BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. By a four-fifths (4/5th,) affirmative vote, the City Manager's findings of an emergency (s), waiving the requirements for competitive sealed bidding procedures as described on the exhibit(s) attached are ratified, approved and confirmed, with funds allocated from the budgets of various user department accounts. Jack on, Director _ Public Works Department On January 5, 2001 an emergency was established to seal coat, construct curbing, striping and additional signage for the Manuel Artime Community Center parking lot (attached memo). The work was informally bid and awarded io F & L Construction, Inc. for $36,018.00. After starting the work additional base cracking, failures and deficiencies were found in the parking lot and walkway areas. The hazardous and maintenance items need repairing to make the area safe for pedestrians and vehicular movement on the property. The additional work will repair trench settlement from prior electrical work and complete the re -surfacing of the parking lot. The contract with F & L Construction will be increased by $20,000.00 to complete the additional work. CDBG 2001 funds are available in CTP Account #322060 to cover the cost of the work. The Public Works Department and the Department of Public Facilities regommend that the work be done. This finding of emergency will be placed on the next available Commission agenda for ratification and approval by the City Commission. Gimenez City Manager Terry Buice, Acting Director Conference, Conventions and Public Facilities January 5, 2001 Manuel Artime Community Center Renovations -Emergency This memorandum serves to request your authorization for the emergency resurfacing and repair of the Manuel Artime Parking Lot that serves the theater building, the office building and the Ernesto Lecuona Park. There is also a need to relocate and add handicapped parking spaces for both buildings to comply with ADA requirements. An Emergency Finding memorandum was previously issued which included this project (see attached) showing the need to spend CDBG Funds prior to September 122000. The first phase of the project that deals with the preparation of blueprints, scope of work and specifications was done by Metric Engineering, who will serve as the project manager. The second phase of the project, the repair and resurfacing for the parking lot, was informally bid and awarded to F&L Construction, Inc. for 536,018.00. Due to the fact that the processing of paperwork was caught in the middle of the dateline, the prior Emergency Finding memorandum,does not comply in part for what it was issued (dateline), leaving in limbo the second phase of the project. Funds from CDBG are still available and will be used to complete the second phase of the project. The need for the repairs and resurfacing of the parking lot is imperative for the safety and well being of our tenants and clients and their private property. In the past we have had numerous problems with broken curbs and parking stoppers, exposing bare metal bars and causing damage to cars. Also, a suit has been initiated by a client who fell. ' Sediment Removal 4John Director Phases I and II Public Works Department The October 3-4, 2000 tropical storm resulted in flooded streets throughout the City. The flooding from the storm deposited an abnormal amount of silt and sediment in the storm sewer catch basin drains and drainage systems. The City has submitted claims to FEMA in the amount of 51,270,306 for Phase I and Phase II work projects to clean the stormwater drains and piping systems. It is most important that the drainage inlets and systems cleaning work be started to complete the work before the rainy season begins to alleviate any potential flooding due to clogged drains. This memorandum is to request your approval to informally bid the draia,'cleaning work and proceed with the work with the lowest responsible bidders, on an EMERGENCY basis. Because there are thousands of drains to clean, multiple contracts will be awarded to several bidders. Funding for the cost of the work is initially available from the Stormwater Trust Fund for projects and with 87.5% of the amount reimbursed by FEMA claims from the October 2000 storm drain cleaning.
