A RESOLUTION OF THE MIAMI CITY COMMISSION,
WITH ATTACHMENT(S), BY A FOUR-FIFTHS (4/5 THS )
AFFIRMATIVE VOTE, RATIFYING, APPROVING AND
CONFIRMING THE CITY MANAGER'S FINDINGS OF AN
EMERGENCY(S), WAIVING THE REQUIREMENTS FOR
COMPETITIVE SEALED BIDDING PROCEDURES AS
DESCRIBED ON THE EXHIBITS) ATTACHED AND
INCORPORATED; ALLOCATING FUNDS FROM THE
BUDGETS OF VARIOUS USER DEPARTMENT ACCOUNTS.
BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. By a four-fifths (4/5th,) affirmative vote,
the City Manager's findings of an emergency (s) waiving the
requirements for competitive sealed bidding procedures as
described on the exhibit(s) attached are ratified, approved and
confirmed, with funds allocated from the budgets of various user
department accounts.

Section 2. This Resolution shall become effective

This memorandum serves to request your authorization to proceed with the
Informal bidding and award to the lowest responsible bidder of the Buena Vista
Restrooms Building Project, B-6333. This is a Safe Neighborhood Parks Bond
project, which consists of the coristruction of a new 1200 square foot building to
house a park office, restrooms and a limited storage area at Buena Vista Park In the
Little Haiti area. The Parks and Recreation Department, with the cooperation of
the Communities United neighborhood organization, has determined that a crucial
need exists to have the restroom building completed for use for the summer
lunch program by June 2000..
in order to meet the above schedule, construction must be under way by March
2000. The Public Works Department has the plans ready for bid, with an estimated
cost of $100,000. Funds are available from the Safe Neighborhood Parks Bond
Program. _ This request is for your approval in establishing that emergency
circumstances exist, necessitating taking informal bids, awarding and executing a
contract with the low bidder, and proceeding with the building construction so as
to finish by June 2000. The award of the contract will be placed on the next
available Commission agenda for ratification and approval by the City Commission.

Waiver of Formal Bids for
Stormwater Pump Station
Maintenance

Based on my investigation, and an, evaluation by the Miami -Dade Water and Sewer
Department, of the condition of the City's four stormwater pumping stations, I have found
that an EMERGENCY exists concerning maintenance of the pump stations which
justifies the selection of a maintenance contractor by informal bids.
The City has four stomvwater pumping stations (1 each) located at 1301 NW 6 Street,
1701 NW 7 Street, 1630 NW 4 Avenue and 342 SW 7 Avenue.
Since 1975, the Miami -Dade Water and Sewer Department has been operating and
maintaining the City's stormwater pump stations under an informal agreement. Certain
operating and safety deficiencies have caused the Director of the Miami -Dade Water
and Sewer Department to issue a letter of notice to the City on February S. 2000, that his
department has discontinued operational and maintenance service of the pump stations.
The Public Works Department has retained a consultant to immediately prepare plans
and specifications for the upgrading of the pump stations, with the safety improvements
given priority status. However.. due to the approaching rainy season, it is essential that a
maintenance contractor be retained to operate and maintain the pump stations during
the renovation period in order to avoid any interruption in service.
The estimated cost of the operational and maintenance service is $8,000 per month for
all four pump stations until the i npi ovements are complete, at which time a permanent
operation and maintenance program will be implemented.
Such conditions indicate the need for extraordinary meawres to pnoted the health.
safety and welfare of the community and the residences in the floor prone areas of the
City. In order to initiate the interim operation and maintenance service as soon as

possible. formal competitive sealed bid procedures shall be waived for the procurement
of contracting services required for said emergency pursuant to sections 1843 and IS.
84 of the City Code. Informal bids shall be obtained and a contract shall be awarded by
the City Manager to the bwest responsive and qualified bidder. This action shall be
ratified at the next available City Commission meeting.
Funds for the aforesaid pump station maintenance and operations service costs are
available from the Stormwater Utility Trust Funds. The amount required for the balance
of FY'00 is $48,000. It is requested that the Budget Department be directed to provide
the required funds from the Stonmwater Ut6Tdy Trust Funds for this emergency
expenditure.
