BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. By a four-fifths (4/5th,) affirmative vote,
the City Manager's findings of an emergency(s), waiving the
requirements for competitive sealed bidding procedures as
described on the exhibit(s) attached are ratified, approved and
confirmed, with funds allocated from the budgets of various user
department accounts.

This .memorandum requests your authorization to proceed with the emergency repairs of
the trusses that support the upper deck of the stadium as well as the required
engineering services for the design of these repairs.
While performing emergency remedial work on the cross bracing of the trusses that
support the upper deck of the Orange Bowl Stadium, a severe deformation was observed
on the bottom chord of the trusses. These members are made up of two back-to-back
angles, joined together by a steel spacer welded in between the two vertical legs that
make them work as one unit. This spacer had rusted away in several locations, causing
the members to split apart breaking the unity, and also threatening to break apart the
end connections.
This condition represents a serious threat to the welfare and safety of the public
attending stadium events, and needs to be corrected prior to the neh football soccer
game scheduled for January 6, 2001 between Guatemala and Costa Rica.
Time is of the essence to restore the structural integrity of the trusses within the period
of time available prior to the game. Additionally, this required remedial work is a
complement to the work being done for the cross bracing. Consequently, it is
recommended that Purchase Order No. 219022 to Professional General Contractors be
Increased, in the amount of $21,000.00 to cover the estimated construction cost of these
repairs. Funds are available from the Orange Bowl Ramp Repair Project, CIP No. 324002.
Additionally, it is also recommended to conduct a thorough investigation of the
structural steel members of the trusses supporting the upper deck, including framing,
bracing and supports on an emergency basis. We will obtain a report identifying the
necessary permanent remedial work, working drawings and an estimated construction
cost. Therefore, it is also recommended that Purchase Order No. 905234 to Bliss and
Nyitray, Inc. be increased in the amount of S15,000.00. Funds are available in the Orange
Bowl Repair Maintenance Outside, 404000-350503-670.

This memorandum serves to request your authorization to proceed with the emergency
repairs to several structural elements in the Orange Bowl Stadium.
While conducting remedial work to the structural framing in the Stadium's upper deck,
new areas were found showing severe deterioration due to the age of the structure. The
metal deck that conforms the composite system of the West End concourses, the interior
pedestrian ramps, as well as the concrete walkways in several locations around the
Stadium present signs of corrosion, sagging, and cracks at the supports. These
conditions must be repaired. It is most important that the identified areas be corrected
prior to the next football season.
The Department of Public Works will immediately start this remedial work through
multiple contracts, so as to accomplish the most critical repairs first. The remedial work
will be done so it will not interfere with the already scheduled events at, the Stadium.
The cost of the needed repairs will not exceed $500,000. This funding must be made
available in order to proceed with the work.

On January 30, 2001, you approved an Emergency Finding for Structural Repairs to the
Orange Bowl Stadium and authorized funding in an amount not to exceed $500,000.`
Our consulting engineers, Bliss & Nyitray, Inc., have been conducting detailed structural
inspections throughout the Orange Bowl Stadium. During their inspection they found
twelve (12) locations in the metal stands where the steel was cortoded and in need of
immediate repair. B&Y recommends that this condition be corrected immediately and
completed prior to the upcoming University of Miami Scrimmage/Select-a-Seat event at
the stadium on April 7, 2001.
This request is to increase Professional General Contractors, Inc: (PGC) existing
contract by $10,000. P.O. No. 219022, to cover the cost of steel repairs. PGC is at
present doing 'repairs to the upper trusses connections at the Stadium and can
commence these repairs immediately and be finished by April 7, 2001. Funds are
available from the Orange Bowl Ramp Repair Project CIP 324002.

