroom sewer line to the street, and miscellaneous
permit and insurance costs.
Because of the urgent need to complete the above extra work for use of the park during
this summer's recreation programs, and for the safety and welfare of the public using
the facilities, we recommend approval of this revision to previously approved
"Emergency Funding" to increase the construction contract with Professional General
Contractors, Inc. in the amount of $9,855 to cover the cost of this additional work.

Community Center Improvements
We are also requesting your approval to obtain informal proposals to fumish and install
or construct the following needed improvements for the Community Center Building that
are needed immediately for the safe and/or proper operation of the facility as follows:

Protective wall pads for the gym walls

Acoustic wall treatment in the gym
(Est.
$20,000)
3)
Dumpster enclosure on-site required by Zoning
(Est.
$ 5,500)

The Community Center Building is completed with a Certificate of Occupancy and the
Parks and Recreation Department is using the park for their Summer Program. The
protective wall pads are needed for safety and to fully utilize the gym for basketball and
other sports. The acoustic wall treatment is needed to improve the sound quality for
community use of the stage and AWTV systems. The dumpster enclosure is now a
citywide zoning requirement to improve the neighborhoods. Subject to your approval,
we will obtain at least three (3) bids for these items and have them installed or
constructed at the earliest date.
Funding Summary
The total additional funding being requested is as follows:
1. Additional Sitework $ 0,885
2. Community Center Building Improvements (up to) 35.115
Total $45,000
There is funding available for the increase in contract and the extra work under CIP
Project # 331316. If approved, this Revision and the original Emergency Finding will be
placed as soon as possible after this work is completed on the next available
Commission agenda for ratification and approval by the City Commission.