This morwrandurn is to request your approval of an Emergency Finding to increase the existing
construction contract with Professional General Contractors, Inc. in the amount of 3110,000 for
emergency repairs to the Orange Bowl Stadium required by the "40 -year Structural
Recertification Report" prepared by Bliss 6t Nyitray, Inc., Structural Eq&eers.
The Orange Bowl Stadium is mainly a steel structure and over the years has been subject to the
deteriorating effects of our subtropical sah air environment. Under the recommendations of the
structural consultants, Bliss dt Nyitmy, the City has been making systematic structural repairs to
the stadium structure.
The contractor currently doing remedial work is Professional General Contractors, under the
project "Orange Bowl Stadium Emergency Structural Repairs, 2000-2001" (B4. 373). While this
work was in progress, the -Building requested a 40 -year recertification report for the
stadium Bliss & Nyitray, Inc. prepared the "Structural Recertification Report" (dated June
2001). They also prepared a detailed updated report on the existing "Structural Condition
Assessment" of the Orange Bowl Stadium (dated June 2001).
The Recertification Report defines those structural conditions observed that require kartiediate
remediation to meet the criteria for the 40 year Recertification of this facility. These repairs
must be completed in order to obtain the recertification. The "Structural Condition Assessment"
report includes the remedial work required for recertification and an extensive list of other
structural deficiMies that need repair.
Using funds availabk in the on-going Emergency Structural Repairs contract, the Public Works
Departmw directed Professional General Contractors to start work on the remedial repairs
required by the Recertification Report. When. the remedial work got underway, the concrete
encaserneut over the steel eolunmes that support the upper decks was removed for inspection and
it was found that extensive repair work would be required. Also, n>tmy structural commeetion
have been found to be much more damaged than anticipated. The remedial work needed will fax
exceed the original scope of work defined in the Recertification Report, and funds ava0able in
the existing Emergency Structural Repairs contract have been exhausted.

It is now recommended that the contract with Pro*96= l General Contractors for the "Orange
Bowl Stadium Emergency Structural Repairs, 2000-2001" be increased m the amount of
$114,000 to cover the esti hated cost of the repairs required by the 40 -year Recertification.
Funds for this increase are awilablc in CIP 324002. This Emwgcncy Finding will be placed on
the pilot available Commission Agenda for ratification.

This memorandum is to request a revision to an earlier Emergency Finding for repairs to
the Orange Bowl Stadium and to- request additional funding for more extensive
inspections and repairs.
On March 5, 2001, the Building Department notified the City's Office of Asset
Management that a "Recertification of Buildings 40 years Old or Older" is required for
the Orange Bowl Stadium, in accordance with Miami -Dade County Ordinance No. 75-34,
amended by Ordinance No. 92-1.
The structural engineers, Bliss & Nyitray, Inc., who are under contract to the City to do
an updated detailed structural assessment of the stadium structure, were authorized to
prepare the structural portion of the 40 -year Recertification report. In June 2001, they
issued their portion of the "40 -Year Structural Recertification Report for the Orange
Bowl Stadium". The report identified ten (10) typical deficiencies in the primary
structural members that needed further inspection, including the removal of the concrete
encasement of some structural members and any subsequent structural repair.
On October 22, 2001, you approved an Emergency Finding allocating additional funds to
the on-going structural repair contract with Professional General Contractors, for the
project "Orange Bowl Stadium Emergency Structural Repairs, 2000-2001 (B-6373)" to
pay for the additional remedial work and repairs necessary to obtain the recertification of
the Stadium.
The field conditions found after the concrete encasement removal during the actual
remedial work revealed that the damage to the main structural members of the stadium
was more severe and widely spread than originally anticipated. If not immediately
repaired these conditions could present a threat to the welfare and safety of the public.
These deficiencies also needed to be repaired to restore the structural integrity of the
stadium, and to meet the requirements for recertification.

It is now recommended that the contract with Professional General Contractors be
increased in the amount of $400,000 to cover the estimated cost of the additional repairs
necessary to meet the requirements of the 40 -year Recertification. Funds for this increase
are available under CIP 324002. This Emergency Finding will be placed on the next
available Commission Agenda for ratification.

and 12/28/01) and to the funding request memorandum (dated 227/02) for repairs to the Orange
Bowl Stadium. The existing funding for repairs will soon be depleted. The Budget Department
has identified $390,000 in available funds under CIP Project No. 324002 to continue the ongoing
emergency structural repair work in the Stadium.
The additional funds requested to complete the 40 -year re -certification work need to be
appropriated. This memorandum is to request your approval to immediately increase the existing
purchase order to the contractor, Professional General Contractors, Ir�c., in the amount of
$390,000 to continue on ongoing repair work. After your approval, the Public Works
Department will process the purchase order.

This memorandum is to request another revision to the earlier Emergency Findings
(approved 10/22/01, 12/28/01 and 3/22/02) for repairs to the Orange Bowl Stadium and

"There have been intensive inspections and remedial work underway since October 2001
to address the structural deficiencies requiring immediate repair to meet the requirements,
outlined in the "40 Year Structural Recertification Report" (Report) prepared by out

intensive and systematic inspections, B&N has now defused the specific scope of work.

Approximately $900,000 has been spent to date on emergency structural repair work

found that the corrosive damage to the existing structural steel is more extensive and
severe than anticipated by earlier inspections. As a result, the cost of required repairs has
increased. There is also other work, which is needed to improve the safety of the
stadium. This work must also be done immediately. The estimated additional funds
needed for this work are listed below:

This memorandum is to request your approval of an Emergency Finding to increase the existing
contract with Professional General Contractors, Inc. in the amount of $150,000.00. for the
emergency repair of several structural elements in the Orange Bowl Stadium, as requested by
Bliss & Nyitray, Inc. structural engineers for the "40 year structural recertification" of the
stadium.
Our consulting engineers Bliss and Nyitray, Inc. (B&N) have been conducting detailed structural
inspections throughout the Orange Bowl Stadium. During the inspection they found severe
deterioration on the supports of the four inner Field Lighting Tower of the stadium, as well as, in
the trusses that support the load of the tower, and the structural system that transfers that load to
the columns along the grid line M.
Because of the four towers are in cantilever, in the upper section of the 'stadium, B&N have
requested the immediate repair of these structural members and connections, as well as some 15
main "x" bracing found damaged inside the concessions stands
This request is to increase Professional General Contractors, Inc. (PGC) existing contract by
$ 150,000. P.O. No. 229101, to cover the cost of these repairs. PGC is at present doing structural
repairs a Stadium through the project Orange Bowl Stadium Emergency Structural Repairs 2000-
2001, B-6373 at the stadium and can commence these repairs immediately and be finished before
the next football season, on August 31, 2002. Funds are available from the Orange Bowl Ramp
Project CIP 324002.

This memorandum serves to request your authorization to proceed with the emergency
repair of several cross bracing supports under the Orange Bowl Stadium upper level.
The Orange Bowl staff requested an inspection of the cross bracing that ties the opposite
support of the trusses that support this upper deck of the stadium and provides lateral
stability to the framing of the structure. Juan Ordonez, P.E. Chief Structural Engineer for
the Public Works Department, determined that the structure was unsafe an required
immediate repairs.
The welding of the gussets plate that work as stiffener of the connection, at the intersection
of the cross bracing, had failed. This failure requires remedial work to be done on an
emergency basis before the next scheduled event to be held on October 7. 2000.
The estimated construction work for this project is $15,000. Funds are available from the
Orange Bowl Ramp Repair Project Number 324002.

Waiver of Formal Bids and
Permit Fees for River Drive
Warehouse Improvements
This memorandum serves to request your authorization for an "EMERGENCY
FINDING" Waiver of formal bids and building permit fees for immediate necessary
improvements to the River Drive Warehouse located at 1100 NW South River Drive,
Miami, FL 33125. This memorandum also includes a request for approval to increase
an existing construction contract, to obtain a required 40 -year re .certification report, an
updated building survey, and required testing reports.
The River Drive Warehouse is a City -owned property, which was formerly leased to the
Orange Bowl Committee, and now the City intends to use the warehouse as a leased
property and/or as a facility to house certain City operations. Before it can be occupied,
the warehouse is in great need of repairs and improvements, which includes but is not
limited to the following:
1. A new roof membrane system.
2. Renovations to the existing restrooms to comply with ADA.
3. Replace or repair damaged warehouse doors and windows.
4. Bring existing electric power and lighting systems up to Code.
5. Bring existing fire safety devices and sprinkler systems up to Code.
6. Miscellaneous demolition and building improvements.
7. 40 -year re -certification of the building and required repairs.._
8. Painting of the building. .
One of the intended warehouse uses is for storage for the "X -Games", which is coming
to Miami October 1, 2002. Time is of the essence substantially to complete the above
improvements by that time. There are only 6 weeks before October 1. It is highly
recommended that the existing construction contract between the City and Professional P, 447
General Contractors, Inc., for the Orange Bowl Stadium Structural Repairs (fie o.><cZA�;
increased by an amount approved by the City Manager based on a quantified written gArs.
proposal to do the above work so that the demolition and improvements immediately
begin and the project completed within the City's schedule. Professional General
Contractors, Inc. has done the Coconut Grove Convention Center restroom renovations
and Orange Bowl Stadium repair projects on time in the past for the City.

Because of the urgent need to expedite this project, we recommend approval of the
"EMERGENCY FINDING' to authorize waiver of formal bidding "procedures, waiver of
building permit fees, increase the existing contract with Professional General
Contractors, Inc., and approval to obtain the required 40 -year re -certification report, an
updated building survey, and required test reports.
The estimate of probable cost of this project is $500,000. There is existing funding
available to begin this work immediately under CIP 324002, "Orange Bowl Stadium
Improvements' pending appropriation of funds to a new capital project specifically for
the River Drive Warehouse Improvements at the next available City Commission
meeting scheduled for August 22, 2002. Any expenditures incurred on the River Drive
Warehouse Improvements project before the appropriation of funds to the new capital
project for the Warehouse project will be subsequently transferred to the appropriate
capital project after City Commission _approval of the project., In essence, the
Warehouse project will temporarily borrow funds from the Orange Bowl Stadium project
until the warehouse account is formally created and funded.

Commission agenda for ratification and ap al by the City Commission.

This memorandum is to request your approval of an Emergency Finding to increase the
existing contract with Professional Geheral Contractors, Inc. in the amount of $60,000
for the emergency replacement of the air conditioning equipment in the lower press
boxes and to waterproof the seating areas above the entrance to the Athletic Club.
During the process of making structural repairs and interior improvements to the lower
press boxes on the south side of the stadium, it was found that the existing air
conditioning equipment was in disrepair and not working efficiently. This equipment is
over ten (10) years old and is not cost effective to repair. It is recommended to
completely replace the air conditioning condensing units and air handling units at an
estimated cost not to exceed $45,000. "
In June and July during heavy rains, it was found that cracks and construction joints in
the seating areas above the Athletic Club entrance had bad water leaks, which need
immediate repairs. It is recommended that the waterproofing work being done over the
press boxes be extended to repair the water leaks over the Athletic Club entrance area
as well. The estimated cost is under $15,000.
These emergency repairs need to be completed before the start of the University of
Miami football season, which begins August 31, 2002. It is recommended that the
existing contract with Professional General Contractors, Inc. be increased by an
amount not to exceed $60,000 to cover the cost of the air conditioning equipment
replacement and the cost of waterproofing the seating areas above the Athletic Club
entrance. Funds are available from the Orange Bowl Stadium Repair Project, CIP No.
324002.

Warehouse Improvements
This memorandum is to request your authorization for a revision to the "EMERGENCY
FINDING" dated August 14, 2002 for the waiver of formal bids and permit fees for the
River Drive Warehouse Improvements.
The River Drive Warehouse Improvements project was being expedited for possible use
by the "X -Games" or by the City departments. At the time of the original "EMERGENCY
FINDING", it was contemplated that all of the repairs and improvements would be done
by a general contractor already under contract with the City. The general contractor did
all of the work except the roof replacement.
When the existing roof membrane and the warehouse roof structure were inspected by
the City's architect and outside roofing consultants, it was found that the existing roof
system was in very poor condition and needed total replacement. The existing roof
area is over 50,000 square feet and the roof structure below is of two (2) types of roof
deck, concrete or gypsum. The Florida Building Code has strict requirements for re-
roofing in Miami -Dade County. Although the general contractor did a good job of making
repairs and improvements, the roof replacement is totally independent work. It was
decided to receive competitive bids from roofing contractors who are manufacture
qualified and large enough to do a roof replacement of this size and complexity.
The original "EMERGENCY FINDING" specifically listed a new roof membrane system
as part of the scope of work. However, it did not specifically indicate that the City would
obtain competitive bids from roofing contractors and award the roof work to the lowest
responsive and responsible bidder. The City bid out the roofing work and received bids
from four (4) roofing contractors. The low bid was from National Roofing/South Florida,
Inc. Based on the low bid, the City is saving over $12,000 by directly contracting the
roof work. In addition, the City has obtained better prices on a better roof system.

We are requesting your approval so that a purchase order can be issued to the low
bidder, National Roofing/South Florida, Inc. in the amount of $258,700. Funding for the
project is in place under CIP No. 311709. The original "EMERGENCY FINDING" (dated
August 14, 2002) and revision will be placed on the next available Commission agenda
for ratification and approval by the City Commission.
